AN ORDINANCE AMEHIIING ORDINANCE N0. 37k AND
ORDINANCE DEFINING NUISANCES PROHIBITING TE� IR
CREATION �R MAINTENANCE AND PROVIDING FOR
ABATEME;NT AND PENALTIES FOR VIOL6TION THEREOF.
The Council of the City of Fridley do ordain as follows:
SECTI08 I. 3ection 2 of Ordinanco Ha..374 ia hereby amended
to read as follpws:
1l.. All trees or portions of trees which by reasoa
oP their siae� age� condition or location,may endanger publie
life or safety� or the sa£ety of property� are hereby declared
to be a nuisance which should be ramoved and abated. IE there �:�: �: ��'��-°��='
is a danger that �11 or a substantial prot3on of such tree ot�
treea might fall on any pubiic alley, street or other public
property or any private property, such condition is also hereby
declsred to be sufPicient evidenc• that sueh tree or trese
constitute a nuisance. The City Manager or arboriat shall
include in the dangerous tree notification a deadline for the
removal of tree(s) or portion(s) of trees by the property ovner�
with aafety a basis for time allocat�d. In event the property
owner or tennant fails to remove the tree on or before the
deadlinel.date eat,�blished in the notification, the City Manager
shall cause the tree to be removed at City expenae and the costs
assessed againat the property owner or ormers as provided by the
City of Fridley Code or ordinancea and the Minnesota State
Statutea.
