Ordinance No. 0796 01-09-1984�I � � ORDINANCE NO. 796 AN ORDINANCE RE(70DIFYING `1HE FRIDLEY CITY CODE BY ADOPTING A NEW CHAPTER 121, ENTITLED "INTOXICATING LIQUOI�aDNSqJMPrION� USE OR DISPLAY" THE CITY COUNCIL OF THE CITY OF FRIDLEY DOES ORDA]SI AS FOLLG[^TS: 121.01 DEFINITIONS The follaaing definitions shall apply in the interpretation and application of this Ordinance and the following words and terr�s, wherever they occur in this Ordinance, are defined as follaws: 1. Cons�snption, use or display. Any drinking, cons�nning, exhibiting, shaaing, imbibing, or having in one's possession or control. 2. Intoxicating Liquor. Ethyl alcohol, distilled, fermented, spirituous, vinous and malt beverage containing in excess of 3.2 percent (3.2o) of alcohol by weight. 3. Non-intoxicating Malt Liquor. Any malt liquor containing not less than one-Y:alf of one percent (.5�) alcohol by volLUne nor more than 3.2 percer�t (3.20) alcohol by weight and which is a fermented malt bevexage. 4. Parking Area. Any area or s�ce used for the �rking of vehicles. 5. Public Place. Any place, other than a private home, where two (2) or more persons or groups of persons or the public congregate or frequent, and shall include, but not be limited to, clubs, taverns, beer stores, drug stores, restaurants and hotels. 121.02 PRGHIBITED USE OR CONS[JMFrPION 1. No person shall consume or use intoxicating liquor or non-intoxicating malt liquor in any �rking area connectec3 with or a part of the land area of the premises which has been issued an intoxicating liquor license, wine license or a license to sell non-intoxicating malt liqaor, under Chapter(s} 602 or 603 cf the Fridley City Code, includi.ng any �rking area connected with or a part of the land area of the prenises of any private bottle club, fxatexnal organization oz other private club, def u-ied in Chaptex 6Q5 of the Fridley City Code, located within the City of Fridley. 2. DIo person shall carry any open receptacle, including a glass, bottle or other device used for the consumption of intoxicating liquor or non-intoxicating malt liquor, from the licensed pranises. 3. No person shall consume or use intoxicating liquor or non-intoxicating malt liquor in any p�rking area connected with or a p3rt of the land area of the prenises of any other public place or ��'t„ i2i.oz DEFINITIONS PROHIBITID USE OR CONSUMPTION 121-1 ' private conu��ercial or industrial 6usiness establishment located within the City of Fridley. This prohibition shall include parking areas connected with schools or any other institution of training or education. 121.03 CONS[TMFPIOI�I OR USE PERMITS The t�nporary constunption, use or display of intoxicating liquor or non-intoxicating malt liquor shall not be prohibited in locations or areas specifically set £orth in a use or consumption permit issued by the Public Safety Director. Permits shall specify the conditions under which they are issued and valid. Permits may be revoxea by the Public Safety Director when, in the Director's opinion, there is a public safety c3anger or infringement of peace and tranquility. Denied and revoked pexmits m«y be appealed to the Fridley City Council. 121.04 PENi�LTIE,S Any violation of this Ordinance is a misdemeanor and sub�ect to all penalties provided for such violations under the provisions of Chapter 901 of this Code. 121.D5 SEVERABILITY � �ery section, provision or part of this Ordinance is aeclared separable from every other section, provision or �rt to the extent that if any section, provision, or �rt of this drdinance shall be held invalid, such holding shall not invalidate any other section, provision or part hereof.
