AN EMER(3ENCY ORDI
FOR COMMERCE PARK
NO. 398
FOR SAL3ITARY SEWER
The Council of the City of Fridley do ordain as follows: _
WHEREAS, Commerce Park is an industrially zoned plat within
the City of Fridley, and
WHEREAS, several new industries are in the process of con-
structing buildings in said plat; and
WHEREAS, the City of Fridley has previously proposed to pro-
vide sanitary sewer service through the North Suburban Sanitary
Sewer system; and
WHEREAS, a dispute arose as to the right of the City to connect
Commerce Park to the North Suburban Sanitary Sewer District line; and
WHEREAS, the District Cou:t, Tenth Judicial District, Anoka
County, Minnesota, has ordered the District to permit said con-
nection; and
WFiEREAS, said connection is needed immediately so as to servica
the above described industries; and
WHEREAS, the n¢�mal bidding procedure as provided in the City
Charter and Ordinances would require too much time to remedy the
emergency that exists.
N�^I THEREFORE, the City of Fridley does ordain:
l. An emergency exists as contemplated by Section 3.06 and
6.06 of the City Charter of the City of Fridley.
2. That the bidding requirements o£ Section 6.06 of the City
Charter are hereby waived because o£ the emergency; that the City
may proceed at once to contract tor:the sanitary sewer connection for
Commerce park Addition to the North Suburban Sanitary Sewer District
line at a price consistent with the construction costs normally
involved and for a sum not to exceed Five Thousand and no hundredths
($5,00.00) Dollars.
