Since that time, the Planning Cou�ission h�v� had ana�hex request for a public hearing on the rezoning�in th� area, but the Planning Cottanission ha� not taken action on it pending Counc�l's d�cis�on. �n oxdex fox the Council to have the a�t�'.on of the P?anninQ GanQ►iss�on tae�p�e th�m �n Monday, when they pxesumably will act on the rezoning plan, T thix►k, as � background, it bught to be pointed out again that the Planning Cominission felt the area should be studied because it was improperly zoned and changes in the meaning of R-2 made the area subject to constanG rezoning �equests for multiple dwellings. The study made by Mr. Chaptnan has been gone over in a number of ineetings and the Planning Comomission r�comtnended at the 1as� meeting that Plan A-1 be adopted which restricted the devel.opment of the area into Chxee categories; the southerly most�portion was comanerc�al axea, fxoin S7'� Avenue to 60th �lti-family dwellings, fxom 60th to 61st Avenuea single family dwelling. I do not feel the Planning CouQaission itself believes the e�ctension of eommercial along University Av�nue is pract�.aal. Axiving down there, it seemed to me if such a rezoning should be acaompli�hed, that ar�a is going to amount to one large used car lot and from my sta�dpoint, I wondex what the value is to the City. If.the Council is going to xezone the ar�a c�anaercial along University Avenue, the x�sidential area should be bezter pxotected than what is being proposed now, and the Planning Commission �sks that a park should definitely be considered. 1'he concern is with the narrow strip of land abutting Univexsity Avenu�. If the need is to extend the co�ercial,..we ought to be sure that we offer protection to those residents who want the protection. We have an obligation to the people who do not want comnercial, which would px�tmarily be along 6�st. The Comanission felt Alternate Scheme A-1, dated April, _1969, resolv�d all the good points from the brochure and was being considezed at this point. Alternative Scheme D-1, submi�ted a� the same time, is a less desirable alt�rnative. This plan is-a composite of some of the other �hinking. pne of the main thoughts is that the area along 3rd Street is e�stxemely sh�1].ow to develop into commercial. The rezoning would be preferable i� it cou�d be done on a large paxcel. It was pointed out that the price range in this area does not warrent 125 foot lots for homes. It was felt that by splitting the lot according to line "A" (splitting the lot into two parcels), there would be no violations, and later on, when the area would be developed, the petitioner could consider another split if feasible. He planned to build on Lot 3, and the existing house, in which he now lives, would probably be torn down within a few years. Now it is out of line with the houses in the rest of the block. The side yard is close. Vice Chairman Myhra suggested,that as a formality, the Chairman of the Board of Trustees should submit a statement concurring with the lot split request. The question was brought up, regarding the existing house, that if the house were torn down could the foundation be built on? The answer was that it could if it met the building code requirements. The Engineering Assistant, referring to the Planning Commission meeting of May 8th, said that it was apparent that the owners of Lots 22, 24, 26, and 28 were n�t interested in having the back portion of their lots rezoned now, nor having a street, and as the hearing went on, they began to realize if a street went through, the assessments would be quite high and R-1 values would not make the land worth the assessments. If the lots were developed R-3 in the back half, then they would be put in a bind without the street. Nothing was resolved. If Arthur Street continued North, then more apartment traffic would go up to Onondaga. The problem is, if Mr. Nelson's request is granted, where is the street pattern terminated. The Commission wondered if the proposed street from the middle of the lots to the cul de sac, could be closed and the street continue between Lots 28 and 30 and the owners to the south would use 73rd Avenue. There is also the problem of frontage lots. Lot 24, having a double frontage, would take twice the rate of assessments as Lot 25 which is to the south and would be served by 73rd Avenue.
