RE: Installation of a Fence Within a City Right-of-Way
Dear Mr. Ziegler:
As the property owner of 6901 East River Road NE, you are proposing to install a fence on your
property within a City Right-of-Way. Below are the stipulations for the installation of the fence.
Stipulations:
1. The City hereby agrees to permit the placement of the fence on the subject property
within the 69th Way NE Right-of-Way.
2. The property owner acknowledges that the City may from time to time need to utilize
the right-of-way. The property owner agrees to hold the City harmless for any damages
which may occur to the fence due to the City’s exercise of its rights within the right-of-
way area. The property owner further acknowledges that if the City needs to dismantle
the fence to obtain access for the purpose of exercising its right-of-way rights, the
property owner will be responsible for the cost involved in dismantling the fence.
Additionally, any reconstruction of the fence including any costs, shall be the sole
responsibility of the property owner.
3. The property owner further agrees that in consideration of the City permitting the
subject fence to remain upon the 69th Ave NE right-of-way that the property owner
agrees that they shall not place any additional structures within the subject right-of-way area. Notwithstanding this language, the property owner acknowledges that they shall have an obligation to maintain the fence in a reasonable fashion.
4. This agreement shall be binding upon both parties and upon their heirs, successors and assigns.
5. Any additional costs incurred by the City in utilizing its right-of-way, which are caused by reason of the fence shall be reimbursed to the City upon thirty (30) days written notice to the property owner at 6901 East River Road NE or at such other address as the property
owner shall provide to the City in writing.
If you agree to the above terms and conditions, please sign below and return a signed copy of
this letter to the City.
