May 2024
Whereas,the ongoing preservation and restoration of our community forests are essential to
maintaining the health and integrity of ecosystems and waterways; and
Whereas,fostering a culture of environmental stewardship and promoting initiatives that
support our forests
future generations; and
Whereas,by prioritizing the health and resilience of our forests, we can ensure the continued
provision of clean water, ecological benefits, and recreational opportunities for Fridley community
members;and
Whereas,the last Friday in April, and throughout the month of May, citizens of Fridley pay

David Carlson commented that he spoke at the last Council meeting related to concerns he had with
prior abuse of his children. He provided more details on what occurred with his children and a concern
that he has that the couple adopting his daughter may be connected to others he has concerns with.
Mayor Lund said he was not sure that the City would be able to assist. He asked and received
confirmation that Mr. Carlson has spoken with the Police Department. He also confirmed that Mr.
now over 18.
Councilmember Tillberry commented that he is unsure where the City Council would fit into this picture,
and stated that perhaps Mr. Carlson would be better served by bringing his concerns to an attorney.
Adoption of Regular Agenda
Motion made by Councilmember Bolkcom to adopt the regular agenda. Seconded by Councilmember
Tillberry.

8. Public Hearing to Consider On-Sale Liquor License by Debesay Girmalul for Continental
Restaurant and Resolution No. 2024-42, Approving On-Sale Liquor License for Continental
Restaurant.

Motion made by Councilmember Tillberryto open the public hearing. Seconded by
Councilmember Evanson.
Upon a voice vote, all voting aye, Mayor Lund declared the motion carried unanimously.
Beth Kondrick, Deputy City Clerk, presented the application for an On-Sale Liquor License from
Debesay Girmalul for the Continental Restaurant. She reviewed the background and analysis of the
request, stating that staff recommends approval of the request following the public hearing.
Debesay Girmalul, applicant, commented that in this location he currently has the food service
license and would now like to obtain the necessary license to serve alcohol. He stated that his
intent is not to focus on just alcohol, but to offer that in addition to his food menu. He commented
that he would continue to run his business professionally.
Mayor Lund asked and received confirmation that the restaurant is currently open and serving food.
He asked about
Mr. Girmalul commented that he did operate a large restaurant in another country, but this is his
first attempt in the U.S. He confirmed that he was aware of the 60/40 rule related to food and
alcohol sales.
Mayor Lund provided additional expectations for food service to be the main focus, noting that
alcohol sales are not to continue past the time food is served. He noted the problems that existed
for the business that previously operated in this location.
Mr. Girmalul replied that if alcohol sales became an issue, he would simply stop serving those
beverages.
Councilmember Tillberry stated that the website for the business shows an event hall and asked if
there is a separate license required for that.
Ms. Kondrick commented that this license would cover the event hall as well.
Councilmember Tillberry asked if Mr. Girmalul has experience selling alcohol.
Mr. Girbalul commented that his restaurant in Nyrobi served alcohol and that operated for 20 years.
He noted that this would be his first-time serving alcohol in the U.S. as this is his first restaurant in
the U.S.
Councilmember Bolkcom stressed that the City is very serious about the 60/40 rule for food and
alcohol. She asked for more information on the type of food served and the training that would be
provided for the staff serving alcohol.

Mr. Girmalul commented that they serve culturally diverse food. He stated that he would train all
employees to check identification on all customers, regardless of age. He stated that they also have
a time limit during which they would offer alcohol service, noting that his restaurant closes at 11
p.m. but the hours may be different for the event hall. He stated that event hall customers must
also have food included in the service.
Councilmember Ostwald asked if the restaurant caters for the events at the event center or whether
an outside caterer could be used.
Mr. Girmalul commented that generally they serve the food, but outside food is allowed with the
proper catering licenses provided. He stated that his plan would be for beer and wine service but
perhaps liquor in the future.
Mayor Lund asked if there are any plans for remodeling or improvements on the exterior.
Mr. Girmalul commented that they have invested in improvements to the interior, and he will now
begin to improve the outside appearance.
Councilmember Bolkcom asked if there is concern with the 60/40 ratio for those that use outside
catering.
Mr. Girmalul stated that he does have a plan to regulate alcohol service during those events.
Mayor Lund noted that perhaps for events that would like alcohol service, the business requires that
the restaurant is used for catering to ensure the 60/40 rule is met.
Councilmember Evanson asked for details on staffing and management of the restaurant and event
space.
Mr. Girmalul provided details on his staffing, noting that once the business grows, he will continue
to add more staff. He was aware that if someone else were added to management, they would
need to be added to the liquor license.
Motion made by Councilmember Evanson to close the public hearing, Seconded by Councilmember
Bolkcom.
Upon a voice vote, all voting aye, Mayor Lund declared the motion carried unanimously.
Motion made by Councilmember Ostwald to adopt Resolution No. 2024-42, Approving On-Sale
Liquor License for Continental Restaurant. Seconded by Councilmember Tillberry.

and Construction of Government Chapter of the Fridley City Charter.
Motion made by Councilmember Tillberry to open the public hearing. Seconded by
Councilmember Bolkcom.
Upon a voice vote, all voting aye, Mayor Lund declared the motion carried unanimously.
Ms. Kondrick presented a proposed amendment to Chapter 1 of the Fridley City Charter. She
reviewed background information on the request, summarizing details of Chapter 1 along with the
proposed amendments. She reviewed the next steps, should the first reading be approved.
Mayor Lund invited any members of the public to provide comments.
No public comments were provided.
Motion made by Councilmember Bolkcom to close the public hearing, Seconded by Councilmember
Tillberry.
Upon a voice vote, all voting aye, Mayor Lund declared the motion carried unanimously.

Amending the Name, Boundaries, Powers and Construction of Government Chapter of the Fridley
City Charter. Seconded by Councilmember Ostwald.

10. Ordinance No. 1422, Amending the Fridley City Code Chapter 105, Commissions, to Establish a
Public Arts Commission.
Scott Hickok, Community Development Director, provided background information on public art
and the public engagement process that occurred thus far and the recommendation that moved
forward to the City Council. He reviewed the proposed ordinance which would establish a Public
Arts Commission. He reviewed the next steps, should the first reading be approved.
Councilmember Tillberry asked if there would be a process to involve the new Commission in public
projects to determine if there would be an opportunity to include public art.
Mr. Hickok replied that there would be a staff liaison, currently identified as himself, and noted that
it would be his responsibility to identify those opportunities.
Councilmember Evanson asked for more information on the creation of a 501-3c organization and
how that would work with this group.

Mr. Hickok explained that the 501-3c would be separate and operate independently with the
purpose of fundraising to further the interest of public art. He stated that the Commission would be
an advisory commission to the Council. He stated that the by-laws of the 501-3c would tie that
organization to the Public Arts Commission.
Councilmember Tillberry noted that it would be similar to the Springbrook Nature Center
Foundation.
Councilmember Bolkcom thanked the residents who have participated, noting the enthusiasm of
the group.
Motion made by Councilmember Evanson to approve the first reading of Ordinance No. 1422,
Amending the Fridley City Code Chapter 105, Commissions, to Establish a Public Arts Commission.
Seconded by Councilmember Bolkcom.
Upon a voice vote, all voting aye, Mayor Lund declared the motion carried unanimously.

Councilmember Bolkcom noted the 44 Avenue bridge discussion scheduled for the following night at
City Hall.
Councilmember Tillberry commented on the wonderful fundraising event that was held the previous
Saturday at Springbrook Nature Center, hosted by the Springbrook Nature Center Foundation. The
Council thanked the City staff and other volunteers who assisted in preparing and running the event.
The Council also asked residents to take a photo of their water service line and provide it to staff.

1.LBAE Resolution No. 2024-01, Approving the Equalization of Assessed Valuations of Real and
Personal Property in the City of Fridley
Patrick Maghrak, City Assessor, stated that the purpose of this meeting is to establish a consistent
appeal procedure for the January 2, 2024,valuation or classification. He explained the actions the
Council could take and noted that if property owners were not satisfied by the action of the Board,
they could appeal further to the County Board. He reviewed the responsibilities of the Boardand
the appeal procedures. He provided a summary of the 2024 assessmentfor residential properties,
commercial and industrial properties, and apartments.
Mr. Maghrak stated that he received a call this afternoon from a commercial property. He stated
that he would not have had enough time to review the request, so they agreed to enter that appeal
into the record to preserve their rightto continue to the County if desired. He provided additional
exhibits to the Board to enter into the record, which show three properties that they changed values
on in the last three days. He reported a total of fifteencalls received, four commercial/industrial,
one apartment call, and nine residential calls.

Councilmember Bolkcom asked why Home Depot waited until today to call.
Mr. Maghrak commented that the letter is vague in stating that they should call the assessor. He
noted that perhaps if additional language were added to the notice, that would clarify the process.
Mayor Lund invited anyone present to provide their input if they wished to dispute their valuation.
There was no one present to provide input.
Motion made by Councilmember Bolkcom to approve LBAE Resolution No. 2024-01, Approving the
Equalization of Assessed Valuations of Real and Personal Property in the City of Fridley, and Exhibit
A, Estimated Market Value Changes, as presented. Seconded by Commissioner Tillberry.
Upon a voice vote, all voting aye, Mayor Lund declared the motion carried unanimously.
Motion made by Councilmember Bolkcom to approve Exhibit B, for Home Depot, as presented
preserving their right to appeal to the County Board. Seconded by Commissioner Evanson.

2.!Fridley Parks and Recreation Mission Statement
Mike Maher, Parks and Recreation Director, commented that this was discussed at the last
meeting and after additional work by staff, he wanted to bring a final draft back to the
Commission for review.
Motion by Commissioner Whalen to approve the updated Parks and Recreation Mission and Vision
Statement. Seconded by Commissioner Kirk. The motion passed unanimously.
3.!Updated Neighborhood Park Playground Design for Sylvan Hills Park
Mr. Maher presented the 2024 neighborhood park playground concept design for Sylvan Hills
which incorporates the input from the community and the theme.
Commissioner Maow arrived during the staff presentation.
Commissioner Maow asked for details on whether there would be any improvements to the areas
outside the playground, such as the basketball court and tennis court areas. Mr. Maher replied
that there is an updated site design for Sylvan Hills, but that is still being worked out with the
stormwater management details.
Commissioner Cardona asked and received confirmation that the plans fit within the proposed
budget.
Motion by Commissioner Schultz to endorse the playground design for Sylvan Hills Park. Seconded
by Commissioner Maow. The motion passed unanimously.
4.!Parks and Recreation Commission 2024 Goals and Workplan Review
Mr. Maher presented the draft 2024 goals and workplan. He confirmed that this is a working
document.
Old Business
Chair Borman referenced Innsbruck Nature Center, which was previously discussed and asked if
there has been any progress on a potential name change. Mr. Maher replied that the discussion
ended with a desire for community input, which staff has not had time to complete as of yet. He
stated that the park is scheduled for park improvements in 2028 or 2029, therefore that process
will occur before that time.

5.!Springbrook Nature Center Report
Mr. Maher provided an overview on the written report noting that the Nature Center staff has
been busy working with the local public schools, holding the nature preschool club, as well as
holding birthday parties. He stated that the lantern light hike attracted over 100 participants. He
noted that the summer day camps have been opened for registration.
6.!Fridley Parks and Recreation Division Report
Mr. Maher provided an update on recently held activities and programs
Day part, afterschool programming, lantern light hike, and north metro athletic leagues. He
reported that the Summer Rocks programing registration begins later this week. He noted that
with the warmer temperatures staff has begun to install nets for tennis and pickleball.
7.!Park Maintenance and Construction Report
Mr. Maher provided an overview of the written report and recent activities of park maintenance
staff.
Commissioner Cardona commented that while there may not be grand opening/ribbon cutting
ceremonies for all the neighborhood parks, perhaps there could be something in the newsletter
listing the updates playgrounds and parks.

3.Approval of Resolution 2024-01, Amendment to Sherman Associates Loan Agreement
Paul Bolin, HRA Executive Director, stated that in 2020 the HRA approved a $600,000 loan for the
URSA Apartments with repayments to start December 2, 2023. He explained that the annual payment
is based on a formula of calculations of Sherman Associatesoperating income and expenses and as
the payment date approached, both parties determined that a later pay date would be better for both
parties, allowing the use of audited financial reports. He stated that the audited financial statements

are completed by the end of April. Staff recommends approval of the resolution amending the loan
agreement.
Commissioner Backlund asked if this would extend the term of the loan. Mr. Bolin confirmed that the

Motion by Commissioner Mulrooney to adopt HRA Resolution 2024-01. Seconded by Commissioner
Brueggemeier.
Upon a voice vote, all voting aye, Chair Showalter declared the motion carried unanimously.
Informational Items
4. Update on Housing Programs
Mr. Bolin stated that there has not yet been any loan activity for 2024, but noted there were two
remodeling advisor visits in January. He said the open house on the housing programs will be held
on March 27 from 5 to 7 p.m. He advised of an April deadline to apply for the grant programs.

The Fridley City Charter (Charter) is the fundamental law that defines the authorities and powers of the
City of Fridley (City). Minnesota Statute (M.S.) § 410.12, subd. 7 allows for an amendment to the Charter
by ordinance upon the recommendation of the Charter Commission.The recommended amendments
to the chapter arecompiled into Ordinance No. 1421, makingitmoreconsistent with M.S.and other
chapters of the Charter itself.
Most ofthe revisions to the Chapter align it withtheWriting Style Guide.Notable revisions to the
Chapter include:
Section 1.01, adding Definitions and moving them to the beginning of the chapter; and
Section 1.03, moving Charter, A Public Act to earlier in the chapter.
Passage of a Charter amendment must follow timelines according toM.S.and the Charter itself. To date,
the following events have occurred for this proposed amendment:
February 5the Charter Commission formally recommended the Charter amendment to the
Fridley City Council (Council)
March 25the Council approved Resolution No. 2024-35Hearing
March 28a Notice of Public Hearing was published in the OfficialPublication and posted to

Amending the Name, Boundaries, Powers and Construction of Government Chapter of the
Fridley City Charter
The Fridley City Charter Commission has completed its review of the Fridley City Charter Chapter
1 and has recommended an amendment of the City Charter by Ordinance to the City Council on
February 5, 2024. The Fridley City Council hereby finds after review, examination and
recommendation of the Charter Commission that the Fridley City Charter should be hereby
amended and the City of Fridley does ordain:
Fridley City Charter
Chapter 1. Name, Boundaries, Powers and Construction of Government
Section 1.01 Definitions
Home Rule Charter, City Charter, Charter: .
Home Rule Charter Commission: A body of 15 Fridley residents appointed by the district court who
work collaboratively to evaluate and propose changes to the Fridley City Charter that reflect the
importance of the Charter to enable effective government operations that reflect the values of
residents.
Voter: A registered voter who lives in the City.
Section 1.01.Section 1.02 Name and Boundaries
Upon the taking effect of this Chapter, the Village of Fridley in the County of Anoka and State of
Minnesota shall become a City under the name of City of Fridley and shall continue to be a municipal
corporation with boundaries the same as they now are established or as they may hereafter be
established.
Section 1.03 Charter, A Public Act
The Charter was approved by voters on September 10, 1957. It is a public act and need not be
pleaded or proved in any case.
Section 1.02.Section 1.04 Powers of the City
The City of Fridley:
shall have perpetual succession;
may sue and be sued;

may use and alter its seal at pleasure;
shall be capable of contracting and being contracted with;
may take by purchase, condemnation, gift, devise, or otherwise, and hold, lease, sell and convey
all such real and personal property as its purposes may require, or the transaction of its business
may render convenient, within or without the limits of the City;
may acquire, construct, own, lease and operate public utilities, and render public service of every
kind;
may grant franchises or licenses for the construction, operation and maintenance of public
utilities in, over, upon and under the streets and public places in the City, and shall have power
to fix and regulate the fares, tolls, or charges which may be collected, the extensions which shall
be made, and regulate the services which shall be rendered by any owner or operator of a public
utility franchise or license;
may assess, levy and collect taxes, for general or special purposes, on all subjects or objects
which the city may lawfully tax;
may borrow money on the faith and credit of the City or on a public utility or other property
owned by the City or the revenues therefrom by the issuance and sale of bonds or certificates
of indebtedness;
may appropriate the money of the City for all lawful purposes;
may provide for, construct, regulate, and maintain public works and local improvements;
may levy and collect assessments against real property within the City for local improvements
and services including garbage and refuse collection and disposal;
may license and regulate persons, corporations and associations engaged in any occupation,
trade or business;
may define, prohibit, abate, and suppress all things detrimental to the health, morals, comfort,
safety, convenience and welfare of the inhabitants of the City, and all nuisances and causes
thereof;
may regulate the construction, height and materials used in all buildings, and the maintenance
and occupancy thereof;
may regulate and control the use for whatever purposes of the streets and other public places;

may make and enforce local police, sanitary, and other regulations;
may pass ordinances for maintaining and promoting the peace, good government and welfare
of the City, and for the performance of all the functions thereof;
shall have all the powers possessed by municipal corporations at common law;
shall have, retain and may exercise all powers, functions, rights, and privileges, heretofore
possessed by the Village of Fridley;
may exercise such powers beyond its corporate limits as may be necessary for the effective
exercise of any powers granted herein as now authorized by law;
and in addition thereto, the City of Fridley shall have and exercise all powers, functions, rights,
and privileges exercised by, or which are incidental to, or inherent in, municipal corporations and
are not denied to it by the Constitution or general laws of the State of Minnesota.
The enumeration of powers herein shall not be construed to limit or restrict the powers granted in
general terms, nor shall any specific power granted in this charter be construed to limit or restrict the
powers granted in this Section.
In addition to the powers herein and hereafter granted, the City of Fridley shall have full power to
deal with all matters of municipal concern and have complete self-government in harmony with and
subject to the Constitution and laws of the State of Minnesota.
Section 1.03. Charter, A Public Act
This Charter shall be a public act and need not be pleaded or proved in any case. It shall take effect
fifteen (15) days from and after its adoption by the voters.
Section 1.04. Definitions
1. Eligible voter.
A resident of the City of Fridley who is qualified to register to vote.
2. Registered Voter.
An eligible voter who is currently registered in the City of Fridley.
3. Voter.
A registered voter who has voted in the City of Fridley within the last four years.

Art its regular meeting of April 8, theFridleyCity Council (Council) approved the first reading of
Ordinance No. 1422to amend the Commissions Chapter of the Fridley City Codeto establish a Public
Arts Commission. The taskforce has so enthusiastically taken on its role that the Mayor and Council have
asked of them that now Council asks that the task force beformally recognized as the Fridley Art
Commission. The ordinance,once approved,wouldtransition the group from a task force to an Art
Commission.
The Public Arts Commission will be established to foster the development of the arts, to advise the
Council on arts-related matters and to stimulate participation in and appreciation of the arts by residents.
After adoption the Ordinance will becomeeffective on May 11. A companion resolution has been
included f approved, itwill officially appoint the members to
the Commission.

Amending the Fridley City Code Chapter 105, Commissions, to Establish a Public Arts
Commission
The City Council of the City of Fridley does ordain, after review, examination and staff
recommendation that the Fridley City Code be amended as follows:

Chapter 105 Commissions
105.01 Purpose
Pursuant to the Fridley City Charter Chapter 2, the Fridley City Council (Council) may create
commissions with advisory powers to investigate any subject of interest to the City of Fridley (City).
Advisory commissions provide for citizen input and are advisory to the Council. Advisory
commissions shall have no decision-making authority, except as expressly established by the
Fridley City Code or Minnesota Statutes (M.S.).
105.02 Commissions Generally
1. Membership
(a)!Each commission, unless otherwise indicated, shall consist of seven Fridley residents
appointed by Council.
(b)!The Council will annually appoint, by Council resolution, a chairperson to each advisory
commission.
(c)!Each commission shall elect a vice chairperson. At any meeting of the commission if
the chairperson is unable to attend, the vice chairperson shall act as chairperson.
(d)!The commission members shall be appointed by the Council for three-year terms,
except the Council shall make every effort to stagger the appointments so that the
terms of no more than three members shall expire in any one year. Attempts shall be
made to have all City wards represented on the commissions. Upon the expiration of
their terms of office, members shall continue to serve until their successor shall have
been appointed.
2. Vacancy
Commission members may resign or be removed from office by a majority vote of the
Council. The commission member appointed to fill any vacancy shall serve for the
remainder of the vacated term.

3. Organization
(a)!Following the appointment of membership, each of the commissions shall meet,
organize and with the exception of the chairperson, elect any officers, as it deems
desirable.
(b)!Adopt rules for its meetings and the transaction of its business, in order to fulfill the
responsibilities of the commission.
(c)!The chairperson shall assure the fulfillment of the following responsibilities:
(1)!Call and preside over meetings of the commission.
(2)!Appear or appoint a representative to appear, if deemed necessary, before the
Council or any City commission pertaining to matters within the scope of the
commission.
(3)!Provide liaison with other governmental and citizens' groups pertaining to matters
within the scope of the commission for the purpose of timely and relevant
information for consideration by the commission.
4.!Staff Liaison
The City Manager shall assign one member of staff to serve as Staff Liaison to each
commission. The Staff Liaison shall perform only such duties on behalf of a commission as
may be assigned by the chairperson and with the consent of the City Manager. Additional
advisory staff shall be assigned to the commissions by the City Manager within the restraints
of the adopted general fund budget. A Staff Liaison shall not serve as an appointed member
of any City advisory commission.
5. Project Committees
The commissions may establish special project committees to further the objectives of the
commissions and provide for greater citizen participation. Such project committees shall be
appointed by a commission for special projects and shall cease to exist when their activities
are completed. The qualifications for membership, composition and duties of such project
committees shall be at the discretion of the commission. The project committee may be
chaired by a member of the commission, and at least one member of the commission shall
act as a liaison for each project committee.
6. Compensation

The members of the commissions shall serve without pay, but may be reimbursed for actual
expenses if funds therefore are provided in the adopted general fund budget.
7. Reports
The commissions shall make such reports as requested by the Council. or Planning
Commission.
8. Meetings
Meetings shall be called by the chairperson and shall be held as necessary to fulfill the
responsibilities of the commissions. All meetings of the commissions shall be open to the
public. Minutes shall be kept of all meetings. Findings and recommendations shall be
transmitted by the commission chairperson to the to the Council.
105.03 Planning Commission
1.!Commission Established
There is hereby created a Planning Commission for the City of Fridley, Minnesota pursuant to
M.S. Chapter 462.
2. Purpose
(a)!The Planning Commission is established to provide comprehensive planning and
zoning advice to the Council, provide a process by which the public may appeal staff
interpretation of the Code, or request a variance to performance standards in the
zoning chapters of the Code.
(b) The Council hereby establishes the Planning Commission to serve as the Board of
Appeals and Adjustments and exercise all authority and perform all functions of said
Board pursuant to M.S. §§ 462.351 to 462.364 and operate according to this Code.
3. Scope
(a)!The Planning Commission shall serve in an advisory capacity to the Council. Matters
shall be referred to the Planning Commission by the Council, City Manager or
chairperson of the member commissions, and may be assigned to the member
commissions for detailed study and recommendations as required. All
recommendations by the Planning Commission shall be made to the Council.
(b)!The Planning Commission is charged with responsibility for community planning,
growth and development of comprehensive goals and policies, including but not
limited to, land use, housing, transportation, , and other related community activities.

(c)!The Planning Commission shall advise the Council in the development of programs to
give increased effectiveness and direction in implementing established City goals and
policies and recommend actions needed to carry out planning responsibility.
4. Appeals and Requests
(a)!The Planning Commission shall hear and recommend to the Council appeals or
requests in the following cases according to the procedures established in Chapters
128 and 205 of this Code:
(1)!Appeals where it is alleged that there is an error in any order, requirement, decision,
or determination made by a City compliance official in the enforcement of the Code,
or State Building Code.
(2)!Requests for variances from the literal provisions of Code in instances where strict
enforcement would cause practical difficulties due to circumstances unique to the
individual property under consideration.
5. Membership of Planning Commission
The Planning Commission shall consist of the Planning Commission chairperson, the
chairperson of the Parks and Recreation Commission, the chairperson of the
Environmental Quality and Energy Commission, and four members at large.
Nothing herein shall prohibit any Planning Commission members from serving on other

105.04 Parks and Recreation Commission
1. Commission Established
There is established a Parks and Recreation Commission for the City.
2. Purpose
The Parks and Recreation Commission is established to promote the systematic and
comprehensive development of park facilities and recreational activities necessary for the
physical, mental and emotional health and well-being of the residents of the City.
3. Scope

(a)!The Parks and Recreation Commission shall act as an advisory commission to the
Council for continuous community planning and development of comprehensive City
goals and policies. Any change in related community planning and comprehensive City
goals and policies must be reviewed by the Council.
(b)!The Parks and Recreation Commission shall advise the Council in the development of
programs to give increased effectiveness and direction in implementing established
City goals and policies and recommend actions as needed to provide park and
recreational opportunities.
4. Program
The Commission shall each year, prior to June 1, recommend a capital investment program
for park improvement and acquisition and for public recreation activities for the ensuing year.
5. Funds
For the purpose of financing the parks and recreation programs authorized by this Chapter,
the accounting shall be the responsibility of the City Treasurer. The Commission shall be
authorized to establish charges or fees for the restricted use of any facility or to make any
phase of the recreation program wholly or partially self-sustaining.
105.05 Environmental Quality and Energy Commission
1. Commission Established
There is established an Environmental Quality and Energy Commission for the City.
2. Purpose
The Environmental Quality and Energy Commission is established to stimulate interest in and
to promote an awareness of environmental and energy concerns among citizens and
businesses of the City. It will serve as a resource to the City in the conservation and
management of energy and the environment, including information on environmental
problems, laws, policies, and regulations of the county, metropolitan, state, and federal levels
to the extent of their effect on Fridley and advise the Council, the City Manager, and other
appropriate City commissions on matters pertaining to conservation and management of
energy and the environment, including the review and recommendation of programs and
policies within the City.
3. Scope

The Public Arts Commission is established to foster the development of the arts, to advise the
Council on arts related matters and to stimulate participation in and appreciation of the arts
by residents.
3. Scope
(a) The Public Arts Commission serves in an advisory capacity to the Council on matters
pertaining to visual public art within the City. The Commission develops a general policy
for inclusion and approval of visual art in public places and projects as well as informs and
educates the public about the importance and need for visual arts integration within public
spaces, including parks, green space, City facilities and other buildings freely accessible to
the public.
(b) The Public Arts Commission promotes the acquisition, maintenance, and upkeep of
works of art on sites throughout the City.
(c) It may advise the City Council and other community groups and agencies who are
initiating a public art project concerning the proposed site, selection of a professional artist
and commissioning of a public artwork. The Commission shall cooperate with foundations,
educational institutions, nonprofit organizations, other governmental agencies, and
various civic groups to foster a broad public arts program for the community.
4. Membership of Public Arts Commission
(a) Members must have an interest in the various studies of the arts.
(b) Members must be residents of Fridley.

(c) Ex official members:
(1) may be appointed by the Council;
(2) may serve for specified terms;
(3) are not required to live in the City;
(4) may include persons under age 18; and
(5) do not have voting privileges.
5. Annual Report
Every year the Commission must make a written or oral report to the Council of the
Commission's activities for the calendar year.

The City of Fridley does ordain, after review, examination, and staff recommendation that the
Fridley City Code (Code) be amended by adopting Ordinance No. 1422. A summary of the
amendments to the Code made by Ordinance No. 1422 are as follows:
The Ordinance adds Section 105.06, Public Arts Commission, to the Fridley City Code (Code). The
Ordinance creates a new City Commission established to foster the development of the arts, to
advise the Council on arts related matters and to stimulate participation in and appreciation of
the arts by residents.
Ordinance No. 1422 was passed and adopted by the City Council of the City of Fridley on April 22,

at Anoka County. The extension is needed due to delays from the property owners of the former
Goodwill property, Home Depot, and Burlington Northern Santa Fe (BNSF) related to easement and site
accessdiscussions. Staff anticipates that the purchase agreement with the former Goodwill property
owner will occur soon, which will then allow the RLS mylars to be created, signed, and filed. A six-month
extension is being requested in the event there are unforeseeable delays.

Whereas, the City of Fridley (City) has implemented a park system improvement plan which will
result in improved equipment and amenities throughout the park system; and
Whereas, the City has identified standard park benches to be installed in neighborhood,
community and natural-resource based parks; and
Whereas, the City has offered a successful park bench sponsorship program at Springbrook
Nature Center, which is consistent with the guidelines proposed for use throughout the park
system; and
Whereas, the Parks and Recreation Commission has reviewed and recommended approval of the
City of Fridley Park Bench Sponsorship Guidelines at their April 1, 2024 meeting; and
Whereas, sponsorship of park benches for tributes, memorials, and commemorations provides
an opportunity to defer park improvement costs and to engage residents in their local parks.
Now, therefore be it resolved, that the Fridley City Council hereby approves the Park Bench

Memorial/Tribute Bench Guidelines for Fridley Park System
The City of Fridley(City)Parks and Recreation Department has the following guidelines for
management of personalized benches to be used within the City of Fridley Park Systemto
memorialize or to pay tribute to a personor occasion:
1.Requests for a memorial/tribute bench will be submitted in writing to the Parks and
Recreation Department through an official order formor online order form. Parks
and Recreation staff will review ordersand work with sponsors to select bench
locations that are compatible with park maintenanceand future improvements.
2.The donor may request bench installationin a specific park and may, in some cases,
suggest a location withinthat park. Final placement of a bench is at the discretion of
City of Fridley staff based on environmental conditions, utility locations and proximity
of other bench amenities.
3.All costs related to a memorial/tribute bench purchase and installation must be paid
in advance of bench purchase and installation of an inscribed plaque. Bench
sponsorship may be made for a new or existing benchand all sponsorships are
$2,500
4.An inscribed recognition plaquewill be affixed to
the park bench. Plaques will be centered horizontally on the bench back with vertical
alignment ensuring proper attachment. Typically,the inscription is limited to three
lines of18 characters per line.
5.Memorial/tribute benches will be installed by the City Parks Division staffand/orits
contractor.
6.The City of Fridley will provide general monitoring of the condition of park benches,
including those that have been sponsored with an attached plaque. Sponsored
benches will be maintained to the same standards as other park system amenities.
7.The City isnot responsible for damage to a bench or plaque due to vandalism,
graffiti, accidents or weather. Reasonable accommodations will be made to repair or
five years after a bench is
sponsored. After five years, a donor may have the option to have the bench or
bench or plaque at market rate.

8.A sponsorship of a bench will be valid for 10 yearsafter plaque installation. After this
time, the City reserves the right to place a new sponsored bench in the same
location. It will not be policy to replace a bench or actively seek new sponsors for a
bench until the condition of the bench and/or plaque fall below minimum standards
fora park amenity. A typical park bench life span is estimated at 20 years.
9.Benches will be placed in public parkland and use of the benches are intended to be
for the public. The donor or associated parties do not have preferential use of the
bench for general use,gatherings,or ceremonies. Items, such as flowers, may not be
placed and left at the bench.
10.The City of Fridley reserves the right to refuse inscriptions deemed to be offensive,
inappropriate or of a divisive nature.Staff review of inscriptions shall be completed
by the Parks and Recreation Director. The Fridley Parks and Recreation Commission
shall review and approve/deny any inscriptions that staff deems reviewable.Denials
of text submissions made by the Commission shall be final. Sponsors may have the
opportunity to edit their submission if denied.

Background
The City of Fridley (City) and Anoka County (County) entered into a Joint Powers Agreement (JPA) dated
July 17, 1980, for the operation and maintenance of the Rice Creek West Regional Trail (RCWRT) and
Locke Park(LP). The City adopted Resolution No. 2022-126 on November 14, 2022, which terminated
the agreement on November 14, 2023.
During the term of the JPA, the County entered into grant agreements with the Metropolitan Council
(MC) in order to receive funds from Minnesota Management and Budget (MMB) for the RCWRT and
certain improvements within LP. These grant agreements required that either a joint powers agreement
with the City be in place or that the County maintain a property interest in the RCWRT and LP. The City
has agreed to provide the County with easements over the RCWRT in order to satisfy the property
interest requirement of the grant agreements, provided the County allow the City to perform
emergency maintenance on the trail and snow removal as deemed necessary by the City. The County
agrees to install ADA improvements to the RCWRT by 2029.
Since the RCWRT is a state bond-finance property, a declaration must be recorded against the
properties containing the trail. MMB has agreed that provided the City execute and record a declaration
for the LP property that indicates that improvements to the property have been financed by state grant
funds, the City the City will be
subjecting the property to the grant agreements, the MMB will besatisfied with the County not having
a property interest in the LP property.
As a result of the agreements, attached are the necessary documents that Council needs to approve in
this matter:
1. Resolution No. 2024-58, Approving the Granting of Easements to Anoka County for the RCWRT
and also Authorizing the Execution of Declarations Related to State Bond Financing with Respect to
LP and the RCWRT;

2. Warranty Deed from the City to the County approving the County easements for the RCWRT. The
Mayor and the City Manager are authorized to execute said Warranty Deed and provide it to the

maintenance plan that will allow the City to remove snow from the trail as deemed necessary by the
City. This approval is also conditioned upon the County constructing ADA improvements to the
RCWRT. If the said improvements are not constructed by 2029, the City may construct the
improvements and bill the County for the costs.
3. The Declarations for the LP and the RCWRT properties. The Mayor and the City Manager are
authorized to execute the Declarations and provide them to the County for recording.

based upon 125% of 15 years, until July 31, 2042, or until the Restricted Property is sold with the
written approval of the Commissioner of Minnesota Management and Budget, at which time it
shall be released therefrom by way of a written release in recordable form signed by both the
Commissioner of the Commissioner of Minnesota Management and Budget, and such written
release is recorded in the real estate records relating to the Restricted Property. This Declaration
may not be terminated, amended, or in any way modified without the specific written consent of
the Commissioner of Minnesota Management and Budget.

Background
Pursuant to certain sections of the Fridley City Code (Code), certain business licensing activities require
approval of theFridleyCity Council(Council), including:
Food, Tobacco, GasOff-Sale Liquor
JunkyardPawn Shop
Massage Therapy (individuals and businesses)Hemp THC Products Shops
On-Sale LiquorTobacco Product Shop.
Liquor Catering
The businesses listed in Resolution No. 2024-49have met all requirementsand paid all appropriate fees
established inthe Codefor their respective licenses. Staff have performed all necessary inspections and
checks to ensure all license requirements have been satisfied.
The Police Divisionconducts compliance checks for businesses holding massage therapy, on-sale liquor,
off-sale liquor, pawn, tobacco, tobacco product shop and hemp THC product shoplicenses. In the 2023-
2024 licensing period, there were four tobacco violations for attempted sale to minors at Moore Lake
Violation letters were mailed to each
business owner andto the staff member who failed the compliance check. The fee for a violation for the
business owner is $500. In addition, the Police Division works closely with the business owner and store
manager to bolster staff trainingto ensure additional violations do not occur.
The Intoxicating Liquor Chapter of the Coderequires restaurantsto maintain a ratio of at least 40% of
their annual sales from the sale of food(Exhibit A).As part of the license renewal process, the City
requires certified financial statements,which show compliance with this requirement.All restaurants
have satisfiedthe food-to-liquor sales requirement.

Approving Business License Renewals for 2024-2025
Whereas, the Fridley City Code (Code) and various sections of Minnesota Statute direct licensing
requirements for certain business activities within the City of Fridley (City); and
Whereas, pursuant to sections of Code, the City Council must approve liquor, tobacco, THC
products shops, massage, pawn and junkyard business licenses; and

Background
In 2018, the large single-family lot that was 6663 Lucia Lane N.E., was replattedto create threesingle
family lots. When a property is replatted, the Subdivision Chapterof the City Code requires that drainage
and utility easements be dedicated along the side and rear property lines.
In 2023, the petitioner, NatashaLawrence reached out to City staff to inquire about combining the
northern two lots, to create one large single-
family lot, because the wetlands on the
northern portion of Lot 3 made it difficult to be
developed on its own. Staff advised that a
simple lot combination form could be filed and
recorded at Anoka County to make the two lots
into one.
A small portion of the new home
will encroach intothe easement, so staff
suggested that thetwofive-footside yard
easements be vacated between Lots 2 and 3.
The lot line that ran between the two lots no
longer exists because of the lot combination, so
there is no longer a need to retain the
easements.
Engineering staff have reviewed this request
and have no concerns. Staff also notified private utility companies and no concerns were received from
them.

Whereas, on March 15, 2024, Natasha Lawrence, submitted a request to vacate a portion of a
drainage and utility easement that lies between Lot 2 and Lot 3, Block 1, Valley Addition, which is
addressed as 6677 Lucia Lane N.E.; and
Whereas, notice of a public hearing concerning the requested vacation was provided in
accordance with the Zoning Chapter of the Fridley City Code and a public hearing was held on
said request at the Fridley City Council (Council) meeting on April 22; and
Whereas, at the April 22 meeting, the Council proceeded to hear all persons interested in said

Now, therefore be it resolved that the City of Fridley (City), pursuant to the Vacation of Streets
section of the City Charter, Zoning Chapter of the City Code and Minnesota Statues § 412.851,
hereby vacates the drainage and utility easement situated in the City of Fridley, County of Anoka,
State of Minnesota, to wit:

Background
On Tuesday,April 16at 9:00 a.m.,bids were publicly opened online via the virtual platform available on
QuestCDNand Microsoft Teams for the 2024Neighborhood Parks Improvements Project. Three
responsive bids were received.
This project is part of the City of Fridley(City)Park System Improvement Plan(PSIP). Theparks included
areEdgewater Gardens Park, Plymouth Square Park and Logan Park(see Exhibit A).
After a successful kick-off of the first year of implementation of the park planin 2023, staff isexcited to
continue our second year of implementation. The purpose of the project is to provide park
improvements that include improved accessibility, playground equipment, fitness equipment and added
amenities such as picnic shelters. The playground equipment will be installed by specialized contractors
and the remaining sitework and installations will be completed by the 2024Neighborhood Parks
Improvements Project contractor.
As noted, threebids were received. The low bid was received fromPeterson Companies, Inc. of Chisago
City, MN in the amount of $725,600, which is 31% below1,052,426(see
Exhibit B). Thenextlowest bid waswithin $126,661(17.5%)of sbid.Of the threebids, the high
bid received was $954,329and staffbelievescompetitivebidis attributed to having
availability in their schedule prior to the close of the 2024construction season.
Construction of this project is anticipated for thisseason with substantial completion by late-October
2024.
Peterson Companieshas successfully completed threeprojects for the City in the past threeyearsas well
as others within the past several years.Thethreemost recentwere the Craig Park Improvements, East
Moore Lake Biochar & Iron-Enhanced Sand Filter, and Farr Lake/Danube Ponds Dredging Projects. Staff
believes they are a responsive and reputable contractor,andwill deliver the project with the requisite
quality specified in the bid documents.

The resolution requests the bid amount of $725,600.74 with a 5% contingency. The contingency would
be available for any unforeseen minor exclusions in the plans, or additional improvements that may be
identified by staff during construction of the project. If the City Council approves the attached resolution,
staff will notify the contractor of the award and issue a notice to proceed to the contractor upon receipt
of acceptable submittals.
Financial Impact
Funding is provided by bond proceeds through the Capital Investment Program (CIP). The 2024
Neighborhood Improvements Project combined with the playground equipment and installation is
approximately $257,250 under the approved 2024 CIP budget. This is a result of in-kind work
performed by Parks Maintenance Staff that included miscellaneous site removals. Additionally,
Engineering Staff provided in-house project design and contract administration through the bid
solicitation phase. Construction administration and oversight will also be provided by Public Works
Staff through project completion.
Recommendation
Staff recommends the approval of Resolution No. 2024-51, Awarding 2024 Neighborhood Parks
Improvements Project No. 24-70457.

Award 2024 Neighborhood Parks Improvements Project No. 24-70457
Whereas, the City of Fridley (City) began a process of understanding the needs and desires of
residents for City parks improvements in 2019 called "Finding Your Fun in Fridley" by conducting
public workshops with residents; and
Whereas, City residents expressed an interest in improving City parks by upgrading playgrounds
and amenities; and
Whereas, on April 25, 2022, the City Council adopted Resolution No. 2022-36, which approves
the Park System Improvement Plan Final Report and authorizes staff to begin the implementation
phase of the Plan; and
Whereas, the Park System Improvement Plan provides funding for its implementation and
includes site improvements in Edgewater Gardens Park, Plymouth Square Park, and Logan Park.
Now, therefore be it resolved, that the City Council of the City of Fridley hereby receives the
bids for the 2024 Neighborhood Parks Improvements Project No. 24-70457 per the attached bid
tabulation and awards the project to the lowest responsive bidder, Peterson Companies, Inc. of
Chisago City, MN in the amount of $761,880.78 which includes a 5% contingency.

Background
On Tuesday, April 16at 9:30 a.m.,bids were publicly opened via the virtual bidding platform QuestCDN
and Microsoft Teams for the 2024 Street Rehabilitation Project No. ST2024-01. A total of eight
responsive bids were received.
The2024 Street Rehabilitation Project No. ST2024-01is identified within the Cityof Fridley(City)annual
street rehabilitation programandincludes the rehabilitation of portions of Lucia Lane, Channel Road,
th
66Avenue, Norton Avenue and Buchanan Street. The total project length is approximately 1.28 miles.
Roadway rehabilitationacross the project will include asphalt reclaimingand milling, asphalt pavingand
concrete curb & gutter repairs. Additional roadway improvements include the termination and
th
construction of a cul-de-sac at the intersection of Lucia Lane and 68Place,as well as the construction
of traffic calming measures along Channel Road.
approximately 1,650 feet of watermain along Channel Road as well as the replacement of 12 fire hydrant
assemblies across the project area. Additional utility improvements include the construction of a
hydrodynamic separator device along Channel Road for stormwater pretreatment.
As noted, eightbids were received (Exhibit A). The low bid was received from North Valley, Inc.of
Nowthen, Minnesotain the amount of $1,211,092.08. This is 18% below
of$1,480,112.50. The three lowest bids were competitive and within $65,371.60 of one another and the
four lowest bids were within $102,897.36. Of the eight bids, the high bid received was $1,739,092.07.
The City has worked with North Valley, Inc.in the past, most recently asthe prime contractor of the 2021

Street Rehabilitation Project No. ST2021-01 as well as a subcontractor on the 7Street and 57Avenue
Trail Project No. ST2021-21.Staff believe they are a knowledgeable and reputable contractor and will
deliver the project within the requisite quality specified in the bid documents.

Based upon favorable pricing of the low bid, special assessments are anticipated to be lower than the
preliminary estimates previously reported at the Hearing on Improvements. Property owners will receive
notification of project advancement in May presuming the City Council awards the project at this
meeting. A project information sheet will provide a tentative work schedule, work description and
contact information. During the project, staff will distribute weekly project updates via email and the
project-
begin in June/July with substantial completion in September of this year.
Financial Impact
Funding for this project is derived from several sources including Municipal State Aid street funding,
special assessments and Utility Capital Investment Plan (CIP) funds (water, sanitary sewer, and storm
sewer). Additional CIP funding for Traffic Safety Upgrades will support the addition of traffic calming
improvements along Channel Road.
The low bid for the overall project is roughly $200,000 below budget. Special assessment estimates
based on the low bid are in line with preliminary estimates.
Recommendation
Staff recommend the approval of Resolution No. 2024-52, Awarding 2024 Street Rehabilitation Project
No. ST2024-01.

Awarding 2024 Street Rehabilitation Project No. ST2024-01
Whereas, the City of Fridley (City) has prepared a Capital Investment Program to systematically
reconstruct streets, utilities and other municipal facilities within the City to maintain public
infrastructure quality and performance; and
Whereas, the 2024 Street Rehabilitation Project No. ST2024-01 (Project) is identified as part of
the Cityregular street maintenance programs under its Capital Investment Program and includes
th
the rehabilitation of portions of Lucia Lane, Channel Road, 66 Avenue, Norton Avenue and
Buchanan Street along with miscellaneous utility improvements and other ancillary items; and
Whereas, Resolution No. 2023-142 adopted November 27, 2023 received the Project feasibility
report and called for a public hearing on the matter of the construction of certain improvements
listed therein; and
Whereas, a public hearing regarding said improvements considered under the Project was set for
December 18, 2023 and ten days mailing notice and two weeks published notice of the hearing
was given; and
Whereas, at said hearing on improvements, the City Council heard all those persons that desired
to address the Council; and
Whereas, Resolution No. 2024-04 subsequently adopted January 8, 2024 ordered final plans,
specifications and calling for bids; and
Whereas, Resolution No. 2024-38 adopted March 25, 2024 amended the feasibility report to
include the construction of traffic calming measures along Channel Road in conjunction with the
aforementioned improvements, which were incorporated into the final plans and specifications;
and
Whereas, on April 16, 2024 electronic bids were received and read aloud, a bid tabulation was
prepared and a lowest responsive bidder identified.
Now therefore be it resolved, that the City Council of the City of Fridley hereby receives bids
per the attached bid tabulation and awards the 2024 Street Rehabilitation Project No. ST2024-01
to the lowest responsive bidder, North Valley Inc. of Nowthen, MN in the amount of $1,211,092.08.

Title
Resolution No. 2024-55, Appointing Members to the Public Arts Commission
Background
In fall of 2023, the Cityof Fridley (City)hosted a series of public engagement meetings. These meetings
were well attended and facilitated by Gretchen Nicholls and Barbara Raye, CDI, Minneapolis. The
facilitators were instrumental in drawing out the creative notions of those whoattended. The goal of the
sessions was to prepare a plan and recommendations for the Fridley City Council(Council)to help direct
the initiative in a way the public saw identity moving. The final report was posted on the City
website after theCouncil received the document in January of this year.
Great things have grown out of the recommendations have a task force, creation ofa 501C3 non-profit
as the fund-raising arm, and startingsmall with the installations so policy can form around the
installations and the taskforce can make a final policy plan document that includes not only suggested
art installation locations, but set policy for rotation (if appropriate), temporary installations, maintenance,
etc.
The task force has so enthusiastically taken on its role that the Mayor and Council have asked that the
task force be formally recognized as the Fridley Art Commission. The council considered the ordinance
to transition the group from a task force to a Commission at theApril 8 City Councilmeeting. ASecond
Reading of that Ordinance will occur this evening.
The Public Arts Commission will be established to foster the development of the arts, to advise the
Council on arts related matters and to stimulate participation in and appreciation of the arts by residents.
Membersto be appointed to the Commissioninclude Joshua Collins, Ryan Fugleberg, Gary Osterbauer,
Frank Sedzielarz, Maija Sedzielarz and Gary Swanson.
While still a task force, the future Arts Commission named the 501C3, FridleyCreative ArtsFoundation.
The formative legal documents necessary for a 501C3 are being reviewed and prepared at this time.
Financial Impact
Meeting minutes will now be officially prepared,which isconsistent with the process of all other City
administrative processes. Cost absorbed.

Appointing Members to the Fridley Public Art Commission
Whereas, the Fridley City Council (Council) asked staff to create a process for encouraging Public
Art in the City of Fridley (City); and
Whereas, to initially guide the
Development Initiative (CDI) to facilitate a series of community workshops from September to
October 2023 to gather community input; and
Whereas, numerous residents and business participants attended three community workshops,
and others offered their input through an on-line Public Art Ideas map that provided an alternative
way for community members to identify potential locations for public art and suggestions for
what type of public art could be a good fit for those locations; and
Whereas, as defined by those members of the public, accessible original art enriches the City as
it evokes meaning in the public realm. It can be a variety of art forms and takes into consideration
the site, its location and context, and the audience. Public art may possess functional as well as
aesthetic qualities; it may be integrated or discreet. Artists may work in partnership with other
design professionals or members of the community; however, the artist is directly involved in the
concept, design, or creation. Performances, installations, events, and other temporary expressions
are included in the definition; and
Whereas, those engaged in the process created the following Mission statement: Empowering
our vibrant community through the transformative power of public art, our mission is to cultivate
a cityscape that celebrates diversity, creativity, and shared experiences. We are dedicated to
fostering a sense of belonging, sparking dialogue and inspiring innovation through the strategic
integration of art into our urban fabric, enhancing the quality of life for all residents and visitors;
and
Whereas, the public participants recommended the following;
1.!creation of an Arts Commission composed of people that understand art.
2.!Commissioners could include artists/creatives, business owners, community organizations,
and others.
3.!Delay creating public art policies or ordinances until there is clarity from experience, and
how to best guide or administer public art initiatives (e.g., how to accept donations or gifts,
how to sunset art, etc.).
4.!Consider ways to integrate public art into capital projects where the city is already building
infrastructure.
5.!Coordinate efforts with the Park System Improvement Plan to explore opportunities to
incorporate public art in parks.

6.!Other cities like Hopkins, Bloomington, Mankato, Minneapolis, and Saint Paul have models
of governance bodies that oversee public art activities and offer important insights
valuable to their cities; and
Whereas, all members of the task force originally created in 2023, in response to the Public Arts
engagement process have carried on their responsibilities admirably; and
Whereas, members of that task force included Joshua Collins, Ryan Fugleberg, Gary Osterbauer,
Frank Sedzielarz, Maija Sedzielarz and Gary Swanson, who all agree to loyally transition into their
role as Public Art Commissioner.
Now, therefore be resolved, that the City Council of the City of Fridley does hereby appoint
Joshua Collins, Ryan Fugleberg, Gary Osterbauer, Frank Sedzielarz, Maija Sedzielarz and Gary
Swanson to the Fridley Public Arts Commission for terms to expire on December 31, 2027.

Each month, the City of Fridley (City) receives various donations and gifts to support City
operations, programs and projects. Pursuant to Minnesota Statute § 465.03, the City may accept
these donations and gifts for the benefit of residents. For specific donations or gifts, the donor
may prescribe certain requirements, such as for a specific activity or department.
Consistent with the abovementioned statute, staff prepared Schedule No. 1 (Exhibit A), which
outlines the various donations, gifts and/or sponsorships received by the City betweenMarch 16,
2024, and April 12,2024.To accept the same, the Council must adopt the attached resolution by
a twothird majority vote.
Lastly, for each donation, gift or sponsorship, staff ensure it meets an identified need, does not
create a quidproquo or longterm maintenance obligation, and the donor received an
acknowledgment of their gift through a letter or publication.

Approving Donations Received Between March 16, 2024 and April 12, 2024, from the
Fridley Lions Club
Whereas, throughout the year the City of Fridley (City) receives various gifts and donations; and
Whereas, the City is sincerely grateful for the support it receives from an array of organizations
and individuals; and
Whereas, without this support, the continuation of different events or programs would be difficult
to sustain; and
Whereas, the attached schedule (Exhibit A) lists all of the donations and gifts received by various
City departments between March 16, 2024, and April 12, 2024; and
Whereas, all of the items listed on the attached schedule (Exhibit A) are required to be accepted
by the City Council by a two-thirds majority vote; and
Whereas, all items have been determined to be donated free of any quid-pro-quo expectation
by the donor.
Now, therefore be it resolved, that the City Council of the City of Fridley hereby approves and
accepts the donations made between March 16, 2024, and April 12, 2024 from the Fridley Lions
Club.
