Honoringand Remembering Veterans
Whereas, thehonor, sacrifice, dedication and contributions of themen and women who served
in the Armed Forces and National Guard have been vital in maintaining our freedoms and way of
life; and
Whereas, the freedoms we enjoy as Americans do not come without a price
veterans have sacrificed to preserve and protect our country and constitution from all enemies
foreign and domestic;
Whereas,through their selfless service, these dedicated members of our Armed Forcesand
National Guard have kept America strong, inspired generations through their patriotic service,
and proved their heroism and love of country time and again while helping to define the character
of our nation; and
Whereas, we can never fully repay our debt of gratitude to those heroic men and women who
served, were wounded, or died in battle,or those who are now serving our Country;
Whereas,Veteransare inspiring reminders of the patriotism, spirit, and courage of all who served
al Guard, and we pay tribute to them, extending our

8. Resolution No. 2023-127, Approving Change Order No. 1 (Final) for West Moore Lake Mill and
Overlay Project
Brandon Brodhag, Assistant City Engineer, provided background information on the project noting
that substantial completion of the project occurred in September. He provided a summary of the
change order in the total amount of $12,771.20 which increases the contract amount by 7.7 percent
but is still within the budget for the project. He provided additional details of the change order items
including adjust gate valve and manhole castings, pavement striping, and bituminous wear course.
Staff recommends approval of the resolution as presented.
Mayor Lund commented that it was a worthwhile project to do.
Motion made by Councilmember Tillberry to adopt Resolution No. 2023-127, Approving Change
Order No. 1 (Final) for West Moore Lake Mill and Overlay Project. Seconded by
Councilmember Bolkcom.

9. Resolution No. 2023-128, Awarding 61 Avenue Parklet Project
Mr. Brodhag provided background information on the process leading to this project. He stated that
the City received $704,668 in federal grant funds from Anoka County through the Community
Development Block Grant program for this project. He displayed the preferred concept for the site
and information on the proposed site features for the site. He provided details on the project bidding,
noting the low bid of $444,452.17 by Winberg Companies. He noted that although the bid is 5.6
He reviewed the tentative project schedule and stated that staff recommends approval of the
resolution as proposed.
Mayor Lund asked about the excess grant funds above the bid price and whether the City would have
to return unused funds.
Mr. Brodhag replied that the City will be maximizing the grant funds by purchasing the site features.

Motion made by Councilmember Tillberry to adopt Resolution No. 2023-128, Awarding 61 Avenue
Parklet Project. Seconded by Councilmember Bolkcom.

Open Forum, Visitors: (Continued)
Ruqiya Jama, a Brooklyn Park resident, expressed concern about mental health and policing. She
provided details on a mental health crisis that occurred with her sister on September 16, 2023. She
explained that they decided to send her sister to the closest hospital, which was Mercy Unity campus.
She spoke about mistreatment of her sister and her family, and the injuries sustained by her sister from
those providing her care at the hospital. She commented that there is a current investigation by the
Fridley Police Department, but only a fraction of the violations are being investigated. She stated that
the State and City have failed her sister by not completing a thorough investigation. She asked the
Council for assistance and provided some suggestions.
Mayor Lund commented that he would be happy to look into the issue to gain more information and
follow up with Ms. Jama.

Councilmember Bolkcom thanked all the volunteers and staff who assisted with Pumpkin Night in the
Park.

2.Public Hearing to Consider Plat Request, PS #23-02 for the City of Minneapolis

public hearing was opened at 7:01p.m.
Stacy Stromberg,Planning Manager, presented a plat request from the City of Minneapolis. She noted
that the Commission reviewed a similar request in April of 2023 and after that public hearing, the City
amended its request to create two lots instead of one tobetter define the property lines for the
Minneapolis Waterworks and the Minneapolis Emergency Operations Training Facility. She noted that
the 150-acre property is made up of several different parcels, unused alleys, and public rights-of-ways.

The replat will create two lots, lot one will be 127 acres and lot two will be 11 acres, with 11.85 acres
dedicated to the East River Road right-of-way. She stated that staff recommends approval of the request.
Commissioner Meisner asked the purpose in changing the request from one parcel to two parcels. John
Howe, Minneapolis Water, stated that they decided on two lots to separate the training facility from the
Waterworks facility.
Commissioner Klemz asked if there were plans for construction on the site. Mr. Howe replied that nothing
will be changing, and this is just to formalize the use of the land.
Commissioner Meisner asked if the replatting of the alleys would come before the Planning Commission.
Ms. Stromberg replied that vacation of right-of-way and alleys would go before the Council. She provided
a brief history on how the land became part of the City of Fridley when the City was incorporated and
noted that this action would clean up this plat/property. She confirmed that there would not be utilities
impacted by the vacation of the alleys/right-of-ways.
Motion by Commissioner Klemz to close the public hearing. Seconded by Commissioner Heuchert.
Upon a voice vote, all voting aye, Acting Chair McClellan declared the motion carried unanimously and the
public hearing was closed at 7:09 p.m.
Motion by Commissioner Meisner recommending approval of Plat Request PS #23-02 City of Minneapolis.

Background
Stonebrooke Engineering (Petitioner) on behalf of the City of Minneapolis is requesting toreplat the
property at 4300 Marshall Street to create 2 lots, one for the Waterworks facility and one for the
Minneapolis Operations Training Facility(PS #23-02).
The Petitionerhad submitted a plat request earlier this
year to create one lot;however,after the Planning
Commission meeting,they decided to withdraw that
request and have theplat redrawn to create two lots.

The 150-acre property itself is made up of several
different parcels and unused alleys and public right-
of-ways. The Petitioner on behalf of the City of
Minneapolis would like to replat the property to create
two lots. Lot 1 will be 126.85 acres in size and will
encompass the land for the Minneapolis Waterworks
facility. Lot 2 will be 10.70 acres in size and is the land
used for the Emergency Operations Training Facility.
There will also be 11.85 acres dedicated to the East
River Road right-of-way.
A Notice of Public Hearing before the Planning Commission was published in the October 6, 2023,
edition of the Star Tribune.
The Planning Commission held a public hearing for PS #23-02 at their October 18, 2023,meeting. After
a brief discussion, the Planning Commission recommended approval ofthePlat. The motion carried
unanimously.

Resolution No. 2023-131
Approving a Preliminary Plat, PS #23-02 Petitioned by Stonebrooke Engineering on behalf
of the City of Minneapolis for the Property Located at 4300 Marshall Street N.E.
Whereas, Chapter 211 of the City Code establishes standard procedures, requirements, and
conditions for preparation, submission, and approval of land subdivisions; and
Whereas, Stonebrooke Engineering (Petitioner) submitted a preliminary plat application on
August 18, 2023 for the property at 4300 Marshall Street N.E., legally described in Exhibit A; and
Whereas, the Planning Commission held a public hearing for Preliminary Plat, PS #23-02 on
October 18, 2023 and recommended approval of said plat; and
Whereas, the City Council approved the preliminary plat for Water Plant Addition at their
November 13, 2023 meeting; and
Whereas, a copy of the preliminary plat for Water Plant Addition is attached as Exhibit A.
Now, therefore be it resolved, that the City Council of the City of Fridley approves Preliminary
Plat, PS #23-02 and directs the Petitioner to prepare the final plat documents to be submitted to
the City for approval within six months of the date the Council approved the preliminary plat or
said approval shall become null and void.

Approving a State of Minnesota Voting Operations, Technology and Elections Resources Account
County-Municipality Agreement
Whereas, pursuant to Chapter No. 4 of the Fridley City Charter, the City of Fridley (City) shall hold
elections every even numbered year or conduct a special election if ordered by the Fridley City Council;
and
Whereas, the City partners with the Anoka County (County) to facilitate elections-related activities; and
Whereas, the County partners with every city, school district and township within its jurisdiction; and
Whereas, a Joint Powers Agreement (JPA) was created to reduce costs by streamlining operations and
eliminate redundancies where election services were concerned throughout the County; and
Whereas, the City entered a JPA with Anoka County in 2013 for elections-related services and
equipment; and
Whereas, the JPA was subject to automatic renewal unless the City or County proposed updated terms;
and
Whereas, the State of Minnesota (State) has given the County a disbursement from the Voting
Operations, Technology and Election Resources Account to be given to each Municipality; and
Whereas, the County has given each Municipality the option to have the County hold onto these funds
and use them to offset that amount of their annual JPA fees; and
Whereas, the City has chosen to allow the County to hold these fees to offset the amount of the annual

VOTING OPERATIONS, TECHNOLOGY & ELECTION RESOURCES (VOTER) ACCOUNT
COUNTY MUNICIPALITY AGREEMENT
This Agreement Anoka County ("County"),
and the City of Fridley.
Recitals
1.!Under Minnesota Laws 2023, Chapter 62, Article 4, section 6, the Voting Operations, Technology, and
Election Resources (VOTER) Account was established requiring the Office of the Secretary of State,
hereinafter the OSS, to distribute funds to each county as prescribed.
2.!Total allocation to County is approximately $67,239.04 annually.
3.!Upon receipt of funds, County and Municipality must agree on a distribution plan for allocating funds from
the account which must be used for expenditures directly related to election administration.
4.!County is responsible for elections within its county and Municipality operates polling places
within its jurisdiction.
Agreement
1. Effectiveness of Agreement
1.1.!Effective date. October 30, 2023, or the date all required signatures have been affixed to the agreement
by County and Municipality, whichever is later.
Њ͵Ћ!Annual Renewal. This agreement shall remain in effect and renew annually until such time that the
County or the Municipality notifies the other party in writing of its desire to terminate the Agreement. The
termination will be effective December 31 of the year of notice,
Њ͵Ќ!Application of terms. Municipality agrees to be subject to the obligations applicable to County in the
Agreement set forth in said agreement.
2. Allocation of VOTER Account Funds
2.1.!Allocation determination. The Municipality agrees to receive no direct allocation under this agreement.
County for qualifying expenditures of the County and the Municipality as referenced in this Agreement.
2.2.!Allocation methodology. The County will utilize the provided OSS default allocation as a consistent and
equitable distribution of VOTER account funds for qualifying expenditures for all municipalities.
2.3.!Maximum available amount. Based on the OSS default allocation, Municipality is allocated no more than
$2,441.00 for qualifying expenditures described in the Agreement and in accordance with all federal and
state laws authorizing these expenditures.
3. Use and Maintenance of VOTER Account Funds
3.1.!Municipality authorization. Municipality agrees to authorize County to expend the allocated amount for
authorized purposes on behalf of Municipality.
3.2.!Segregation of funds. County must segregate all funds in an election funding account.
3.3.!Maintenance of funds. County must maintain the funds in the segregated account until spent for any
authorized purposes described in the Agreement.

3.4.!Authorized purposes. County may use the funds provided under the Agreement for expenditures directly
related to election administration as defined in Minnesota Statutes section 5.305.
3.5.!Reporting requirements. County agrees to provide any required information to OSS to meet reporting
requirements outlined in statute for all funds expended for each calendar year by December 31 annually.

Attached is Resolution 2023-135, required as part of the application for State of Minnesota
appropriation of funds in the amount of $500,000 for an inclusive playground at Commons Park. Efforts
to support this project in the legislature were supported by Allina Health, Gillette Children's Hospital,
Minnesota Consortium for Citizens with Disabilities, Multicultural Autism Action Network and The Arc,
Minnesota.
Financial Impact
The total project cost for the planned inclusive playground at Commons Park is expected to be a
minimum of $1 million, with half of the funding being accepted as a special appropriation from the

Authorizing Special Appropriation Application to State of Minnesota for Fridley Inclusive
Playground
Whereas, the City of Fridley (City) submitted an application to the State of Minnesota (State) for
funds in the amount of $500,000 for an inclusive playground at Commons Park; and
Whereas, the total project cost for an inclusive playground at Commons Park is expected to be a
minimum of $1 million; and
Whereas, the Special Appropriation Application submitted to the State serves as a local match
Improvement Plan.
Now, therefore be it resolved, by the City Council of the City of Fridley as follows:
1. The City will act as the legal sponsor for the project contained in Chapter 71, Article 1,
Section 14, Subdivision 18, entitled Fridley Inclusive Playground.
2. The City has the legal authority to receive financial assistance, and the institutional,
managerial, and financial capability to ensure adequate project administration.
3. The sources and amounts of the local match identified in the development proposal are
committed to the project identified.
4. The City has not violated any Federal, State or local laws pertaining to fraud, bribery, graft,
kickbacks, collusion, conflict of interest or other unlawful or corrupt practice.
5. Upon approval of its development proposal by the State, the City may enter into an
agreement with the State for the above-referenced project(s), and that the City certifies that
it will comply with all applicable laws and regulation as stated in all contract agreements.
6. The non-DEED source(s) of funds identified in the sources and uses outline in the application
total the amount of $500,000 and are committed and adequate to fully fund or provide the
match for the project identified in the application.
7. Any funds to fully fund the project shall be from the Parks Capital
account which has an adequate amount of funds to cover the commitment.
8. The City Manager is hereby authorized to execute such agreements as are necessary to
implement the project(s) on behalf of the City.

Background
The City Charter (Charter) is the fundamental law which defines the authorities and powers of the City
of Fridley (City). Minnesota Statute (M.S.) § 410.05 authorizes the establishing of a Charter Commission
(Commission) comprised of fifteen court-appointed residents who meet approximately seven times per
year to discuss and refine the Charter in response to the needs of the community.
On November 6the Commission finalized itsreview of Chapter 4, Nominations and Elections. Pursuant
to M.S. § 410.12, subd. 7, the recommended revisions to the Chapter were compiled into Ordinance No.
1417.Resolution No. 2023-136schedules a public hearing for the ordinance on November 27.

Scheduling a Public Hearing on November 27, 2023 on a Proposed Amendment to the
Fridley City Charter Chapter 4, Nominations and Elections
Whereas, pursuant to Minnesota Statute § 410.12, Subd. 7, the Fridley City Council may amend the
City Charter by ordinance upon recommendation of the Charter Commission; and
Whereas, the Charter Commission reviewed, discussed and recommended an amendment by
ordinance to Chapter 4, Nominations and Elections, on November 6, 2023; and
Whereas, within one month of receiving a recommendation to amend the Charter by ordinance, the
City must publish Notice of a Public Hearing (Notice) on the proposal; and
Whereas, the Notice must contain the text of the recommended amendment (Exhibit A).
Now, therefore be it resolved, that the City Council of the City of Fridley hereby schedules a public
hearing for November 27, 2023 in the Council Chambers of the Fridley Civic Campus, 7071 University
Avenue NE, Fridley, Minnesota at 7:00 p.m. to consider an amendment to the Fridley City Charter
Chapter 4, Nominations and Elections.
Be it further resolved, that the City Council directs the City Clerk to publish the text of the
recommended ordinance, as shown in Exhibit A in full at least two weeks but not more than one
month before the Public Hearing in the Official Publication.

Notice is hereby given that there will be a public hearing of the Fridley City Council at the Fridley
Civic Campus, 7071 University Avenue NE, Fridley, Minnesota, on November 27, 2023 at 7:00 p.m.
for the purpose of conducting a public hearing on the following amendment to the City Charter:
Ordinance No. 1417
Amending the Nominations and Elections Chapter of the Fridley City Charter
The Fridley City Charter Commission has completed its review of Fridley City Charter Chapter 4
and has recommended an amendment of the City Charter by Ordinance to the City Council on
November 6, 2023. The Fridley City Council hereby finds after review, examination and
recommendation of the Charter Commission that the Fridley City Charter should be hereby
amended and the City of Fridley does ordain:
Fridley City Charter
Chapter 4. Nominations and Elections
Section 4.01. General Election Laws to Apply
Except as hereinafter provided, the general laws of the State of Minnesota pertaining to registration
of eligible voters and the conduct of primary and general elections shall will apply for all municipal
elections of such officers office as are specified in this Charter. The Council shallwill, through
ordinances duly adopted in compliance with such state lawsMinnesota Statute (M.S.) and this Charter,
adopt suitable and necessary regulations for the conduct of such elections.
Section 4.02. Regular Municipal Elections
On the first Tuesday after the first Monday in November, municipal general elections shall must be
held, at such place or places as the City Council may designate by resolution. General municipal
elections shall must be held every even numbered year. The Council may divide the City into as many
voting precincts as it may from time to time deem necessary. Each ward shall will constitute at least
one (1) voting precinct and no precinct shall may be in more than one (1) ward. At least fifteen (15)14
days' notice shall must be given by the City Clerk of the time and places of holding such election,
and of the officers offices to be elected, by posting a notice thereofNotice of Election in at least one
(1) public place in each voting precinct and by publishing a notice thereofa Notice of Election at least
once in the official newspaperOfficial Publication of the City., but failure Failure to give such notice
shall will not invalidate such election.
Section 4.03. Primary Elections

There shall must be a primary election, on the date established by Minnesota State LawM.S., for the
selection of two (2) nominees for each elective office at the regular municipal election, unless only
two (2) nominees file for each elective office. Primary municipal elections shall be held every even
numbered year, if necessary.
Section 4.04. Special Elections
The Council may by resolution order a special election, fix the time of holding the same, and provide
all means for holding such special election, provided that a Notice of Election was published in the
Official Publication three (3) weeks' published notice shall be given ofprior to said special election.
The procedure at such elections shall must conform with all election regulations established in M.S.
as nearly as possible to that herein provided for other municipal elections and Minnesota Election
Laws. Special elections for vacancies in the City Council shall will be held in accordance with provisions
of Section 2.062.07.
Section 4.05. Judges of Election
The Council shall must at least twenty-five (25) days before each municipal election appoint
two (2) three eligible voters for each voting precinct to be election judgesElection Judges and
one (1) registered voter to be head election judgeHead Election Judge;, or as many election
judgesElection Judges as may be determined by the city clerkCity Clerk. No person signing
or circulating a petition of nomination of candidate for election to office or any member of a
committee petitioning for a referendum or recall shall be eligible to serve as a judge of such
election.A person is ineligible to serve as an Election Judge if they:
Signed a Nomination Petition;
Circulated a Nomination Petition; or
Was a member of a committee petitioning for a referendum or recall.
Pursuant to M.S. § 204B.19, the City may establish additional requirements that are not inconsistent
with State law M.S. and which relate to the ability of an individual to perform the duties of an Election
Judge.
Section 4.06. Nominations by PetitionNominations of Municipal Candidates
The mode of nomination of all elective officers provided for by this Charter shall must be by petition.
The name of any eligible voter of the City shall must be printed upon the ballot whenever a petition
as hereinafter prescribed shall have properly filed Nomination Petition been filed in on that person's
behalf with the City Clerk. Such petition shall must be signed by at least ten (10) registered voters
qualified to vote for the office in question. No elector shallperson may sign more than one petition
Nomination Petition for any office for which there is an election. Should such a case occur, the
signature shall be void as to the petition or petitionswill be voided on the Nomination Petition last
filed. All nomination petitionsNomination Petitions shall must be filed with the City Clerk in
accordance with Minnesota State StatutesM.S. Each petitionNomination Petition, when presented,
must be accompanied by a ten dollar ($10.00) filing fee.

Section 4.07. Nomination Petitions
The signatures to the nomination petition need not all be appended to one (1) paper, but to each
separate paper there shall be All Nomination Petitions must have an attached a notarized affidavit of
the circulator stating:
1. the number of signers of such paper;
2. that each signature found on a Nomination Petition appended thereto was made in the
circulator's presence; and
3. that it is the genuine signature of the person whose name it purports to be.
With each signature there shall must be the printed name, birth year, and address of the signer,
giving the street and number or other description sufficient to identify the same. The nominee must
shall indicate by an endorsement upon the petition acceptance of the office if elected thereto sign
the Nomination Petition.

Section 4.08. Write-In Candidates

A candidate for any city City office who wants write-in votes for the candidate to be counted must
file a written request with the filing office for the office sought no later than the seventh (7th) day
before the primary, general or special municipal election. The city clerkCity Clerk shall must provide
the form to make the request.
Section 4.09. Canvass of Elections and Taking of Office
If more than two candidates filed for office, the Council must meet and canvass the primary election
returns on the third calendar day after any primary election. The two candidates for each office who
receive the highest number of votes shall will be nominees for the office named. Their names shall
must be certified by the city City clerk Clerk to the county auditorCounty Auditor who shall must
place them on the municipal general election ballot without partisan designation. The Council shall
will meet and canvasto canvass the general (regular) election or special election returns between the
third and tenth calendar days after any regular or special election, shall make full declaration of the
results, and file a statement thereof with the City Clerk. Said statement shall must be made a part of
the minutes. This statement shall must include:
(a) the total number of votes cast;
(b) the total number of individuals registered before 7:00 am on election Election day

(d) a true copy of the ballots used;

Background
In conjunctionwith the replat application for the Minneapolis Waterworks and Minneapolis Emergency
Operations propertyat 4300 Marshall Street, the City of Minneapolis is also requesting to have the
existing streets, alleys, and a public road easement vacated. These platted streets, alleys, and public
road easement areon private property and areaccessible to the public.
The alleys to be vacated were platted as part of the Berlin plat that was recorded in 1884. Marshall Street
No. 39, which was recorded in 1939.
Approving the vacations will clean up the lot tosimplify the legal descriptions. The City of Minneapolis
has their own water and sewer service to the property, so additional utility easements are notrequired
as part ofthis plat.
A Notice of Public Hearing before the City Council was published in the October 27, 2023,and November
3, 2023, editionsof the Official Publication.

Whereas, on September 15, 2023, Stonebrooke Engineering on behalf of the City of Minneapolis,
submitted a request to vacate streets, alleys, and a public road easement within the property
owned by the City of Minneapolis, generally located at 4300 Marshall Street N.E.; and
Whereas, notice of a public hearing concerning the requested vacation was provided in
accordance with Fridley City Code § 205.05.08 and a public hearing was held on said request at
the Fridley City Council (Council) meeting on November 13, 2023, at the Fridley City Hall, 7071
University Avenue N.E.; and
Whereas, at the Council Meeting on November 13, 2023, the Council proceeded to hear all
persons interested in said vacation request and the Council considered the request for said

Intent: The subject property is the location of the Minneapolis Water Treatment Plant. The property
currently is made up of 15 separate parcels. Some of the descriptions for these parcels are very lengthy
and difficult to retrace. The city of Minneapolis would like to plat the property to better define the
property lines and to make for a simpler description of the property. The entire property will be platted
into two lots. Lot 1 will be the large overall campus and Lot 2 will be the Emergency Operations Facility
No other property will be subdivided with this plat other than the portions of the property that fall
within the existing County State Aid Highway No. 1 (East River Road) right-of-way will be dedicated to

There are also a number of road and alley right-of-ways located on the property that either were never
used or are no longer being used by the public and the city of Minneapolis is requesting these roads and
alleys be vacated. The roads and alleys that the city of Minneapolis is requesting to be vacated are
depicted in the hatching on the preliminary plat and are as follows:
Marshall Street runs northerly and southerly through the property and depicted on the Auditors
Plat No. 39 . A portion of Marshall Street was vacated in 1970 through the Road Vacation
Resolution located in Book 870 pg. 327. The city of Minneapolis would like to vacate the
remainder of Marshall Street running through the property.
Numerous streets and alleys were platted and dedicated to the public in the plat of “Berlin”. The
city of Minneapolis would like to vacate the streets and alleys located on the property.
A road easement located on the property was identified in Book 131 of Deeds, pg. 506. The city
of Minneapolis would like to vacate this road easement.

Background
Brian Bona, owner of Bona Brothers Automotive Services located at 5311-5333 University Avenue is
requesting to vacate a portion of the University Avenue Service Drive, crosshatched in green/light blue
and an existing Highway Easement, which is a City easement over land owned by the petitioner,
crosshatched in brown. The purpose of the request is to gain
additional land area needed for parking and
landscaping/screening.
There is analley along the east side of the subject property
th
that isused by residents along 4Street. As part of the
vacation, an access easement will be retained from the alley
throughthe vacated Service Driveto continue to allow
residents and garbage/delivery trucks accessthrough the
property.
The City will retain the western 20 feetof right-of-way,
crosshatched in blue, which is the area that will be needed for
construction of the future Bus Rapid Transit (BRT) stop and a
potentialtrail.
The petitioner had submitted a similar vacation request in
2013, and at that time, the Minnesota Department of

Over the last year, staff havemet with the petitioner, MnDOT,
and Metro Transit to try to find a solution that will be a
benefit toall. The proposed request has been agreed upon
from all parties involved.
Site History The property was originally developed as a
service station in 1955. In 2000, that building was
demolished. In 1999, the subject property was granted a
special use permit to allow an automobile service station in a

C-2, General Business zoning district. At the same time a variance was also granted to reduce the setback
from the adjacent residential district on the east side of the property from 50 feet to 25 feet. The existing
building was then constructed in 2000 as Bona Bros. Automotive Services. In 2003, a special use permit
was granted to expand an automotive service station that would connect the gas station with the service
station; that connection was constructed in 2004.
Bona Bros. Automotive has been successful in this location and as a result, there is a need for additional
land area for parking vehicles. The petitioner is also interested in continuing to create a pleasing image
along this corridor.
By gaining additional land area, the petitioner would like to install a wrought iron fence where the
MnDOT chain link fence used to be. He is also planning to redesign the green space and storm pond
on his property, to provide additional screening of parked vehicles. Placement of the fence and planting
along the right-of-way line will need to be approved by MnDOT prior to installation. The petitioner has
committed to parallel parking passenger vehicles (sedans) along the curb within the vacated right-of-
way, and the larger vehicles will be parked in the existing parking lot.
If the vacation is approved, the petitioner will be responsible for maintenance, including resurfacing and
snow removal of the vacated right-of-way and easement area.
A Notice of Public Hearing before the City Council was published in the October 27, 2023, and
November 3, 2023, editions of the Official Publication.

Whereas, on September 15, 2023, Bona Management Fridley, LLC, submitted a request to vacate
a portion of the University Avenue Service Drive, and a Highway Easement adjacent to the
property located at 5311-5333 University Avenue N.E.; and
Whereas, notice of a public hearing concerning the requested vacation was provided in
accordance with Fridley City Code § 205.05.08 and a public hearing was held on said request at
the Fridley City Council (Council) meeting on November 13, 2023, at the Fridley City Hall, 7071

Whereas, at the Council Meeting on November 13, 2023, the Council proceeded to hear all
persons interested in said vacation request and the Council considered the request for said

Charges and Rates for the Year 2024
Background
At the October 23, 2023,City Council Conference Meeting, the Fridley City Council (Council) reviewed
the proposed utility rates and recycling service for 2024. In addition, there were also budget discussions
thththth
on September 25, September 11, July 24and May 8.
The proposed changes in the various chargesforservice will allow each fund to respond to its various
cost pressures while improving the sustainability of their operations and limiting the need for future
borrowing to support certain capital expenditures. These recommended changes also allow the City to
provide stable and predictable rates changes over time, while responding to various cost pressures. It
will also allow each fund to maintain their cash and fund balances at levelsrequired by City policy.The
proposed changes are included on the attachment.
Financial Impact
The estimated quarterly impact for a residential customer using 18,000 gallons would be an increase
of approximately $11.34 or$3.78 monthly.
Recommendation
Staff recommend the approval of Resolution No. 2023-130.

Resolution No. 2023-130
Approving Water, Sanitary Sewer, Storm Water and Solid Waste Abatement Charges and
Rates for the Year 2024
Whereas, Section 402 of the Fridley City Code (City Code) provides that the City Council shall
have the authority to set water and sanitary sewer utility charges, fees and rates by resolution; and
Whereas, Section 216 of the City Code provides that the City Council shall also have the authority
to set the drainage rate by resolution; and
Whereas, Section 113 of the City Code provides that the City Council shall also have the authority
to set solid waste abatement (i.e., recycling) charges, fees and rates by resolution; and
Whereas, changes in the various chargesforservice will allow each fund to respond to its various
cost pressures while improving the sustainability of their operations and limiting the need for
future borrowing to fund ordinary capital expenditure; and
Whereas, the following charges, rates and fees shall be effective upon the first billing cycle of
2024.
Now, therefore be it resolved, that the City Council of the City of Fridley hereby establishes the
following charges, fees and rates for each of the public utility and solid waste abatement funds
for 2024 as shown in exhibit A.
