Public Hearing andResolution No. 2023-121, Adopting the Assessment for 2023Nuisance Abatements
and 2023Rental Reinspection Fees
Background
Pursuant to Minnesota Statue § 429.021 and the Assessments Chapterof the Fridley City Code (Code),
the Fridley City Council (Council) may finance certain public improvement, including nuisance
abatements, using special assessments. Generally, special assessments are a form of tax levied by a local
government against a property that benefits from the improvement(s). As part of this process, the
Council must conduct a public hearing to accept comments regarding the proposed assessments.
On September 11, 2023, the Council declared the costs to be assessed, ordered the preparation of a
proposed assessment roll and scheduled a public hearing forOctober 9, 2023for the 2023Nuisance
Abatements and 2023Rental Reinspection Fees(Resolution No. 2023-100). The Public hearing notice
was published onSeptember 18, 2023. At that time, the
proposed assessment roll included 63properties with assessments totaling approximately $81,707.
Sincethe publication and mailed notice(Exhibit C)to individual property owners, the proposed
assessment roll includes 56properties (Exhibit A) with assessments totaling about $78,670,which
includes a25% fee to support the administrative costs associated with the abatements. In addition, this
cost includes all incidental expenses as allowed by the Assessments Chapter of the Code. The proposed
assessment will be certified for one year at an interest rate of 10.5%.
Financial Impact
The proposed assessment reflects costs already incurred by the City to abate nuisances and perform
rental reinspection within the community. The Adopted2023Budget contained sufficientbudget
authority to support these costs.
Recommendation
Staff recommend the City Council conduct the public hearing and approve Resolution No. 2023-121.

Resolution No. 2023-121
Adopting the Assessment for the 2023 Nuisance Abatements and 2023 Rental
Reinspection Fees
Whereas, pursuant to proper notice duly given as required by State law, the Fridley City Council
has met and heard and passed upon all objections to the proposed assessment for the 2023
Nuisance Abatements and 2023 Rental Reinspection Fees.
Now, therefore be it resolved, by the City Council of the City of Fridley hereby approves:
1.!Such proposed assessment, a copy of which is attached hereto and made a part hereof, is
hereby accepted and shall constitute the special assessment against the lands named
therein and each tract of land therein included is hereby found to be benefited by the
proposed improvement in the amount of the assessment levied against it.
2.!Such assessment shall be payable in equal annual installments extending over a period of
one year, the first of the installments to be payable on or before the first Monday in January
2024 and shall bear interest at the rate of 10.5% per annum from the date of the adoption
of this assessment resolution. To the first installment shall be added interest on the entire
assessment from the date of this resolution until December 31, 2024.
3.!The owner of any property so assessed may, at any time prior to certification of the
assessment to Anoka County (County), make one payment of at least one hundred dollars
($100), to the City of Fridley; no interest shall be charged if the entire assessment is paid
within 30 days from the adoption of the assessment. A property owner may pay to the City
of Fridley (City) the entire amount of the assessment remaining unpaid, with interest
accrued to December 31 of the year in which such payment is made. Please note, no
payments will be accepted between November 15 and December 31 of any year.
4.!Upon receipt of any such prepayment, the City Clerk, with the assistance of the City
Treasurer, shall note the same upon the records of the City, credit the payee therefore, and
reduce the assessment as originally made in the amount of the prepayment received. The
balance remaining shall then be noted as the amount due and may then be certified to
the County together with and as a part of the assessment roll in which the original amount
due was contained.
5.!The City Clerk shall forthwith transmit a certified duplicate of this assessment to the County
Auditor to be extended on the property tax lists of the County. Such assessments shall be
collected and paid over in the same manner as other municipal taxes.
