Ordinance No. 0053 08-24-1953� r � • 1 . � CRDiNANCE N0.53 A M E N O M E N T OF THE ZJNING ORDINANCE OF THE VILLAGE OF FRID- LEY, NAMELV ORDINANCE NO. 24, BEING AN ORDIN- ANCE REGULATING THE LOCATIONS, S 1 Z E, U S E AND HEIGHT OF BUILD- I N G S, T H E ARRANGE- MENTS OF BUILDINGS ON LOTS, ANO THE DENSITY OF P�:PULATION IN THE VILLAGE OF FRIDLEY: AND FOR THE PURPOSE O F P R O M O T I N G T H E HEALTH, SAFETV, ORDER, CONVENIENCE, PROSPER- ITV AND GENERAL WEL- FARE OF THE SAID VIL- LAGE, AND FCR SAID PUR- POSE TO D I V I D E THE VILLAGE INTO DISTRICTS. The Council of the Village of F::dl�y Qo ord_iin as foltows: Section 1. For the purpose o[ this Ordinance, t h e 4 illage of P'ridley is divided into the follow- ing use distriCt: residential, com- mcrcial and industrial. Thc boun- daries oF these districts are de- lineated on the map entitled "Re- vised Zoning Map of Village of Fridley." 5aid Revised Zoning Map having been adopted by the Vlllage Council of the Village of Fridley on thc 121h day oP May, 7953, and pursuant to a public hearing held on the 4th day of May, 19�3. That said 'LO�ing Map. a copy of which is on file in the office of the Village Clerk, is here- ,by made a part af this Ordinance. Section 2. Amend Section 8 of Ordi�ance � No. 24 by deleting Ihe paragraph numbered 1 as fol- lows: "All uses permitted in resi- dence and open development dis- tricts." � Section 3. Amend the opening paragraph of SecUon 10 of Ordin- ance No. 24 as follo�vs: In the industrial districts, 6uildings and land may be used for any indus- trial and manufacturing enter- prise not pirohibited by law; pro- vided howeveq that none of the Collowing uses shall be established and operated in the industrial dis- tricts unless and until a special use permit, in each case, as pro- vided in this Ordinance shall have been first secured for such use, an� provided further that any appliCa- tion tor a 6uilding permit in an industrial zone shall be made in writi�g and refcrred and present- ed to 2he Zoning and Planning Commission for approcal befom a bui ding permit is issued. Section 4. Any application for a building permit for an improve- ment in an arca zoned as commer- cial sl�all be submitted in writing to the Village and shall bear the recommendation of the Planning Commission, ox• oI the Village Council, bcforc a building permit is issucd by the Building Inspec- tor. Section 5. That application for the issuance of a speeial use per- mit, or for any change in the Zon- ing Ordinance of this Village, or for the u'aivcr of any provision of this Ordinance, or the provisions of the Ordinance :Vo. 23, rclating to the Building Code, or to the Ordi- nance Ro. 39, rclating to the p1aY- ting of lands within the Village shall be made as fol]o�vs: aj .� written peUtion or applica- tion shall be filed with the office of the Village Clerk and directed to the Plan�ing and Zoning Com- mission and the Village Council of the Village of Fridley, that said application sha❑ fully describe the land involced, the nature of tUe request and any other infor- matia� that will clarify and ex- plain the nature and significance of the appliCation. b) That the Village Clerk shall prompHy refer such application to thc Planning and Zoning Com- mission. c) That the Planning and Zon- ing Commission ehall at its regular mon[hlp meefing, or at a specia] meeting called for that purpose, consider said application for peti- tion, and either recommend, or vote to not recommend, the appli- cation and petition. That its re- port shall be made in writing and transmitted to the Clerk of the Village for presentation to the Village Council at its next regular meeting. That if the Plaruting Commission deems it necessary that the matter be submitted to a public hearing, that that should be embraced within its recommenda- t:ion to the Village Council. ld Thc V411age Council �nay then approve .or disapprove the recommendation of the Zoning or Planning Commission. If the Vil- ]age Council determines that a public hearing is warranted and necessary, it may authorize the Village Clerk to�issue a public noLice setting the time and place for such a hearing and may give such nofice by posting three copies of the notice in three public places a�ithin the Village. One of the pinces oY public posting should be, if possible, in the vicinity of Yhe pruperty concerned. e) The Ylanning Commission mav recommend and the Village Coimcil may approve a special des- ignated wnditions, and require guarantecs in the granting of spe- cial use permits, or in the waiving ar amending of any of the require- ❑ienls of said Ordinance. fl That the Village Council and the members ot the Planning Com- mission at the public hearing shall publicly read the application and petition presented to them. That there shall be recorded the names and addresses of persons rising in favor of the application, and the names and addresses of those per- sons opposing the application or request. The Village Council wilI then determine whether or not the applicaUon or special use per- mit sought will, under all of the circumstances of the partieular case, be detrimental to the public welfare or injurious to the proper- ty or improvements in the neigh- 6orhood, and it may then act on the granting of the application. The Village Council shall have power in making its decisions to grant adjustments and exceptions in any and to any of the provisions of the said Ordinances, to the ex- tent of varying or modifying ffie s-trict application of any of the regulations or provisions contained � • i . . in said Ordinences where there are praMical difticvlties or unnec- essary hardships in the way of such striM applicatioq but to no greater extent Section 8.
