Ordinance No. 0197 12-19-1961� 1 C J � QRDINANCE NO. 797 AN ORDINANCE TO AMEND AN ORDINANCE RELATING TO GASOLIN�E PUMPS THE COUNCIL OF THE CTTY OF� FRIDLEY DO ORDAIN: That Ordinance No. 17, en- tifled, "AN ORDINANCE RE- LATING TO GASOLINE PUMPS", passed and adopted on the lst day of August, 1949, is amended by adding following�- 5ection 1 thereof, the following sections: "SEC. 1.1." That upon the re- ceipt of any application � for the erection,� placement, keeping or maintaining of any gasoline pump or any building or strn��cture in �vhich such gasoline pump is to be housed or in canneMion with w-hich any gasoline pump is to be used, that before granting or issu- ing therefor a permit or license, the Council shall determine the effect of such erection, place- ment, keeping or maintaining r.pon public health, safety or the general welfare; and whenever the Council shall determine and find that such erection, place- ment, keeping or maintaining, of s���ah gasoline pump, or the Uuild- ing or structure in which the same is housed or to be housed, or in connection with which the same is to be used, is detrimental to public health, safe4y and the general welfare, that then the Council shall deny the issuance of such license or permit as is applied for. In making a deter- mination whether or not the erec- tion, placement, keeping or main- taining of any such gasoline pump, or the erection or con- struction of a Uuilding or stru�c- ture in which the same is housed, or to be haused, or in conneMion with which such pump is Ro be used, is detrimental to the pub- lic health, safety, and the general welfare, the Council may consid- er the nature of the ]and upon ' which the same is located or to I be located, the nature of adjoin- ing land, or bu�ildings, fire haz- �, ards created thereby, the effect � upon traffic into and from the premises, or on any adjoining roads, whether or not such a pump or building or similar structure is already in existence and located on the same premises or on other lands immediakely close 6y, and all such other or further factors as the Council sl�all deem requisite of cronsidera- Uon in determining the effect of such installation or construction on public health, safety and gen- ei•al welfare. "SEC. 1.2.° That whenever the Council shaIl find that a gasoline pump has previously erected, placed, kept or maintained in any ]ocation, and that such erection, placement, keeping or maintaining has caused, or tends te cause a public nuisance, whe- ther the same be by reasan of danger of fire, traffic safety wise, unsanitary conditions on the pre- mises, or other factors injurious to public health, safety and the general welfare, that then the Council may withhold the grant- ing of a funther license or permit reqv�ired therefor, with respect to any premises upon which the same are located until such nui- , sance or threatened nuisance be � corrected or abated, as the case may be, or the Council may issue the same upon condition that any such nuisance be corrected and abated and cease to exist within such a reasonable period of time as the Council shall state. "SEC. 2." That this amend- ment shall be effective upon its passage and adoption. PASSED AND ADOPTED BY THE COV'NCIL OF THE CTTY CF FRIDLEY THIS 19TH D.1Y OF DECEMBER, 1961.
