HRA RES 2008-03 - 14513HRA RESOLUTION NO. 20�8-03 RESOLUTION APPROVING APPRAISAL OF CERTAIN PROPERTY TO BE ACQUIRED BY THE HOUSING AND REDEVELOPMENT AUTHORITY AND AUTHORiZING QiJICK-TAKE DEPOSIT BE IT RESOLVED by the Housing and Redevelopment Authority in and for the City o� Fridley, Minnesota (the "HRA"), as follows: Section 1. Recitals. 1.01 The HRA has adopted its Resolution No. 2008-a1 0� Janu�ary 10, a true and correci co�y of which is attached hereto as Exhibit A, and incorporated herein by reference. 1.02 In its Resolution No. 2008-01, the HRA found that acquisition of the property identified in Exhibit B, attached hereto and �ncorporaied herein by reference, for the establishment of a Fridley cornmuter rail station and related facilities will serve a public purpose and furtl�er the goais and ohjectives of the HRA. 1.03 In iis Resolution No. 2008-01, the HRA authorized the acquisiiion of the property identified in Exhibit B for public use by negotiation or by err�inent domain under Minn. Stat. § 117.01 et seq. i.04 The acquisition authorized in Resolution No. 2008-01 is done in conjunction with the State of Minnesota, by and through its Department of Transpartatian, the Anoka Co�ty Regional Railroad Authority, and Burlington Northern Santa Fe Railway Company. 1.05 Pursuant to Min�. Stat. § 117.036 and in conjunction with its proposed acquisitian of the praperty, the HRA obtained an appraisal, which is attached hereta as Exhibit C and incorporated herein by reference. 1.06 I� order to timely commence cons3:ruction on the Fridley commuter rai� station and related facilities, i�.cl�ding an underpass tunnel, the HRA also autharized acquisition by the "quzck tal�e" process provided for in Minn. Stat. � 117.042. Minn. Stat. � 117.042 provides for a depasit of the amount of an approved appraisal with �tie Court Administraior at same tirne subsequent to 90 days from the service of notice of intent to take possession. Section 2. Findin�s. 2.01 The Recitals in Section 1 are hereby adopted as Findings; moreover, 2.02 The appraisal attached as E�ibit C describes the market value of the property ideniified in Exhibit B and is certified to be in accordax�ce with the appraisal requiremer�ts of the Uniform Standards of Prafessional Appraisal Practice and the Minnesota Departrnent of Transportation, and governing appraisal ethzcs and siandards; 2.03 The appraisal amount of $3,1 b5,000.00 represents market value of the property as of January 17, 2008. Page 2 3.0 f Pursuant to the above findings, the HR.A does hereby approve the appraisal attached hereto as Exhibit C, and directs its staff to facilitate the deposit of the appraisal amount of $3,165,000.00 with the Anoka County Court Administrator on or after Apri130, 2008. Adopted by the HRA this 6th day af March, 2008.
