Written Report -
The Request
The petitioner, Ryan Gerhard, with Gerhard Builders and Remodeling LLC, on behalf of the property
owners, is requesting a Conditional Use Permit (CUP) to allow the construction of an oversized
accessory structure at 531 Kimball Street.
Site Description and History
The subject property is located on Kimball Street, west of East River Road, within the Riverview Heights
Neighborhood. It is zoned R-1, Single
Family
, as are all surrounding properties. — ■'
According to assessing records, the
existing home was constructed in 1950.
The detached garage was added in 1962,
followed by a front porch in 1963. In 1981,
a basement was constructed under the
home. The property is in the 0-2 Critical
Area District, but there are no Primary
Conservation Areas on the property and
the project does not trigger a Critical Area
Permit.
Code Requirements and Analysis
When the recodified Zoning Code was
approved in May of 2025, a provision was
added allowing single-family property
owners to request a CUP to construct an accessory structure exceeding the maximum square
footage requirement.
i
Current accessory structure standards are as follows:
• Single -Family lots 15,000 sq. ft. or less
• Garage plus two additional accessory structures allowed
• Maximum total footprint of all accessory structures: 1,500 sq. ft.
• No accessory structure may exceed the footprint of the principal building (house)
• Single -Family lots 15,001 sq. ft. or more
• Garage plus three additional accessory structures allowed
• Maximum total footprint of all accessory structures: 2,000 sq. ft.
• No accessory structure may exceed the footprint of the principal building (house)
The subject property is 12,366 sq. ft. The existing house is 1,140 sq. ft., the existing garage is 440 sq.
ft., and an approximately 120 sq. ft. shed is present on the property. The petitioner proposes
D A 1 .,f RQ
removing both existing accessory structures and constructing a new 30 ft. by 60 ft. (1,800 sq. ft.)
garage.
The purpose of a CUP is to provide the City with discretion in determining whether certain uses are
acceptable based on their impacts to public welfare, health and safety. The CUP process also
enables the City to impose reasonable conditions to mitigate potential negative impacts on
surrounding properties.
During the recodification process, the City included conditions for various types of CUPS. However,
no use -specific conditions were established for oversized accessory structures. As a result, staff
have identified and including stipulations for this CUP request.
Analysis of Code Provision
Over time as staff have worked with the new code and evaluated actual applications, some
challenges have been identified. Without clearly defined criteria for oversized accessory structures,
determining an appropriate structure size through a CUP becomes difficult and inconsistent. The
current standards limit accessory structures to the footprint of the principal building and to a
combined maximum of 1,500 sq. ft. for this lot size, while the proposed structure is 1,800 sq. ft. This
challenge highlights the need for more precise guidance within the ordinance.
During the zoning recodification process, it's common for staff and consultants to explore more
flexible standards. These standards were created in part to support modern residential needs, such
as providing additional storage space for homeowners, under the assumption that such flexibility
would have minimal impact on surrounding neighborhoods.
When reviewed by the Development Review Committee (DRC), several concerns were identified.
Most single-family lots in the City are 9,000 sq. ft. Oversized accessory structure on smaller lots risk
dominating backyards, creating extensive visual mass, shading adjacent properties, and altering the
typical residential character. Further, CUPS are not intended to replace dimensional standards; they
regulate uses and associated conditions, not provide exceptions from height, bulk or area limits.
Dimensional deviates are more appropriately reviewed through the variance process, which applied
a defined legal standard.
Evaluating this provision through a real -world application has prompted staff to reconsider the
appropriateness of allowing accessory structures to exceed standard size limits through a CUP. Staff
anticipate recommending modifications to this section of code during our annual code update.
Staff Recommendation
Staff recommends the Planning Commission hold a public hearing for Conditional Use Permit, CUP
#26-03 and recommend approval with stipulations.
Stipulations
Staff recommends that if the conditional use permit is approved, the following stipulations be
attached.
D AO . f Al
1. The petitioner must obtain all required permits for demolition of the existing accessory
structures and construction of the new garage.
2. No additional accessory structures are permitted on the property for as long as this
Conditional Use Permit remains in effect.
3. The accessory structure is not permitted to be used for a home occupation or converted into
habitable space.
4. The accessory structure must be architecturally compatible with the principal dwelling and
finished with complementary siding and color scheme.
5. Architectural features — such as windows or other design elements must be incorporated to
break up the 60-foot east elevation wall to reduce the visual mass.
6. Drainage from the accessory structure must be managed on site and not directed onto
adjacent properties. Gutters must be installed to properly capture and direct roof runoff.

Conditional Use Permit Request
531 Kimball Street Fridley, MN 55432
Summary of request:
We are requesting approval to build an oversized detached garage on our
property.
Reason for reauest:
As the third generation to own this home, we are committed to maintaining and
improving it for future generations. Our current garage is undersized, leaving
vehicles and personal property exposed to the elements. A larger garage would
provide secure storage, improve the property's appearance, and increase its
long-term value.
This project also holds deep personal significance. In January 2025, 1 lost my
father. One of his greatest passions was a 1937 American LaFrance fire engine
that he proudly owned since 1985. As a young boy in St. Louis Park, he watched
this very truck respond to emergencies and dreamed of owning it. It eventually
became much more than a vehicle —it became a treasured part of our family's
history.
As we prepare to sell my father's home in Fridley, we have chosen to keep the
fire engine in our family so his legacy can continue for future generations.
However, our existing garage cannot safely accommodate this historic vehicle.
Preserving it is the primary reason for our request.
Our family has proudly served the Fridley community through the fire department
since 1968. Building this garage is not only an investment in our property, but
also a reflection of our continued commitment to the community that has meant
so much to our family for generations.
Our goal is to create a secure home for an irreplaceable piece of our family's
history while enhancing our property and preserving a legacy of service. We
respectfully ask for your consideration and sincerely appreciate the opportunity to
continue investing in both our home and the City of Fridley.

2. Consider a Conditional Use Permit, CUP #26-03, by Gerhard Builders and Remodeling LLC, for
an Oversized Garage at 531 Kimball Street (Previously Item 3)
Stacy Stromberg, Assistant Community Development Director, presented a request for a
Conditional Use Permit (CUP) from Gerhard Builders on behalf of the property owner at 531 Kimball
Street for an oversized accessory structure. She reviewed the site description and history and
provided information about the Code requirements and the purpose of a CUP. She explained why
the provision was created in 2025 and reviewed an analysis of the issues identified during the
application review, concerns expressed by staff as part of the Development Review Committee
Planning Commission 8/19/2026 Minutes Page 2
meeting, and anticipated Code adjustments. She recommended approval as presented, subject to
the stipulations found within the staff report.
Commissioner Heuchert asked about the size of the lot. Ms. Stromberg replied that the lot is
12,366 square feet, which is a large -sized lot for the neighborhood.
Commissioner Meisner asked and received confirmation that the current Code language states that
if you want a larger -sized garage, you should apply for a CUP, as this would seem like more of a
variance request. Ms. Stromberg confirmed that the Code currently states that an applicant should
apply for a CUP, but typically there would be additional conditions and parameters included. She
agreed that a variance could an alternate path to approving oversized garages in the future and
that is something they will discuss in future Code adjustments.
Commissioner Heuchert asked about the setbacks for the garage. Ms. Stromberg replied that a
detached accessory structure can be three feet from the property line, but the Building Code would
require five feet from the property line. She stated that the applicant meets setback and lot
coverage requirements.
Motion by Commissioner Meisner to open the public hearing. Seconded by Commissioner Borman.
Upon a voice vote, all voting aye, Chair Hansen declared the motion carried unanimously, and the
public hearing was opened at 7:14 p.m.
Chair Hansen invited input from the public.
Ryan Gerhard, applicant, introduced himself, noting that the homeowner is also present.
Todd Messer, 531 Kimball Street, appreciated the time of the Commission in hearing this request.
He asked about the difference in definitions between a CUP and a variance. Ms. Stromberg replied
that a variance is harder to obtain because a practical difficulty has to be identified. She stated that
because the Code allows a CUP, that is a better path for the applicant.
Mr. Messer asked if there would be any way to keep his shed, perhaps moving it to the western side
of his property. He explained that he has large equipment in the shed that he would like to keep
secure and noted that the oversized garage would house his vehicles and a fire truck from his late
father. He noted that he intends to keep his property clean and secure but understands if he does
need to remove the shed.
Commissioner Brom asked if the Ordinance limits the number of accessory structures orjust the
total square footage. Ms. Stromberg replied that a property of this size is typically allowed to have
three accessory structures.
Planning Commission 8/19/2026 Minutes
Commissioner Brom asked if the shed would need to be added to the CUP in order to keep it. Ms.
Stromberg replied that the Commission could modify the stipulation if desired.
Mr. Messer stated that he would agree to no additional structures on the property if he could keep
the shed and would also agree that no living quarters would be included in the garage. He noted
that his wife and two neighbors are also present to support the request.
Kathleen Semke, 518 Kimball, commented that the Messers are great neighbors and she supports
the request. She did not feel that the proposed garage would overpower the lot and believed that
it would not only look good, but would fit more of the vehicles from the driveway.
Janice Born, 8316 East River Road, commented that the Messers are wonderful neighbors and she
fully supports the request. She commented that there is a large structure home across from the
subject property and the larger garage would bring balance. She commented on the value that the
Messers bring to the neighborhood and the assistance that they have provided to her since she has
become widowed. She noted that some of the equipment the Messers have is used to help
maintain her property and others in the neighborhood as well. She commented that her niece and
nephew also live in the neighborhood but could not attend tonight, noting that they also support
the request.
Lara Messer, Brooklyn Center, spoke in favor of her brother's request. She commented that their
father passed away in 2025 and left her brother his fire truck, which has been in the family since the
1980s. She commented that she supports the garage as it can house the fire truck, which is used in
parades in Fridley.
Ms. Stromberg stated that staff also received three phone calls in support of the request from
members in the neighborhood.
Commissioner Brom asked if there is a reason this sized structure is proposed. Mr. Messer
explained that the fire truck is approximately 25 feet long and about 12 feet wide. He stated that
this Ford F350 is used for plowing, and he would also like to keep that in the garage, along with his
wife's vehicle. He stated that he could also park his trailer in front of his wife's vehicle so they could
get everything in the garage. He stated that he and Mr. Gerhard talked about many different sizes
and determined this to be the best size to fit those items.
Commissioner Borman asked how the shed would be allowed to remain. Chair Hansen replied that
they would need to modify the stipulations.
Commissioner Borman stated that he would be in favor of allowing the shed to remain, noting that
it would also provide an opportunity for storage of some items when the existing garage is
removed, and the new garage is constructed.
Planning Commission 8/19/2026
Minutes Paqe 4
Motion by Commissioner Meisner to close the public hearing. Seconded by Commissioner Borman.
Upon a voice vote, all voting aye, Chair Hansen declared the motion carried unanimously, and the
public hearing was closed at 727 p.m.
Commissioner Brom stated that he does not have any problems with the request but asked if this
would set a precedent.
Chair Hansen stated that staff has explained that they will be revisiting the Code in the future to
discuss this type of item.
Commissioner Meisner recognized that in the future they may require a larger lot for this sized
structure, but the Code currently allows it.
Commissioner Borman commented that someone in his neighborhood has a garage larger than
what is proposed and he has no objections to that. He stated that either things are able to be kept
in a garage or the large vehicles are kept in the driveway.
Commissioner Meisner commented that gabling the ends of this building could make it more
attractive, but there seems to be support as proposed from the neighbors.
Commissioner Heuchert stated that he does not have any opposition to the design as proposed.
Chair Hansen recognized that the neighbors are in support of the request, noting that if there was
opposition, the discussion may be different. He stated that he has no objection to leaving the shed,
as keeping items contained will look better than having them around the yard.
Ms. Stromberg stated that if the shed is allowed to remain, that would equate to 24.7 percent lot
coverage, which would mean the site is built out for roofed structures.
Motion by Commissioner Meisner recommended approval of a Conditional Use Permit, CUP #26-03,
with the listed stipulations, modifying the second stipulation to allow the retention of the existing shed
and no further structures. Seconded by Commissioner Borman.
Upon a voice vote, with all voting aye, Chair Hansen declared the motion carried unanimously.
It was noted that this will move forward to the City Council for consideration on September 14,
2026.

Title: Resolution No. 2026-99, Approving Conditional Use Permit, CUP #26-03 by
Gerhard Builders and Remodeling, LLC for an Oversized Garage at 531 Kimball
Street N.E. (Ward 3)
Background
The petitioner, Ryan Gerhard, with Gerhard Builders and Remodeling LLC, on behalf of the
property owners, is requesting a Conditional Use Permit (CUP) to allow the construction of an
oversized accessory structure at 531 Kimball Street.
The subject property is located on Kimball Street, west of East River Road, within the Riverview
Heights Neighborhood. It is zoned R-1, Single Family, as are all surrounding properties.
According to assessing records, the existing home was constructed in 1950. The detached
garage was added in 1962, followed by a front porch in 1963. In 1981, a basement was
constructed under the home. The property is in the 0-2 Critical Area District, but there are no
Primary Conservation Areas on the property and the project does not trigger a Critical Area
Permit.
When the recodified zoning chapters of the City Code were approved in May of 2025, a
provision was added allowing single-family property owners to request a CUP to construct an
accessory structure exceeding the maximum square footage requirement.
Current accessory structure standards are as follows:
• Single -Family lots 15,000 sq. ft. or less
o Garage plus two additional accessory structures allowed
o Maximum total footprint of all accessory structures: 1,500 sq. ft.
o No accessory structure may exceed the footprint of the principal building (house)
• Single -Family lots 15,001 sq. ft. or more
o Garage plus three additional accessory structures allowed
o Maximum total footprint of all accessory structures: 2,000 sq. ft.
o No accessory structure may exceed the footprint of the principal building (house)
The subject property is 12,366 sq. ft. The existing house is 1,140 sq. ft., the existing garage is 440
sq. ft., and an approximately 120 sq. ft. shed is present on the property. The petitioner proposes
removing both existing accessory structures and constructing a new 30 ft. by 60 ft. (1,800 sq. ft.)
garage.
The purpose of a CUP is to provide the City with discretion in determining whether certain uses
are acceptable based on their impacts to public welfare, health and safety. The CUP process also
enables the City to impose reasonable conditions to mitigate potential negative impacts on
surrounding properties.
During the recodification process, the City included conditions for various types of CUPs.
However, no use -specific conditions were established for oversized accessory structures. As a
result, staff have identified and including stipulations for this CUP request.
Over time, as staff have worked with the new code and evaluated actual applications, some
challenges have been identified. Without clearly defined criteria for oversized accessory
structures, determining an appropriate structure size through a CUP becomes difficult and
inconsistent. The current standards limit accessory structures to the footprint of the principal
building and to a combined maximum of 1,500 sq. ft. for this lot size, while the proposed
structure is 1,800 sq. ft. This challenge highlights the need for more precise guidance within the
ordinance.
During the zoning recodification process, it's common for staff and consultants to explore more
flexible standards. These standards were created in part to support modern residential needs,
such as providing additional storage space for homeowners, under the assumption that such
flexibility would have minimal impact on surrounding neighborhoods.
When reviewed by the Development Review Committee (DRC), several concerns were identified.
Most single-family lots in the City are 9,000 sq. ft. Oversized accessory structure on smaller lots
risk dominating backyards, creating extensive visual mass, shading adjacent properties, and
altering the typical residential character. Further, CUPS are not intended to replace dimensional
standards; they regulate uses and associated conditions, not provide exceptions from height,
bulk or area limits. Dimensional deviates are more appropriately reviewed through the variance
process, which applied a defined legal standard.
Evaluating this provision through a real -world application has prompted staff to reconsider the
appropriateness of allowing accessory structures to exceed standard size limits through a CUP.
Staff anticipate recommending modifications to this section of code during our annual code
update.
A Notice of Public Hearing before the Planning Commission was published in the August 7,
2026, edition of the Official Publication.
The Planning Commission held a public hearing for CUP #26-03 at their August 19, 2026,
meeting. Following a discussion, the Commission recommended approval of the stipulations,
including a modification to stipulation #2 to allow the property owner to retain the existing 120
sq. ft. shed in addition to the proposed accessory structure. All remaining stipulations were
approved as presented. The motion, including the modification to stipulation #2, passed
unanimously.
