Ordinance No. 0397 07-01-1968� ' ' �� NO. 397 AN ORDINANCE REGULATING AND CONTROLLING THE GROWTH OE WEEDS, GRASS, BRUSH AND OTHER RANK, POISONOUS OR HARMFUL V�GETATION IN THE CITY OF FRIDLEY, MINNESOTA The City Council of the City of Fridley does ordain as £ollc�as: SECTION 1. Cuttin4 and Removal of Grass, Weeds and Other Rank, Poisonous or Harmful Vegetation. It sYxall be unlawful for any owne' r,�%�see or occupant, or any agent, servant, representative or employee of any such owner, lessee or occupant having control of any occupied or unoccupied lot or land or any part thereof in the City of Fridley to permit or maintain on any lot or iand any growth of weeds, grass, brush or other rank vegetation to a greater height than ten (10) inches on the average, or any accumulation of dead weeds, grass or brush. It shall also be unlawful for any such person or persons to cause, suffer or allow poison ivy, ragweed or other poisonous plants, or plants detrimental to health to grow on any such lot or land in such manner that any part of such ivy, ragweed, or other poisonous or harm£ul weed shall extend upon, overhang or border any public place or allow to seed, pollen or other poisonous particles or emanations thereirom to be carried through the air into any public place. SECTION 2. Dutv of Owner, Lessee or Occupant. It shall be the duty of any owner, lessee or occupant of any lot or land to cut and remove or cause to be cut and removed all such weeds, grass, brush or other rank poisonous or harmful vegetation as often as may be necessary to comply with the provisions of Section 1; provided that cutting and removing such weeds, grass and vegetation at least once in every three weeks, between May 15 and September 15 shall be deemed to be a compliance with this ordinance. SECTION 3. When City to do Work. If the provision of the £oregoing sections are not complied with the City Weed Inspector or Police Department shall serve written notice upon the owner, lessee or occupant or any person having the care or control of any such iot or land to comply with the provisions of this ordinance. If the person upon whom the notice is served £ails, neglects or refuses to cut and recnove or to cause to be cut a£ter date of such notice, or if no person can be found in the City of Fridley who either is or claims to be the owner of such lot or land, or who either represents or claims to represent such owner, the City Weed Inspector sha11 cause such weeds, grass, brush and other vegetation on such lot or land to be cut and removed and the actual cost oi such cutting and removal, plus up to 25 percent for inspection and other additional costs in connection therewith, shall be certified by the City to the Anoka County and shall there- upon become and be a lien upon the property on which such weeds, grass, brush and other vegetation were located and shall be added to and become and form part of the taxes next to be assessed and levied upon such lot or land and sha11 bear interest at the same rate as taxes and shall be colLected and enforced by the same officer and in the same manner as taxes. Any person who shall neglect to cut and remove weeds, grass, brush or other vegetation as directed in this ordinance, or who shall fail, neglect or re£use to comply with the provisions of any notice herein provided or who shall violate any oz the provisions of this ordinance or who shall resist or obstruct City of Fridley employees or contractor engaged for weed and grass mowing or his employees in the cutting and removal of weeds, grass, brush. and other vegetation, shall, upon conviction thereo£, be subject to a fine of not more than $100.00 and each day on which such violation continues sha11 constitute a separate offense. SECTION 5. De£inition. The word "person" as used in this ordinance shall mean and include one or more persons of either sex, natural persons, corporations, partnerships, associations, joinc stock companies, societies and all other entities of any kind capable of being sued. SECTION 6. All ordinances or parts of ozdinances in conflict v.�itn tne provisions oi this ordinance are hereby repealed. SECTION 7. This ordinance sha11 take effect August 1, 1968.
