ROLL CALL : Members Present: French, Engdahl, Meissner Members Absent: Forster, Schmedeke Others Present: Darrel Clark, Community Development Administrator 1. VACATION RE UEST, SAV #72-05, BY LEIF HENRI�.SEN: To vacate 64� Way being the cul de sac in Veit's Addition and construct a private road. Mr. Henriksen was present. He stated that the way the road is shown on the certificate of �urvey, it is 40 feet with the cul de sac. His request was to vacate the street and cul de sac and then make a 20 foot wide private road eliminating the cul de sac. He stated he owns three lots. When a survey was made of the property, two of the lots were smaller than he thought as he had used the wrong survey. The house to be built on Lot 3, without using the land that the cul de sac would add, would be only five feet from the river bank. By elimi.nating the cul de sac, the house could be pulled forward. Mr. Clark said that from the City's standpoint, there would be one less stxeet to maintain. A cul de sac is hard to plow, but desirable to live on. As long as all the parties concerned agree to the vacation, that this is a private road, the City would not object. The procedure is to vacate the whole thing and then deed the 20.foot easement for water and sewer to the City. Each home owner would receive a deed for their portion of the driveway. Mr. Henrik�en said he found an iron in the middle of the cul de sac so that it would be simple to lay out the road. Mr. Clark said that one of the lots was quite small. This vacation would make it about 10 feet larger. Mr. Henriksen said that was the lot with the high ground overlooking the river. With the right type of arranging the house, it would be a nice pi�ce of property. Asked if his neighbor would be willing to sell an extra 10 feet, Mr. Henriksen s aid he thought the neighbor would, but at a price: The lots on the river have a 20 foot driveway for ingress and egress, Mr. Clark said, and the City has a 20 foot utility easement. MOTION by Engdahl, seconded by French, that the Plats & Subdivisions- Streets & Utilities 5ubcommittee recommend to the Planning Commission approval of the vacation request, SAV #72-05, by Leif Henriksen of the vacation of 64� Way and the cul de sac in Veit's Addition and that there be a 20 foot easement in the private driveway for the sewer and water utilities as necessary. Upon a voice vote, all voting aye, the motion carried unanimously. �lats. & Suhs.-Str. & Uti1. - N 8. 1972 Page 2 Mr. Clark informed Mr. Henriksen that he would have to have a certificate of survey. Mr. Aenriksen then asked how far from the bank could he build. Mr. Clark said he would have to look at the property before answering. 2. VACATION BEQUEST; SAV=��72T�6, �Y STATE LAND & DEVELOPMENT C0. (PAUL BURKHOLDER): To vacate 55th Avenue between 5th and 6th Streets and the 12 foot alley located in Block l0, Ham3-lton's Addition to Mechanicsvi�lle located hetween Highway 4f100 on the North and 54th Street on the South being the property of the.Sacred Eieart of Jesus Polish Catholic Cemetery. Mr. Burkholder was present. Mr. Burkholder explained he is concerned with the North portion of the 'cemetery property being B1ock 10, Hamilton's Addition to Mechanicsville. The cemetery dates back to 1914. Part of B1..:10 was rezoned from R-2 to R-3A in 1969. Mr. Clark said, that according to the law, the whole alley should be vacated. There is a little piece of 55th Avenu� that still shows up on the plat and it could be used for connecting 5th Street to 7th Street. However, there is a sight.problem where it would intersect with 7th Street. Mr. French stated he had driven up to the property and obviously the alley has never been used or could be used. Mr. Burkholder commented that primary access to the property is on the West. Acting Chairman Meissner summed up thE discussion by saying he did not see any reason why they could not vacate the street and the alley is not used. There are no problems with easements. MOTION by French, seconded by Engdahl, that the Plats & Subdivisions- Streets & Utilities Subcommittee recommend to the Planning Commission the vacation of the 12 foot alley in B1ock 10, Hami.lton's Addition to Mechanicsville, and the vacation of 55th Av�nue between 5th and 6th Streets, noting that utility easements are not required as per the Vacation Request, SAV #72-06, by State Land.& Development Co. (Paul Burkholder). Upon a voice vote, all voting aye, the motion carried unanimously. ADJOURNMENT : There being no further business, Acting Chairman Meissner adjourned the meeting at 7:40 P.M.
