Resolution No. 2024-34, Denying an Interim Use Permit (IUP #24-01) Requested by Amarok, LLC, to Allow a 10-Foot-Tall Electric Fence at 4650 Main St. NE Resolution No. 2024-34 Denying an Interim Use Permit (IUP #24-01) Requested by Amarok, LLC, to Allow a 10-Foot-Tall Electric Fence at 4650 Main Street Northeast Whereas, the City of Fridley (City) has received a request from Amarok, LLC, on behalf of property owner STB Minneapolis Partnership LLP (Applicant), to allow a 10-foot-tall electric fence as an interim use; and Whereas, the request is for the property generally located at 4650 Main Street Northeast (Property Identification Number 27-30-24-44-0001), which is legally described on the attached Exhibit A (Property); and Whereas, on February 21, 2024, the Planning Commission held a public hearing to consider the Amarok, LLC’s Interim Use Permit, IUP #24-01; and Whereas, at the February 21, 2024, meeting, the Planning Commission voted 5-1 to recommend denial of IUP #24-01. Now, therefore be it resolved, that the City Council of the City of Fridley hereby denies the request for the Interim Use Permit (IUP #24-01) and makes the following findings of fact: 1. Interim uses are defined and regulated by Fridley City Code (Code) § 205.05.6 and general standards for approval are established in Code § 205.05.6.D. 2. Pursuant to the Code § 205.05.6.A.2, the purposes for allowing an interim use are as follows: a) to allow a use for a temporary period of time until a permanent location is obtained or while the permanent location is under construction; b) to allow a use that is presently judged acceptable by the City Council, but that with anticipated development or redevelopment, will not be acceptable in the future or will be replaced in the future by a permitted or special conditional use allowed within the respective district; c) to allow a use that is seasonal in nature; or d) to allow a use for a limited period of time that reasonably uses the property where it is not reasonable to use it in the manner otherwise provided in the zoning ordinance or comprehensive plan. 3. It is not being proposed by the Applicant that the proposed interim use of the Property would be for a temporary period of time. The proposed use is not seasonal in nature as the fence will be used year-round. It is also not anticipated that the Property will be redeveloped in the future, and therefore, whether the proposed use will not be acceptable in the future is not applicable. The use is also not being proposed to be used for a limited period of time as the Applicant has not identified the date or event that would terminate the use. Resolution No. 2024-34 Page 2 4. Code § 205.05.6.D.4 (General Standards) states that no interim use permit may be granted if it will adversely affect the adjacent property, the surrounding neighborhood, or other uses on the property where the use will be located. The Property is adjacent to residential areas and a sidewalk/trail. The proposed electric fence would be located approximately 300 feet from a public sidewalk/multi-use trail and less than 400 feet from residential properties. The fence’s warning signage would be visible from adjacent properties and the fence may also cause a safety issue with the surrounding recreational/residential uses. Furthermore, the proposed fence encloses an area much larger than what is necessary on the Property for outdoor storage. 5. Code § 205.05.6.D.5 requires that the date or event that will terminate the interim use must be identified with certainty. The Applicant has not identified the date or event that would terminate the use.
