Ordinance No. 1248 12-03-2007ORDINANCE NO. 1248 AN ORDINANCE AMENDING FRIDLEY CITY CODE CHAPTER 603 INTOXICATING LIQUOR TO ALLOW SALE OF INTOXICATING MALT LIQUOR WITH 3.2% MALT LIQUOR AND WINE LICENSES The Fridley City Council hereby finds after review, examination and recommendation of staff that Chapter 603 related to sale of sale of intoxicating liquor be hereby amended and ordains as follows: SECTION 1 Chapter 603 is hereby amended as follows: 603.23. SALE OF INTOXICATING MALT LIQUOR A licensee who has been issued an on-sale 3.2% malt liquor license and an on-sale wine license may sell intoxicatin� malt liquor whose �ross receipts are at least 60 percent attributable to the sale of food, without an additional license, as allowed by Minnesota Statutes 340A. At the time for renewal of the a�plication for an on-sale 3.2% malt liquor and wine license, the a�plicant shall submit proof to the City in a statement made by a certified public accountant. The statement shall provide proof of the total �ross sales, the total �ross malt liquor and wine sales, and the total �ross food sales of the restaurant for the twelve (12) month period immediately precedin� the date for filin� renewal a�plications. The statement shall also provide proof that a minimum of 60% of the total �ross sales shall be attributable to the sale of food prepared on-site and not from vendin� machines. SECTION 2 That the current numeration in Sections 603.23 through 27 be numbered accordingly so as to incorporate this new section into the City Code.
