Ordinance No. 0741 10-19-1981� ORDINANCE ND. 741 - 1981 AN ORDINANCE REPEALING CHAPTER 506 OF THE FRIDLEY CITY CODE IN ITS ENTIRETY AND ADOPTIhG A NEW CHAPTER 506 ENTITLED "VEHICLE PPRKING" The C�ty Council of the City of Fridley does oraain as foilows 506.01. STATE LAW COMPLIANCE No person shall drive, operate or be in actual physical control of any vehtcle contrary to state law; nor shall any owner or person having custooy or control of any veh�cle knowingly allow any other person to drtve, operate or be in actual physicai control of a vehicle contrary to state law. As used in this ordinance, the term "commercial veh�cle" means and includes a"truck" as aefined �n Minnesota 5tatutes 5ection 168.011 Subdivsion 10, a"tractor" as defined in Minnesota Statutes Section 168.011 Suboivision 11, a°truck tractor" as defined in M�nnesota 5tatutes Section 168.011 subdivision 12, a "trailer" as defined in Minnesota Statutes Section 168.011 Subdivision 13, a"semi-tra�ler" as defineG in Minnesota Statutes 5ection 168.011 Subdivision 14, and a"bus" as defined in M�nnesota Statutes Section 168.011 Subdivision 9. As used in this ordir�ance, the term "resiaential d�strict" means and includes those areas zoned single fam�ly dwelling areas, two fam�ly dwelling areas, and general multiple family dwelling areas. (Ref. 552) 50E.02. OFF PAVEMENT No person shall stop, leave stanatng or park a vehicle whether attended or unattended, upon the paved or improvea or main traveled portion of a higliway or street when it ts practical to stop, park or leave such vehicle off such portion of sa�a highway or street. In every such event, a clear and unobstructed width of at least fifteen feet (15 feet) of such h�ghway or street opposite such stand�ng vehicle shall be left for the free passage of other vehicles. 506.03. UNATTENDED VEHICLES No person shall stop, park or leave a vehtcle unattended upon such street or highway in the City for a period in excess of 24 hours. 506.04. SNOW REMOVAL - VIOLATION AND TOWING During the winter months, commencing on the first day of November of any year, to and including the first day of May of the following year, it shall be a violation for any person to stop, park, or leave stanaing a vehicle on any street or h�ghway in such a mar�ner as to impede the plowing and/or removal of any snow, ice or waste on such street or highway. Whenever it shall be found necessary to tl�e prcper direction control, or regulation of traffic or for the plow�ng ana/or the removal of snow, ice or waste, maintenance or improvement of any highway or street to remove any vehicle standing on a highway or street in the C�ty, then any pol�ce officer is authorized to provioe for the removal of such vehicle and have the same removed to the nearest convenient garaye or other place of safety. Any vehicle stopped, parked or left standing on any highway or street in violation of law and removed as providea herein above, may be removed upon order of a police offtcer and the cost of removal and storage of the same charged to the owner of the vehicle, as well as the person caus�ng such violation. �Ref. 583) S7ATE LAW COMPLIAhCE OFF PAVEMEhT UNATTENDED VEHICLES SNOW REMOVAL VIOLATION AND TOWING .1 w �e � :.� v� v Page 2-- Oroinance No. 741 _ 198� 506.05. SCHOOLS Whenever any public school lands or the lands and areas of any public goverm ng body or authority customar�ly or usually open to traffic by the publ�c shall be posted by order of the school i�oard or other goverm ng body or authority in control of such lands, then it shall be unlah�ful to drive or operate or stop, leave stanoing and park any vehicle on such lanos contrary to such posting. 506.06. OBEDIEfdCE TO MARKINGS No person shall park or stand a vehicle other than at the curb or edge of the roadway or with�n designated spaces on those streets which have been signed or marked for parking by the City Manager or desgnee. 2. Whe� official signs proh�biting parking are erected as autnorized heretn no person shall park a vehicle upon any such street in violat-�on of any such sign. SC HOOLS OBEDIENCE TO MARKINGS 3. In the event a highway �ncludes two or more separate roadways anc traffic is restr�cted to cne direction upon any such roadway, no person shall stand or park a vehicle upon the left-hand siae of such one-way roaaway unless signs are erectea to pennit such standing or parking. 506.07. STOPPING AND STANDING PROHIBITED STOPPING AND STANDING No person shall stop, stana or park a vehicle, except when PROHIBITE� necessary to avoid conflict o��th other traffic or ir compliance w�th law or the directions of a Police Officer or traffic-control device, in any of the following places: On a sidewalk; 2. In front of a public or private driveway or airectly a�ross therefrom in such a manner as to impede the access to said driveway; 3. W�thin an intersection, 4. Within 10 feet of a fire hydrant. 5. On a crosswalk; 6. W�thin 20 feet of a crosswalk at an intersection or w�thin 20 feet of a mia-block crosswalk properly marked; 7. With�n 30 feet upon the approaching side of any flashing beacon, stop sign or traffic-control s�gnal locateo at the side of a roaaway, S. Between a safety zone and the ad�acent curb or within 30 feet of points on the curb immediately opposite the ends of a safety zone, unless the Ctty has indicated a different length by s�gns or markings; 9. W�thin 50 feet of the nearest rail of a railroad crossing; 10. Within 20 feet of the driveway entrance to any fire station and on the side of a street opposite the entrance to any fire station or within 75 feet of said entrance when properly posted: 11. On a roadway siae of any vehicie stopped or parked at the euge or curb of a street; 13. Upon any br�dge or other elevated structure upon a highway or witM n a htghway tunnel or underpass; 14. At any place where official signs prohibit stopping, 15. On any boulevards; 16. In areas reserved for the handicapped; (Cross Ref. ChaptEr 511.03) 17. fire Lanes 506.08. ALLEYS (Cross Ref. Chapter 108.06) No person shall park a vehicle within an alley in such a or under such conditions as to leave available less than feet of the width of the roadway for the free movement of vehicular traffic and no person shall stop, stand or park vehicle within an alley in such posit�ori as to block the driveway entrance to any abutttng property. 506.05. FOR SALE OR WASHIN6 No person shall park a vehicle upon any roadway for the principal purpose of: 1. Displaying such vehicle for sale; manner 10 r.i 2. Washing, greasing or repairing such vehicle except repairs necessitated by an emergency. 506.10. �'ARROW STREETS The City Manager or des�gnee is here6y authorized to erect signs ind�cating no parking upon any street when the width of the roadway does r�ot exceed 20 feet or upun one side of a street as �ndicated by such signs when the w�dth of the roadway does nat exceed 30 feet. 506.11. CONGESTEO PLACES The City Manager or des�gnee is hereby authorized to oetermine and designate by proper signs places in which the stopping, standing or parking of vehicles would create an espec�ally hazartlous condition or woulo cause unusual delay to traffic. When official s�gns are erected at hazaraous or congested places as authorizea here�n, no person shall stop, stana or park a vehicle in any such aesignated place. 5D6.12. PARKING IN RESIUENTIAL DISTRICTS No person shall park or leave standing a truck tractor, semi-trailer, bus, mobile home, house trailer, or truck having a licensed gross weight over 12,000 pounus, whether attended or unattended, upon the pu6lic streets in any residential district unless in the process of loading or unloadiny and then only for such per�od of t�me necessary to load or unluad. ILLEGAL PPF2KING 741 - 1581 In any prosecution charging a violation of any law or regulation governing the standing or parking of a vehicle, proof that the part7cular vehicle aescribed in the complaint was parked �n violation of any such law or regulation together with proof that the defendant named in the complaint was at the time of such parking the registered owner of such vehicle shall constitute in evidence a prima facie presumption that the registeretl owner of such vehicle was the person who parkea or placed such vehicle at the point where and for the ttme dur�ng which such violat�on occurred. 506.14. PENALTIES Any violation of th�s chapter is all penalttes prov�ded for such of Chapter 501 of this Code. 506.15 REPEAL a misoemeanor and is sub,7ect to violations unaer the provis�ons Chapter 5D6 is hereby repealed and replaced by a new Chapter 506 ent�tled "Uehicle Parking."
