MUNICIPAL BATHING BEACHES THE CITY COUNCIL OF THE CITY OF FRIDLEY HEREBY FINDS AND ORDAINS, AFTER REVIEW, EXAMINATION AND STAFF RECOMMENDATION THAT CHAPTER 507, MUNICIPAL BATHING BEACHES OF THE FRIDLEY CITY CODE BE AMENDED AS FOLLOWS: Chapter 507. Municipal Swimmin� �g Beaches 507.01. Definitions'�°^^'� T'°��°�' 1. Guarded Swimmin� Beach. A�uarded swimmin� beach shall be attended by life u.°� ards hired by the City of Fridle� 2. Public Swimmin.°� Beach. A public swimmin� �g beach shall mean any public land or highway adjoining public water, any area which has been so designated by the Council, or any privately owned place which the public is permitted to frequent or use for swimming. 3. Un�uarded Swimmin� Beach. An un�uarded swimmin� beach shall not be attended bX life�uards on duty and all park visitors will swim or wade in the water at their own risk. 507.02. Beach Season ���'�� The date of the season opening and closing of the Fridley Municipal swimmin� �g beaches, generally June 15 to August 15, shall be directed by the Parks and Recreation Commission each calendar year. 507.03. Hours �^,- c„ron.;�o,a c,,,;,,,,,,;,,,, 1. The Fridley Municipal swimmin� �g beaches shall be open �**°r�'°�"���'�� ����r�'� T-�'�� °'��'� at hours and times designated by the Parks and Recreation Commission. 2. The Recreation Director or desi�nated staff inember c„r°n�;��r�, T;� ,.,,�r,a �r ���, ��° ��*�,° '�� ����r�'� �r �'��*�� �* *'�°'�°��'� may close the swimmin� �g beaches whenever, in that person's judgment, the water is too rough or cold for swimmin� �g. The swimmin� beaches may also close for periods of severe weather and/or the presence of li h.°� tning_ No persons shall be permitted in the water during the periods when the beaches are declared closed �.., ., i; � ,.,,.,,-,a 507.04. Swimmin� �g Beach Rules and Regulations 1. No person shall throw, cast, deposit, damage, lay, place or scatter in the water or upon any swimmin� �g beach any lighted cigars or cigarettes or any glass, bottles, nails, tacks, wire. crockery, cans or other sharp or cutting substance or any refuse matter or article or thing of any Ordinance No.1176 Page 2 kind. If any glass is broken, the person responsible for the breakage shall immediately pick up the pieces and place them in a trash container. . � ���/n1 %��l�f���� %����1�������I���1�1��������•�`1��� ��� %���T1�/��� \ 24. No person shall light or make use of any fire on any beach, except in locations provided for that purpose. 3�. No person shall swim or bathe in the water fronting any swimmin� �g beach outside established hours or outside the designated swimming area at any municipal beach. 4b. No swimmer or bather shall enter the water or onto any swimmin� �g beach unless clothed in a swimmin� �g suit. 5�. No person shall change clothes on any beach or in vehicles parked at any beach. 6�. No person shall appear in the state of nudity, nor shall any person make any indecent exposure of their �� person in any park or upon any swimmin� �g beach. . .. - - - :.•�.,._::! 7�9. No personal shall bring or carry any bicycle upon any swimmin� �g beach or in the water in such manner as to jeopardize the safety and health of themselves'��m°°'� �r'�°r°°'� and/or others. 8�. At �uarded swimmin� beaches, no person shall carry on unnecessary conversation with lifeguards; or falsely call for help or assistance; or stand, sit upon or cling to any lifeguard perches or light towers; or, except in an emergency, go into or cling to lifeguard boats. 9�. No person shall conduct themselves'��m�°'� �r'�°r�°'�upon any swimmin� �g beach or in the water in such a manner as to jeopardize the safety and health of themselves �� �€ and/or others. A. No person shall use profane, offensive or vul a.°� r langua�e and no person shall conduct themselves in a rou�h, boisterous, su�estive or offensive manner while in the water or upon any beach B. No person shall bring, drive, lead, carry or permit any do� or animal, whether leashed or unleashed, muzzled or unmuzzled, onto the premises of any swimmin b.°� each. C. No person shall brin� into or use in the water artificial floats of any kinds or description. Ordinance No.1176 10�. No person having, or apparently having, an infectious disease shall be admitted to a swimmin� �g beach. Page 3 11�-4. No person, except children, their parents, custodians or guardians, shall be permitted in any play area on swimmin� �g beaches designated for children. 12�. No child under twelve (12) years of age shall be allowed on the beach unless under the supervision of a competent person who shall be not less than si�teen (16) years of age. 507.05. Conduct of Lifeguards All lifeguards shall be subject to rules and regulations prescribed by the Parks and Recreation Commission. 507.06. Authority of Lifeguards At �uarded beaches, the duly appointed lifeguards are hereby authorized and empowered to order swimmers out of the swimmin� �g beach waters at such time and under conditions as they deem necessary for the public welfare and to maintain the peace and safety on the streets, grounds and water involved. 507.07. Liquors It shall be unlawful for any person to have in their �� position or to consume any intoxicating liquor or 3.2% �e��g malt liquor on Fridley Municipal swimmin� �g beaches. 507.08. Penalties Any violation of this Chapter is a misdemeanor and is subject to all penalties provided for such violations under the provisions of Chapter 901 of this Code.
