Upon a voice vote, a11 voting aye, the motion carried unanimously. MOTION by Christensen, seconded by French, to alter the agenda �nd hear the second item first. Upon a voice vote, all voting aye, the motion carried unanimously. l. LOT SPLIT RE UEST, L.S. #73-07, DAVI5 S. MYCKA: Split off the Westerly 10 feet of Lot 32, Revised Auditor's Subdivision No. 77, , to be purchased by owner of Lot 31. Mr. David S. Mycka was present. Mr. Boardman said Lots 31 and 32 would not have access to East River Road when the cul-de-sac plan was put in, off Riverview Terrace. 71z Way was an unimproved �treet. On the cul-de-sac plan, the road would be on the East side of Lot 31 and both of these lots would be served by private drives. Administration has no objection to this lot split. Mr. Mycka said his neighbor wishes to purchase the 10 feet because he wants to build a double garage and needs the property to meet the setback requirements. Mr. Mycka said his home is presently about 110 feet from his back property line so he didn't need the 10 feet. Mr. Meissner asked if there were any utility easements on this part of the lot. Mr. Boardman said there weren't any utilities involved. Mr. Christensen said there was a garage on Lot 31 at the present time. Mr. Mycka said this was an old single garage which will be torn down and Plats � Subs.-Str. � Util. ��iz#� Meeting -June 6,,1973 Page 2 replaced with a new double garage. Mr. Christensen asked Mr. Boardman why a lot split was needed for this 10 feet. Mr. Boardman said the County would split the lot when the deed was filed, but the City doesn't split any property without an approved lot split by the City. This would be so the assessments were levied to the owner of the 10 feet, and the owner of Lot 31 could s�ow this as part of his property when he applies for his building permit. MOTION by French, seconded by Christensen, that Plats & Subdivisions- Streets & Utilities Subcommittee recommend to the Planning Commission approval of lot split request, L.S. #73-07, by David S. Mycka, to split off the Westerly 10 feet of Lot 32, Revised Auditor's Subdivision No. 77, to be purchased by the owner of Lot 31. Upon a voice vote, all voting aye, the motion carried unanimously. 2. VACATION REQUEST: SAV #73-09, MICHAEL SELEDIC, JR.: Vacate 61st Way between East River Road and Burlington Northern Railroad; Vacate alley between Lots 4-10, 14-20, Block 20; Vacate 612 Way N.E. between Lots 4-7, 19-23, Block 20; Vacate alley between Lots 3-7. 20-23, Block 19; a11 in Fridley Park Addition, to allow construction of a 69 unit apartment building. Mr. Michael Seledic, Jr. was present. Mr. Meissner said his first question was why we were vacatin� only a portion of all these streets and alleys. Mr. Boardman said the purpose of the request for the vacations is to allow the construction of a 69 unit apartment building. It will come up before the Planning Commission tonight, along with a rezoning request. The roads and alleys have already been vacated on the property owned by the railroad. What the City feels about this location is that there will be a street signal at 61st Way. We want to keep this road open for access to East River Road and we want a road easement on the back of the property. We are also concerned about the drainage on this property. If the vacation is approved, it should be contingent upon the rezoning being approved. Mr. French asked if this would be approved when it has access on East River Road. Mr. Boardman said there would be a center island at this location and they would only have access one-way. Mr. Christensen said 61st Way has not been improved at the present time. Mr. Boardman said it would have to be, if this proposal went through.. Mr. Harris asked if there weren't some homes on 61% Way. Mr. Boardman said there were two or three homes. Mr. Meissner said there are apparently utilities in this area now. Mr. Boardman said there was a gas main on 612 Way and also a fire hydrant. The utilities would have to be altered. Mr. Seledic said there weren't. Mr. Seledic said he has checked with the County, and they have at least three proposals for East River Road. We have been in a quandary as to which way to go, but right now we can work this any way. This was set up according to what seemed to be the plan most favored by the County at the present time. Mr. Boardman said it was because of the three proposals by the County that we can't allow the vacation of 61st Way, until the plans are definite in this area. Mr. Harris said we only have half the right of way on 61st Way and half a dedication of the road that would go in back of this proposal. We would have to get additional right of way from Burlington Northern. Mr. Boardman said the property that is owned by Burlington Northern is zoned light industrial. Mr. Harris asked if all the property to the East of this proposal was owned by the railroad. Mr. Boardman said it was. Mr. Meissner_asked if the vacations were approved, would the City want any utility easements retained. Mr. Boardman said we are not sure where we will want drainage easements, but it can be a stipulation that the drainage and roadway easements be worked out with administration. We have sewer, water and gas lines in this area which will have to be stubbed or looped back and altered. This should also be a stipulation. Mr. Harris said he wouldn't want to leave dead-end alleys. Mr. French said he felt that any alley that has never been put in, and it was certain they would never put it in, should be vacated. Mr. Harris s.aid the other property owners would have to be notified before the entire alley could be vacated. Mr. Seledic said they lost about 15 feet when the property was surveyed, so they would only have 65 units. There would be one underground parking stall for each unit, plus one parking space for each unit on the back of the property. The 12 stalls proposed in the front, were just for visitor parking. He said they would not need any variances. Mr. Meissner said that if we ask for a 30 foot dedication for a road along the East side of the property, it could make a difference in your proposal. Mr. Seledic said he liked the plan of having access to 61st Way and the access road along the East side of the property. Mr. Boardman said there was a problem in the timing of this proposal in that the City has not made a decision on when whether or not they are going to put this road in. Mr. Harris said there could be a cul-de-sac put in on 61z Way for access just for the residential area. Mr. Boardman said this would help serve as a buffer between the residences and the apartment complex. Mr. Har�is said it.would because it would keep the apartment traffic out of the residential area. They could only go North and would have to make a U-turn to go South. Mr. Harris said they would have this problem without this proposal, as would others in this area. If it made East River Road a safer route, the inconvenience was worth.it. Mr. Christensen asked if there any plans to improve 62�d Way. Mr. Boardman said'there were no plans at the present time.
