ORDINANCE NO. 426
AN EMERGENCY ORDINANCE FOR THE MODIFICATION OF FLOOD DIKE
AND. REPAIR OF SEWERS
The Council of the City of Fridley do ordain as follows:
WHEREAS, the City of Fridley has previously constructed a
temporary dike for flood prevention purposes; and
WAEREAS, said dike was constzucted under emergency conditions
caused by high water in the Mississippi River;.and
WHEREAS, the City of Fridley desires to modi£y and improve so
as to zaise the grade of Rivezview Terzace and 79th Way and provide limited
flood protection dike to pro�ect a portion o£ the Riverview Heights
Addition; and
WHEREAS, the City of Fridley has received assurance from the
Office of Emergency Planning that a portion of the cost of said modi-
fication and improvement wi11 be paid for through federal funds; and
WHEREAS, certain portions of the Fridley sewer system were
damaged by high waters caused by the flood and are in need of immediate
repair; and
WHEREAS, the normal bidding procedure as provided in the
City Charter and City Ordinances would require too much time to ac-
complish i:he above necessary work.
NOW THERF'ORE, the City of Fridley does ordain:
.� 1. An emergency exists as contemplated by Section 3.06
and 6.06 of the City Charter of the City of Fridley.
2. That the bidding requirements of Section 6.D6 of the
City Charter are hereby waived because of the emergency; that the City
may proceed at once to contract for the repair and improvement of the
flood dike in Riverview Heights and for the repaix�of damaged.._sewer- �
lines at a price consistant with the construction costs normally in-
volved and for a sum not to exceed Twenty-Five Thousand and no hundredths
($25,000) Dollars. �
