M�� �i � �1 �M �� �� : �.� � \� +�a. •, ; �y t • ��l MY �� . � �. • a:�� � Mt � �.� : 1- �t : �,� Mr. Jim Hill, Public Safety Director, stated this ordinance is being proposed upon the reoommendation of the Assistant City Attorney and the O�unty Attorney's Offioe in order to simplify the public nuisanoe abatement provess. He stated the current 1905 statute is extremely difficult and almost impossible to er�orae. Mr. Hill stated the �xoposed ordinance pravides that upon oonviction of three prostitution arrests over a period of three years,, it would be cbnclusive evidenoe as to the existenoe af a public nuisance as it relates to a house o� prostitution. He stated it is hoped this ordinance would greatly reduoe the time and oosts to the City to oorrect a situation that is currently existing in the City. Mr. Hill stated they wished to review the ordinance further to refine it before the second reading. He stated the ordinanoe was originally drafted by the Hennepin �unty Attorney' s off ioe. �� O�uncilman Schneider asked if the ordinance isn't adopted, what is the prooess which must be follawed. Mr. Hill stated underoover affioers would have to be aoquired to o�ritinually make arrests and hope the �unty Attorney' s of f ice would pur sue a publ ic nuisanoe abatenent. Tt�e 16 foot alley and the balance of G�aood Street south of Lot 11, Blk 6, Onaway All lying in the south half of Section 3, �30, R-24, City of Fridley, County of Anoka, Minnesota Be and is hereby vacated except that the City of Fridley retains (1) an easeqnent for utility purposes on the 12 foot alley and (2) an easeqnent for utility purposes on the west 30 feet of Gumwood Street.
