Notice is hereby given that the City Council of the City of Fridley,Minnesota (City)will hold apublic hearing
on
Monday,April 24,2023 at 7:00 p.m.,or as soon thereafter as the matter may be heard
at the City Council chambers on the upper level of the Civic Center,located at 7071 University Avenue N.E.
in the City,regarding the adoption of an ordinance to establish the Innsbruck North Housing Improvement
Area (HIA);and the adoption of aresolution imposing fees on housing units within the HIA,all under
Minnesota Statutes (M.S.)§428A.11 to 428A.21,as amended (HIA Act).
The boundaries of the proposed HIA areshown in the map attached hereto as Exhibit A.Within the HIA,the
City proposes to facilitate various improvements to the housing units in the HIA.The improvements would
be financed by fees imposed on the owners of units (Fees).Details regarding the hearing,the improvements,
and the Fees areasfollows:
1.Persons to be heard:All persons owning housing units in the proposed HIA that would be subject to
the Fees,and all other interested persons,will be given an opportunity to be heardatthe hearing.
2.Proposed improvements:The proposed improvements include site and utility improvements,
including but not limited to the replacement of all streets and driveways;the addition of new curbs
and gutters;the replacement or improvement of sanitary and storm sewer mains;the correction of
drainage issues within the HIA;the replacement and renovation of retaining walls,paths,sidewalks,
stairways,and concrete mailbox pads;and the replacement of the tennis court with green space.
3.Estimated cost of improvements to be paid in whole or in part by the Fees:The total estimated
project cost is $5,710,000 which includes construction costs,bond issuance costs,capitalized interest,
professional services costs,and the City’sadministrative costs.Aportion of the project costs will be
paid with equity of the HIA in the amount of $920,000.The total estimated project cost to be paid
from the Fees is $4,790,000.
4.Amount to be charged against each housing unit:The total costs will be allocated equally to each
housing unit in the HIA,equaling an estimated per-unit fee of $16,986 (Unit Fee).If aunit owner fails
to pay the Unit Fee prior to June 23,2023 (Prepayment Date),interest will accrue on Unit Fee at an
estimated rate not to exceed 7.25%per annum and the Owner will be charged an estimated annual
fee of $1,716.36 (Annual Fee)for aperiod of 20 years,assuming no prepayment,is estimated to be

5.Owner’sright to prepay the Unit Fee:Owners may prepay the Unit Fee without interest,in whole
but not in part,beforethe Prepayment Date.After the Prepayment Date,the Fee may not be
prepaid.The unpaid balance will be imposed as an Annual Fee as described in paragraph 4above.
6.Number of years the Annual Fee will be in effect:If owners do not pay the Unit Fee by the
Prepayment Date,the Annual Fee will be imposed and collected at the same time and in the same
manner as property taxes.The Annual Fee will be payable in equal installments over aperiod not to
exceed 20 years beginning in 2024.
7.Compliance with Petition Requirement:Owners of morethan 60 percent of the housing units that
would be subject to the Fees in the proposed HIA have filed apetition with the City requesting a
public hearing on the proposed Fees,the creation of the HIA and the adoption of an ordinance
(Ordinance).This meets the petition requirements for apublic hearing under Minnesota Statutes,
Section 428A.12 and the City’spolicy.

Those who wish to provide comments may do so by attending the meeting in person or submit comments

included as attachments to the Agenda Report.All comments received after that will be given to the City
Council at the beginning of the meeting and entered into the public record.
Written or oral objections asserting that the owner’sproperty should not be included in the HIA or should
not be subjected to afee and objecting to the inclusion of the housing unit in the HIA,for the reason that
the property would not benefit from the improvements must follow M.S.§428A.12,subd.4.
Housing unit owners subject to the Fee will also have aright to veto either the ordinance,the fee resolution,
or both following the adoption of the ordinance and the fee resolution.If owners of at least 45%of the
housing units within the HIA file an objection with the City Clerk beforethe effective date of the ordinance
or the resolution the HIA will not become effective.
