Ordinance No. 1289 02-12-2012CITY OF FRIDLEY NIlNESOTA COUNTY OF ANOKA ORDINANCE NO. 1289 AN ORDINANCE AMENDING CHAPTER 2, SECTION 2.06 OF THE FRIDLEY CITY CHARTER TO ALLOW FOR A VACANCY OF A COUNCILMEMBER TO BE FILLED BY APPOINTMENT The City Council of the City of Fridley hereby finds, after review, examination and recommendation by the Fridley Charter Commission and staff, that the Fridley City Charter be hereby amended as follows: FRIDLEY CITY CHARTER CHAPTER 2. CITY COUNCIL ORGAl�]IZATION Section 2.06. VACANCIES IN THE COL7NCIL. 1. A vacancy in the council shall be deemed to exist in case of the failure of any elected person elected thereto to qualify on or before the date of the second regular meeting of the new council, or by reason of the death, resignation, removal from office, continuous absence from the City for more than three (3) months, failure to attend any council meetin�s for three (3) consecutive months, or conviction of a felony of any such person whether before or after their qualification; or by ceasing to be a resident of the city or the ward from which elected. In each such case, within thirty (30) days the council shall by resolution declare a vacancy to exist. (Ref. Ord. 1141) 2. If a vacancy is declared to exist, the Council shall, within 30 daysTa�point by majority vote a qualified person to assume the office until the ne�t �eneral election. If the council cannot a�ree on an a�pointment within the required timeframe, the Mayor shall a�point a qualified person to fill the position. The Councilmember-at-Lar�e shall then be declared vacant and it shall be filled as defined in Section 2.06.2 of the Citv Charter. 4. � If at any time the membership of the Council is reduced to less than three (3) members, the City Manager shall order a special election to be held not less than thirty (30) days nor more than si�ty-five (65) days from the time the multiple vacancies occurred. A period of eight (8) to twelve (12) consecutive working days shall be desi�nated for the purpose of filing nomination petitions in accordance with Section 4.06.
