IT IS HII2fBY RESOLVED by the Board of Commissioners (the "Board") of the Housing and RedeveloFxnnent Authority in and for the City of Fnc7ley, Minnesota (the "HRA"), as f011ows: 1. Recitals and Findings. A. The HRA has heretofore established its RedeveloXanent Project No. 1 and has adopted a redevelopnent plan therefor (the "Redevelognent Plan"). The ob7ectives of the Redevelopment Plan include the promotion of new developnent, the rEVitalization and redevelognent of existing developnent, and the providing of assistance by the HRA toward the realization of such ob7ectives. B. The property knaan as the Union 76 Service Station is located within Redevelognent Pro7ect No. 1 and legally described as follc�as: ' That part of the N 135 ft. of Lot 1, Auditor's Sub. No. 25 lying southerly of Hackman Ave., lying easterly of the easterly line of Trunk Hiykiway 65 and Central Avenue, and lying westerly of a lir.e prll/w and 130 ft. westerly of (as measured along N line of saicl Lot 1) westerly lirie of Block 2, Seacter Add. sub�. to easement of record. C. The intersection of Highway 65, West Moore Lake Road and Old Central is conjested and in need of additional right-of-way along the Um on 76 Station property to better facilitate the realignment of Hillwind Road associated with the intersection improv�nents to Highway 65, West Moore Lake Road and Old Central. Aoquisition of said right-of-way property is necessary in order to meet the goals of �mproving the flow of traffic in this area. D. The Bc�rc3 hereby fin� that the acquisition of the above mentioned right-of-way property by the HRA, whether by negotiation or pursuant to the exercise of the Authority's power of eninent domain, is and would be in the public interest pursuant to the goals of the HRA's Modified Redevelopnent Plan for its Redevelopment Pro�ect No. 1, and the Board hereby authorizes the offioers and agents of the HRA, at the direction of the Executive Director, to commence imn�ediately such efforts as may be necessaxy, including private negotiation, the institution of eminent domain proceedings, to aoquire said property. BE IT RFSOLVED that the City Attorney is specifically authorized to notify the ' aanzrs of intes�t to take possession pursuant to Minnesota Statutes, Section 117.042. The City Attorney is further anthorized to take all actions necessary and desirable to carry out the purposes of this resolution.
