Adopting the Assessment for the 2024 Utility & Driveway Lateral Repair Projects
Whereas, pursuant to contracts signed by property owners or their representative, the Fridley City
Council has met and considered the proposed assessment for the 2024 Utility and Driveway
Lateral Repair Projects.
Now, therefore be it resolved, that the City Council of the City of Fridley hereby approves:
1. Such proposed assessment, a copy of which is attached hereto as Exhibit A and made a
part hereof, is hereby accepted and shall constitute the special assessment against the
lands named therein and each tract of land therein included is hereby found to be
benefited by the proposed improvement in the amount of the assessment levied against
it.
2. Such assessment shall be payable in equal annual installments extending over a period of
5 years for utility lateral repair and 10 years for driveway lateral repair, the first of the
installments to be certified to property taxes in 2025 and shall bear interest at the rate of
10.50% per annum from the date of the adoption of this assessment resolution. To the
first installment shall be added interest on the entire assessment from the date of this
resolution until December 31, 2025. To each subsequent installment when due shall be
added interest for one year on all unpaid installments.
3. The owner of any property so assessed may, at any time prior to certification of the
assessment to the County, make one payment of at least one hundred dollars ($100.00),
to the City of Fridley; no interest shall be charged if the entire assessment is paid within
30 days from the adoption of the assessment.
A property owner may pay to the City of Fridley the entire amount of the assessment
remaining unpaid, with interest accrued to December 31 of the year in which such payment
is made. Please note, no payments will be accepted between November 15 and December
31 of any year.
4. Upon receipt of any such prepayment, the City Clerk, with the assistance of the City
Treasurer, shall note the same upon the records of the City, credit the payee therefore, and
reduce the assessment as originally made in the amount of the prepayment received. The
balance remaining shall then be noted as the amount due and may then be certified to
the county together with and as a part of the assessment roll in which the original amount
due was contained.
5. The City Clerk shall forthwith transmit a certified duplicate of this assessment to the county
auditor to be extended on the property tax lists of the county. Such assessments shall be
collected and paid over in the same manner as other municipal taxes.
