AN ORDINANCE AMENDING CHAPTER 128 OF THE FRIDLEY CITY CODE PERTAINING
TO ABATEMENT OF EXTERIOR PUBLIC NUISANCES
The City Cauncil af the City af Fridiey hereby finds, after review, examinatian and recammendatian af
staff, that Sectian 128.06 af the Fridiey City Cade be hereby amended as fallaws:

128.06 PROCEDURES FOR REMOVAL OF E�TERIOR PUCLIC NUISANCES
2. Hearing.
Any praperty awner wha feels aggrieved by an arder af #� a Cade Enfarcement Officer ar ather duly
autharized agent issued pursuant ta this chapter may request a hearing befare the
Ai�t�eais Cammissian. Such request shall be filed in writing with the affice a� the Cammunity
Develapment Directar within twenty (20} days after the date af service af the natice by the Cade
Enfarcement Officer ar ather duly autharized agent. The Cammunity Develapment Directar shall natify
the u°�ri„R �'°�m;„°r �T�'�rt �'��" At�i�eais Cammissian and � the praperty awner af the date, time,
and place af the hearing. The hearing shall be canducted na mare than ���th�(�30} days after the
u°�ri�n ��,�m;r°r r°�°;�r°� ��+;�° n�+�.° praperty awner's request, unless a later date is mutually agreed
ta by the ne � � praperty awner and the City. Bath the praperty awner and
rei�resentatives af the City may appear at the hearing with caunsel and may ca11 s� witnesses and
present� relevant and campetent evidence � � a°*°�;„°�"�-T *'�° u°�-�„R �'�,�m;„°r *rt'�° r°'°Tr�„*
Within ten (10} days after such hearing, the €E€�r�g����Ai�t�eais Cammissian shail affirm, repeai
ar madify the arder af the Cade Enfarcement Officer ar ather duly autharized agent. The €�g
€��t�� Ai�t�eals Cammissian's arder sha11 be accampanied by written findings af fact, and may
include a finding af fact as ta the absence af value af the refuse and�ar junk materiais deemed ta
canstitute an exteriar public nuisance. Any persan aggrieved by the decisian af the €E€�����ri�
Ai�t�eais Cammissian may appeal that decisian ta the City Cauncil by filing natice af such appeal with the
Cammunity Develapment Directar within twenty (20} days af receiving natice af the €[€������
At�i�eals Cammissian's decisian. At its next availabie regular meeting failawing the filing af a natice af
appeai, the Cauncil sha11 review the decisian and findings af fact af the u°����a �:`�� Ai�t�eais
Cammissian and sha11 affirm, repeai ar madify that decisian. If the Cauncii affirms the €�€�g
€��t�� Ai�t�eais Cammissian's decisian deciaring that an e�teriar pubiic nuisance exists, the City
shail abate the e�teriar pubiic nuisance after twenty (20} days fallawing the Cauncii's finai determinatian,
uniess the praperty awner e�� t�etitians far a caurt arder ta the cantrary within said twenty (20} days.
