EXCERPT OF TI� REGULAR COUNCIL I�ETING MINUTES OF MAY 16, 1966 � ING COMMISSION ME' 12. 1966: 6-02) - , .. 5 The City Manager read the motion of the Planning Commission to recommend that this specific plan for rezoning be denied and the Public Hearing closed. The City Manager explained that the Planning Commission was not shutting the door for rezoning, but they felt that a more specialized ordinance they are working on should be in effect first. If the Council concurs with the Planaing Commission, Mr. Skjervold could reques� another Public Hearing. Mr. Skjervold, xepresen�ing Eirgny R3.ede1, was present at the Cauncil Meeting. He s����d th�.t he had suggested to the Planning Couunission Xh,at it would be a11 right �atth the Riedela to leave a strip 125' wide to act as a bugfer, and theq would also be agreeable to anything �he Council wanted. He said that at one � ti.me he had written the City Attorney Wyman Smith about the storm sewer drainage on the Riedel property as he thought it was illegal, but they agreed to hold in a'���y°ar�c� Ue�ause of Urban Renewal possibilities at that time. He stated that they would be agreeable to give some of this land to the City if this would make it possible for the City to control the development. He stated that the Planning Conanission had held a meeting on April 28th at which he had not been present, but from the minutes of the meeting lie gathered there was no one in opposition and he thought the request would be approved, and then it was denied. He said the property, as it is, is b.y no means a credit to the City as they are not receiving the taxes they would if it were developed, nor is it a credit to the people next door, but it could be a benefit if it were rezoned and used uader the control of the Council. He said if the problem is that the City has no ordinance, should the Riedels have to wait year aftex year, someone has to take the r� first step, and if the only thing is the method, the Riedels are Nilling.to agrea to any covenants or even agree to give laad. � _ . Ci EXGERPT OF Ti3E REGULAR COUNCIL MEEZZNG MINUTES OF MAY 16, 1966 pAGE 2 Councilman Wright said that Mr. SkjervoZd has�given an actual sum�►ary, except for one exception. In part it is the ordinance, but also because of neceasary engineering for sewer drainage. The Council has three choices of the way to take care of the drainage problem, and one of the ways may require a partisl ponding, and another of the three might take as much.as four acres of the 15 acres in the south. He suggested perhaps there could be a narrower strip as a planting area, and a larger area in the s.outh for a park area with pond. Mr. Skjervold said he was sure the Riedels would seriously consider this. Councilman Wright stated he felt that it is important to get the engineering advice to the Planning Cocmnission and hold a meeting to consider this. The City Manager asked the City Attorney if the City were a property owner, cou�.d restrictive protective covenant8 be enforced, and the City Attorney said yes. �Councilman Wright said that there , � would be two things to work out with the Engineer and the Riedels, an area suitable for ponding and protective zoning without a new ordinance. �ouncilman Samuelson said he thought the City needs a new ordinance and the Citq Manager said that the Planning Commission was working on it, and they will diacuss i:� on the 26th of � May. Councilman Wright said that the City Attorney says he could help speed up the process with the Planning Caaanission so they could get it to the Council in reasonable form rapidly. He said that assuming there was an appropriate ordinance, a Public Hearing could be called at the earliest for June 6th, or a more normal date of June 13th, and the City Attn rney said this would be fine. The Council discussed whether a Public Hearing date should be called. The City Manager suggested the Council give the Planning Commission a little tim�e, he was sure � - they would pusYr as hard as they can. Councilman Sheridan suggested that Mr. Skjervold and the Engineer go over it with the Pianning Coamission May 26th, � and at the same time the Council can be talkiag about the three choices for storm sewer drainage. Seconded by Councilman Harris. Upon a voice vote, there being no nays, Mayor Kirkham declared the m otion carried. The City M,anager asked Mr. Skjervold if he was in a position to say how the problem with the sewer and water services are to be handled before Mississippi Street �s paved, as they are inadequate to the property at the present time if it were to be coumiercial. The Attorney said that he did not kaaw, if he knew haw the property was to be utilized, he would have no problems.
