Resolution No. 2024-20, Approving a Vacation, SAV #23-04, for the City's HRA for the Property Generally Located at the SE Corner of Mississippi St. and Central Ave. NE Resolution No. 2024-20 Approving Vacation, SAV #23-04 for the City’s Housing and Redevelopment Authority, for the property generally located at the Southeast Corner of Mississippi Street and Central Avenue N.E. Whereas, on December 15, 2023, the City’s Housing and Redevelopment Authority (HRA), submitted a request to vacate a portion of an alley and a utility easement for the properties generally located at the Southeast Corner of Mississippi Street and Central Avenue N.E.; and Whereas, notice of a public hearing concerning the requested vacation was provided in accordance with Fridley City Code § 205.05.08 and a public hearing was held on said request at the Fridley City Council (Council) meeting on February 12, 2024, at the Fridley City Hall, 7071 University Avenue N.E.; and Whereas, at the Council Meeting on February 12, 2024, the Council proceeded to hear all persons interested in said vacation request and the Council considered the request for said vacation; and Whereas, the Council in its discretion has determined that retaining a portion of the alley and utility easement will not benefit the public and that new utility easements will be dedicated when the property is replatted upon approval of a redevelopment project; and Whereas, the Alley and Utility Easement Vacation Description Sketch is attached hereto as Exhibit A. Now, therefore be it resolved that the City of Fridley (City), pursuant to City Charter §12.07, City Code § 205.05.8, and Minnesota Statues § 412.851, hereby vacates the alley and utility easement situated in the City of Fridley, County of Anoka, State of Minnesota, to wit: That part of alley, as created and dedicated within Block 1, Spring Valley, according to the recorded plat thereof, Anoka County, Minnesota, lying northerly of the following described line and its westerly extension: Commencing at the Northwest corner of the Northwest Quarter of the Southeast Quarter of Section 13, Township 30, Range 24, Anoka County, Minnesota; thence South 89 degrees 20 minutes 56 seconds East, assumed bearing, along the North line of said Northwest Quarter of the Southeast Quarter, 50.02 feet; thence South 00 degrees 48 minutes 09 seconds East, 30.01 feet to the Northwest corner of Lot 16, Block 1, said plat; thence South 89 degrees 20 minutes 56 seconds East, along the North line of said Block 1, a distance of 476.15 feet to the Northeast corner of Lot 13, Block 1, said plat; thence South 00 degrees 48 minutes 16 seconds East, along the East line of said Lot 13, a distance of 293.89 feet to the Southeast corner of said Lot 13 and the point of beginning of said line to be described; thence North 89 degrees 08 minutes 20 seconds West, along the South line of said Lot 13 and its westerly Resolution No. 2024-20 Page 2 extension, 141.02 feet to the East line of Lot 18, Block 1, said plat, and said line there terminating.
