the minutes of the Board of Appeals of December 4, 1968. Upan a voice vote,

1. COTITII�iUED PUBLIC HEARING : APPROVE PRELIIrQNARY PLANS FOR PD DEVELOPI�NT
(ZOA �68-10 and �68-10A) HOWARD D[A�HY:
Mr. Howard Dumphy was present and stated he had received a letter from
the City Attorney, but he had not had time to evaluate it, and until then,
he would like to table his PD rezoning request. He was not certain his plan
now was economically feasible or if he should choose to abandon the whole
project.
Chairman Erickson asked if he could read the letter to the audience which
the City Attorney had mailed to Mr. Dumphy. The attorney's letter, dated
December 4th, answered the Planning Co�ission's request for an opinion of the
present status of�Mr. Dumphy's rezoning request.
A citizea asked how loag the PD rezoning, if granted, would continue once
it ie approved but not developed. He was informed it was a perpetual zoaing,
the same as if a piece of land were rezoned R-1.
I�OTION by Mittelstadt, seconded by Myhra, that the Plaimiag Comnission
close the public hearing of ZOA �68-10 aad #68-10A, appraving preliminary
plans for the PD area of Howard Dumphy- Upon a voice vote, all voting aye,
the motion carried unanimously.

A citizen asked if anyone who contiaually came to the Plaiming Co�ission
^ meetings sud signed in, would be notified of the meetings. The public meetings
would be published in the Fridley Sun and the notices also would be mailed to
the adjacent property awnera.
Mr. Dumphy said about three years of good work has gone into this PD plan.
Basically, the plan developed here is apparently a good job and he could see
no real objection. It is a good area for this type of development. He felt
the objections could be avercome and worked out with the people.

table iadefinitely until another public hearing would be called for approval
of a plan by Haward Dumphy, for the PD rezoning (ZOA �68-10�aad #68-10A).

Mr. Clarence D. Nordstrom and Mr. A. T. Hamnerlund were present.
Mr. Nordstrom asked to present his proposed plan which they hope to call
Rice Creek Park. The property is on County Road H, North of Rice Creek and
abutting Stinsoa Boulevard on the East composing 29 2/3 acres. About 14
acres are not true buildable sites and this they will either deed to the City
of Fridley for the sum of $1.00 for park or will use it for a private park.
Mr. Nordstrom said he would like the Planning Co�nission to look over the
^ plans, and would not expect a decision, and then they will make an application
for rezoning. The Planning Commission thought the plan was of one use, there-
fore his petition for rezoniug should be for �ltiple dwellings.
Mr. Nordstrom left one set of plans with D�rrel Clark and made arrangements
with him to begin processiag the rezoniag.

Mr. Edmund Contoski, Mr. Robert Engstrom and Mr. James Aill represented
Pemtom, Inc.
Mr. Engstrom asked if tiiey were in the same categorq as Mr. Nordstram as.
they had wished to present their proposed plan for the dewelopment of the SE�
of Section 24 and get the reaction oE the Planaing Coumission. A discussion
follawed concerning the traffic pattern through the area using Silver Lake Road
for the main collector street. Mr. Engstrom said he understood another request
for PD was requested aad asked the opinion of the people to tha West. Zheir
proposed plan calls for single family residences abutting the houses on Regis
Trail. As part of this plaa would go over into New Brighton, the City &igiaeer
asked if they knew if there was a possibility of uaiag so�e of the facilities
of New Brightoa for sewer. _
There was no actioa, but the petitioners were goiag to study the PD Ordinance
aad return with aa application.

The Chaizzuan recalled the Planaiag Conomisaion, on Octobar 10, 1968,
recommended to Council approval of the lot split �ubject to a buildiag permit
for only one housa until the land is rezoned to �t-1, and Couacil concurred
at their October 21st meetiag. An application for rezoning waa a�nt to Mr.
Wilson, but he has not returned it. A buildes talked with the Bngia�ering
Asaistaat and it was explaiaed to him that the laad has to be rezoned to
single family dwellings before he could build on the tvo lots. To date no
permit has been taken out for a house.
No action.
5. HYD� PARK ADDITION REZONING ST[TDY:
The Chairman explained that Mr. Chapman of Nason, Wehsmaa, Knight �
Chapman, Inc. would be unable to be present at a public meeting on January 9,
1968.

accept the notice of the informal public hearing prepared by the Bngineering
Depar�ment for Wednesday, January 8, 1968 with amendments aa indicated. Upon
a voice vote, all votiag aye, the motion carried unanimously.
The Chairman requested the recording secretary to send the lett�rs to the
people of Hyde Park Addition on December 24, 1968, and that meation of the
^ meeting be made in the Jatruary 2nd issue of the Fridley Sun.

The Commission considered in detail the correction� indicated at the last
meeting of Decembe�� Sth, correcting their awa working.copies (this m�etiag
making the eighth session of study).

Meeting was called to order by Chairman Fitzpatrick at 7:37 P.M.

MINUTES OF REGULAR MEETING OF NOVEMBER 25, 1968
Uhder the heading SPRING LAKE PROPERTY, Line 1 of the Motion, the word "direct"
should be changed to "request".
Under the heading LOCKE PARK ACCESS ROAD FROM EAST, Line 1 of the Motion, the
word "directing" should be changed to "requesting".
Under the heading SUIrflrIER OLYMPICS PROGRAM, Line 4, the word "swimming" should
b� changed to "softball".
MOTION by Dunphy, seconded by Stimmler, that the Minutes of the Regular
Meeting of November 25, 1968 be accepted as amended. The Motion Carried.
WELL SITES
In the Minutes of November 25, 1968, a list of five sites were offered to the
^ Engineering Department for future consideration in the locating of City water
wells. Vice Chairman Dunphy suggested the possibility of Craig Park for a
well site. The water lines are of sufficient size and a dual purpose building
would be an asset to the Park. The Commission agreed to bring this to the
attention of the Council and Administration.
COUNTY COIrA�tISSIONER - HARVEY PETERSON
Mr. Harvey Peterson, County Commissioner, presented a copy on a study of the
County �arks raade by Midwest Planning and Research, Inc. This included not
only County owned parks but also City owned parks within the County. This
report shows that the County is well ahead of the statistic on nwnber of
people per number of acres of park land. He also stated that he has colored
slides of aerial views of some of the parks within the County that he will
bring to his next regularly scheduled meeting and show to the Commission.
Mr. Peterson brought the Commission up to date on some of the latest activities
of the County regarding park land. He stated that they are interested in acquir-
ing canoe camp sites along the Rum River. The County is rejuvenating the Rice
Creek Boy Scout Camp-by installing a fence along the road, sidewalks and a new
shelter building in the area. The County Commissioners have also talked about
the possibility of discontinuing the County Fair and developing the land now
used for the Fair into a large park to be used the year around.
The Commission asked about the progress of the Ice Arena. Mr. Peterson stated
that they expect it to be ready by the lst of March. They are in the process
^ of interviewing managers at this time. They anticipate that the arena will be
open for twelve months of the year, twenty-four hours a day.
PI�IiK CONSULTANT - EDWARD BRADDOCK
Mr. Edward Braddock, Park Consultant, presented his revised plan for the River-
view Heights area. This plan showed a curved entrance of� of Apex Lane leading

into a twenty to twenty-two foot drive, which would be used for parking, off
from which a sixty foot, black-topped boat launch would be built. A large,
� open, recreational area would lie to the North of the circular roadway with
the area lying to the South left primarily in a rustic state. The river would
have to be dredged in this area approximately every two to three years although
it would only take about one day and should not be too costly.
The Commission explained the purpose of having both Mr. Peterson and Mr.
Braddock attend the same meeting. They had discussed at an earlier meeting
the possibility of having the County help in the development of this park
since it would be open to the public and not restricted to only residents
of Fridley. Mr. Peterson suggested that the Coannission contact Mr. A1 Kordiak
who is the County Park Committee Chairman.

Ft�ANNING CprMISSION - CHAIRMAN �ITZPATRICK
Chairman Fitzpatrick informed the Commission that a developer has presented
^ tc� the Planning Commission, a plan for developing the Innsbruck area North
of Interstate 694. Nothing officially has been done to date but he thought
that the Commission should be aware of this.
RESOLIIf ION
A draft resolution regarding land from the parks system lost to the Nlater De-
partment for we�l sites was written by and presented to the Conneission by Vice
Chairman Dunphy. More than 1.57 acres have already been lost by the Park sys-
tem and the Commission feels that this land should be replaced. Mr. Marvtn
Brunsell, Finance Director, was called into the meeting to explain the system
oF assessing park land.

MOTION by Minieh to deny the request for a variance, on the ba8ie that
the plans ahown to the Board did not meet the preaent requiremente of the
City Code, and in the Boaxd's opinion they can see no hardship in
requirixig the applicant to comply with the requirements for la�ndry space.
Seconded by Ahonen. Upon a voice vote, 0'Bannon voting nay, the motion
caxried.
Mr. 0'Bannon voted xiay as he feels it ia unfair to deny this requeat �-�
when other apartments were allowed to be built and not meet the requirements
of Section 49.082 of the City Code.
The Board feels since the plans submitted to them were only preliminary plane,
they can be cha.nged to meet the present City Code requirementa. It ie also
the Boards opinion that it doea not make sense that a 17 unit apa,rtment and
a 140 unit apartment should req�zire tr� same 500 equaxe feet of laundry
room space. They feel thie section of the City Code should be changed.
�, There were no vaxiances of laundry room or storage spaee brought before the
Board on the four apartment buildings listed on the report. It ia the
Board's opinion that all four apartments are in violation of Section 49•082
of the present City Code.

In reviewing the planned development district, l find Ianguage
in Section 45.�3�, Subdivision 5, which I feel needs your review.
This section is rather confusing and I believe it to be impractical.
I suggest for your consideration tl�e followin� revised Ianguage:
If construction within the Planned Development District or
any staging thereof is not begun within one year from the
approva! of the fina) development plan, the Building Inspector
shall report such fact to the planning Commission together
With such other information as is availab.le to him concerning
any �ctual or planned ch�nges in the surrounding area with
respect to construction of buildings, roads, highways, or
other public improvements.
The report of the Planning Commission shall be considered
by the Council at the next regular meeting or at such other
meeting as the Council may direct, in order to determine
whether the final development plan is consistent with public
health, safety, or general welfare. The final�development
plan shall be reviewed and reconsidered at one year intervals
until such construction is substantia!!y completed in accordance
with the ptan.
