INMAN Y CLERK OF TNE CJTY OF FRIDLEY .s .. ,.f � .. 0 ORDINANCE N0. 738 AN ORDINANCE ESTABLISHING CHAPTER 217 OF FRIDLEY CI7Y CODE ENTI7LED "CONVERSION CONDOMINItfM" LICENSING 217.01. Purpose The Council of the City of Fridley deems that it is in the interest and promotion of the health, safety and general welfare of the residents of the City of Fridley that the owner(s) of a multiple dwelling intending to convert to condominium units, register the intent with the City before such a conversion is initiated. 217.02. Definitions For the purposes of this chapter, except where the context indicates otherwise, the following words mean: 1. Condominium: A multiple dwelling in which portions are desic,�ated for separate ownership and the remainder of which is design ated for common ownership solely by the owners of these portions. A multiple dwelling is not a condominium unless the undivided intere sts in the common elements are vested in the unit owners. 2. Conversion Condominium: A multiple dwelling which has been converted f rom rental units to ownership units in accordance with the Uniform Condominium Act (CH. 582 - 1980 session). 3. Dwelling Unit: A single unit providing complete indepenaEnt living f acilities for one or more persons including permanent provisions f or living, sleeping, eating, cooking and sanitation. 4. Multiple Dwelling: Any building or structure containing therein two or more dwelling units whether used solely or exclusively for residential purposes. 5. Owner: The person or body having an interest in a multiple dwelling as a fee owner or subordinate interest with the right to exercise control and management of the premises. 217.03. Registration At least 60 aays prior to the conversion notice given to the tenants, the owner of a multiple dwelling in the City of Fridley shal l f i le with the Ci ty a cert if icate of registration on a form provided by the City. At that time, the owner shall also file therewith an application for license from the City and pay the license fee. .� 217.03 PURPOSE u�F ii�i�? IQ":� REGISTRATION Page 2-- ORDINANCE N0. 738 217.04. Certificate of Registration, License, and Fees A certificate of registration shall be required of any owner of a multiple dwelling located within the City of Fridley who intends to convert such a building to condominiums. The li�ense fee shall be provided in Ch apter 11 of this code. This section does not exempt an owners association from obtaining the annual multiple dwelling � license as set f orth in Chapter 220 of the Fridley City Code. 217.05. Application Certificate of registration and appl ication for a conversion conaominium license shall contain the following information: 1. Oescription of ground are a by street number and legal description. 2. 5ize of the building. 3. Number of stories and height in feet/meters. 4. Total floor area of the building. 5. Floor plans of proposed modification s. 6. Number of dwelling units in the condominium. 7. Total area provided on premises for off street parking. 8. A certification by the owner that the building is not in violation of the provisions as set forth in Ch apter 220 of the Fridley City Code. 9. The name and address of the individual to which any notice or order respecting the premises may be served or given during the conversion. 217.06. Condition of Denial The City may adopt an ordinance to deny a conversion condominium license if there exists within the City a significant shortage of suitable rental dwellings available to low and moderate income individuals or families or to establish or maintain the City's eligibility for any federal or state program providing direct or indirect financial assistance for housing to the City.
