Ordinance No. 0882 05-04-1987� ORDINANCE NO 882 AN ORDINANGE R�CODIFYING THE FRIDLEY CITY CODL, CIIe1PTEK 603, ENTITLED "INTOXICATING LIQUOR" BY AAiEApDING SECTIOY�➢� 603.10.7, ADDING SECTIOIlV 603.24 AAVD RENiDMBLRIAVG CONSECUTIVELY, AND F[7RTHER AMENDING CHAPTER 11, L.IVTITLED "GENERAL PRDVISIONS AND FE�S" SEC'LION ll 10 The City Council of the City of Fridley does hereby ordain as follows 603,10 CONDITIONS OF LICENSE 7 No licensee shall keep, possess, operate or permit the keeping, possession, or operation of any slot machine, dice, or gamUling device or apparatus on the licensed premises, and the l�censee shall not permit any gambling therein, whether or not licensed 6y the state, except that pull-tabs may be sold on licensed premises when such activity is licensed Uy the state pursuant to MinnesoCa Statute, Chapter 349, and conducted pursuant to the regulations contained in this city code (Ref 882) 603.24 GAMBLING ENDORSEMENT l, Statement of policy On-sale licensees may request permission of the City Council to pennit � qualified charitable organizations to conduct lawful gambling in the form of pull-tabs only on the licensed premises Application for a gamUling endorsement shall be made to the City C1erk with payment of the specified fee in Chapter 11 of the City Code 2 Regulations Gambling endorsements on on-sale licenses shall be sub�ect Lo the following regulations which shall be deemed as a part of the license, and fallure of compliance may constitute grounds fox' adverse action as prescribed in the City Code A Only licensed charitable non-profrt organizations which contribute the ma�ority of pull-tab proceeds for lawful purposes within the City of Fridley may be allowed to se11 pull-tabs on the premises B Use of the licensed premises sha11 be by means of a written lease agreement between the licensea and the charitable oiganization Tl�e lease shall be for a term of at least one year, a copy sha11 be filed with the City Clerk, and also a copy must be kept on the premises and availat�le for puUlic inspection upon request Leases shall be governed by the follocaing (1) Maximum rent that may be charged is $100 00 per �veek (2) Rental payments may not be based on a percentage of profits from gambling (3) The charitable organization may not reimUurse the licensee for any � license fees or other gambling related expenses incurred Uy the license2 (4) The only form of gamlaling that sha11 Ue permitted on the licensed pYemises shall Ue pu11-tabs approved by the state � � Page 2-- Ordinance No 882 (5) Pull-tabs shall only be sold from a booth used solely by the charitable organization, and pull-tabs sha11 neirher be sold hy employees of the licensee or sold from the bar service area (6) The construction and maintenance of the booth used by the charitable organization shall be the sole responsihility of the charitablc organization (7) The leasee shall contain a provision permitting the licensee to terminate the lease if the charitable organization is found gullty of any violation of state or local gambling statutes, ordinances or rules and regulations C Only one charitable organization shall be permitted to se11 pull-tabs on the licensed premises D The licensee may not be reimbursed by the charitaUle organization for any license or permit fees, and the only compensation which the licensee may obtain from the charitable organization is the rent fzxed in the lease agreement E The licensee must commit to a minimum of 20 hours of sales of pull-tabs for the chariCable organLZation per week F.
