It is the duty of the Forester to coozclinate under the direction and control of the City Manager all activities o£ the City relating to the control arxl prevention of tree diseases. The Forester shall recommend to the City Manager the details of the program for the control of tree diseases arxi per£orm the duties inoident to such a program adopted by the City Council. �• �� • �o. �aW �•�� 4. Any dead Oak tree, or paYt thereof, includuxg logs, branches, stwnps, firewood, or other oak material which has not been del�arked or free of hazard as detennined bv the Forester. 5. Any diseased tree, dead tree, or part thereof, including logs, branches, st�mips, firewood, or other wooclen material which has beexi detenninecl to present a condition which endangers the safety or health of the public and has not been treated ac�on�ing to the prescription of the City Forester. 1D4.06. INVIIIIL7RY, INSPFXTI�7 AND IlAVESi�GATION 1. The Forester or agent thereof may inspect all premises and places within the City as often as deemed appropriate to determine whether any condition described in either Section 104.04 or 104.05 of this Chapter exists thereon. The Forester shall investigate all reported incidents of diseased trees. �• �: •�,�«�� •s. �• •a ,• . � a �� ���a. •� •��. 1. If the infected tree is located on private property, the Forester shall send a written notification and prescription to the owner of said property. It shall be the obligation of the property owner to cai�y out the prescribc�cl abatement procedure(s) within thirty (30) days £rom the date of receipt of the notification unless a written variance is granted by the Forester. If the owner requests the City or fails to follow the prescription within the designated time period, the Forester shall notify the propexty owner by mail that the City will contract for the abatement of the public nuisance, namely the diseased or dead tree and/or wood in question. The Forester shall then proceed to contract for the prescrit�ed abatement procedures as soon as possible and shall report to the City Clerk all rhames resulting from the abat�snent procedures r_.arried out on such private property. The City Clerk shall list all such chan7es along with a City Acfiiinistrative cost against each separate lot or parcel by September 15 of each year as special assessments to be collected co�nencing with the following year�s taxes. Achltinistrative costs of $25.00 for each lot of parcel shall be added to each assessment. ,� Page 2- Ordinance No. 931 2. In the case of baulevazd trees, defined as a tree growing within a street rightrof-way or a street easement that k�s been acquired for an exist9ng street, notices will be mailed to the owner of the abutting property as previously descrii�ed in Section 104.08.01. However, the City shall abate any diseased boulevaxd tree at no cost to the pmperty owner. If the property owner desires, the City will replace the tree with a bare root selection on the owners property in the vici_nity of the remwed tree. _�� �• 3b�r_..0 ;�.��.;�,.
