Ordinance No. 0351 10-17-1966ORDINANCE N0. 351 AN ORDINANCE AMENDING SECTIONS 48.01, 45.02, 48.04, AND 48.05 PERTAINING TO THE DUTIES OF THE PLANNING COMMISSION AND AUTHORIZING A SUB-DIVISION OF THE PLANNING COMMISSION TO SERVE AS 9 BUILDING BOARD AND PRESCRIBING THE DUTIES THEREOF. THE COUNCIL OF THE CITY OF FRIDLEY DO ORDAIN AS FOLLOWS: , 48.011. It is hereby ordered that the Building Standards and Design Control, a sub-committee of the Fridley City Planning Commission, shall serve as a Building Board. The board shall consist of five members: 1. The Chairman of which shall�be a member of the Planning Commission. 2. An Architect, construction engineer, builder or other similarly competent person residing in the City. 3. Three members - one from each of the three wards within the City. Members of the Building Board, except the Chairman of the Building Standards and Design Control Sub-committee of the Planning Commission, sha11 be appointed by the Mayor with the approval of the City Council, except that the ward representatives are appointed by the respective Ward Councilman with approval of the Council. Membership is for a term of one year, commencing on the 15th day of January of each year and thereafter until each of their respective successors is appointed and qualified. Members of the Building Board serve without compensation but may be reimbursed for expenses incurred in the performance of their duties. 48.021. A majority of such Board sha11 constitute a quorum. The Board shall elect such other officers besides the Chairman, as it deems necessary. _ � The Board shall keep a record of its proceedings, shall adopt rules and regu- " lations governing its proceedings, and shall record IIhe vote of each member � of its findings and its determinations. In case of absence or disability of either the chairman or the secretary, the Board may elect any member as acting chairman�or acting secretary, who shall act during such period of absence or disability. The Board shall meet twice monthly and as often as necessary to perform its duties. 48.03. Not changed 6y this ordinance, refer to City Code as published. 48.041. Within three (3) days after the receipt of such a.pplica.tion papers and opinions the secretary shall give notice to each member of the Building Board, to the applicant, and to any other persons he deems advisable, of a hearing to be held by the Building Board with respect to such application. The notice shall state the purpose of the hearing and the location of the structure. Notice to the applicant shall be by mail at lease three (3) days in advance of such hearing, provided appearance at the hearing shall constitute a-w4iver of any defect in the notice thereof. The hearing on such application shall be held at the next regular meeting of the Board, but not less than one week nor more than three weeks after receipt of such application by the secretary of the Board. 48.051. Before or during the hearing, each member may view the premises upon which the structure is located or to be located, and at the hearing the Board shall examine the application papers and hear the applicant. It may also � hear any person who requests to be heard. The Board may adjourn from time to time but within forty-eight (48) hours of the close of the hearing the Board shall, pursuant to a majority vote of all the members of the Board, file written findings of the fact that the exterior design, appearance and functional plan of such structure is or is not at a variance or so similar with the exterior design, appearance and functional plan of structures constructed or in the course of construction in the neighborhood of said proposed structures, which are in the same zoning district as the proposed structure, as to cause material depreciation generally to property in said neighborhood. The Board shall further make a recommendation that the application be accordingly granted or denied. Such finding, determination and recommendation shall be in writing, signed on behalf of the Building Board by its chairman and secretary. The ORDINANCE N0. 351 secretary shall file a copy thereof, certified by him, with the building inspector and the City Clerk and sha11 mail a copy thereof to the applicant. The application pap8rs, the written opinions, and the findings., determinations and recommendations of the Building Board shall thereupon be presented by the City Manager to the City Council at its next regular meeting. Further action with respect to the granting or-refusing of a permit with respect to such application shall be held in abeyance pending order and direction of the Council. In such case, no permit with respect to the application shall be issued except upon approval of the Building Board and order and direction of ' the City Council. 48.06 & 48.07, Npt changed by this ordinance, refer to City Code as published.
