All of us on 69th are at least 100 feet back. Also what kind of parking for the cars? Mr. R. V. Pritchard, 4528 58th Avenue: Our plan shows some cars under roof parking. Our plana also show about 180 feet that we left as open ground area. There will be grase, shrubbery, and the garages or buildings will be 35 feet from the trees. This would show 180 feet for setback, which would be an open area and for overflow parking. The drop off at the South end of the land was discuesed. The Engineering Asaistant brought in the Half Section topog map of the area. By allowing the petitioners to use down to 860, the number of apartments would be 104 and not 108. The Engineering Assistant said this proposed preliminary plat would be part of the final plat, as he understood Mr, Swanson purchased the extra lot and wanta to make one final plat. ^ Plamzing Coa�nission Minutes - June 11, 1969 Page 3 Mrs. Novak said that no purchase had been made. She was asked to identify her husband's aignature on the application form, which she did. Inasmuch as Mrs. 1� Navak did not understand the purpose of platting, Mr. Jensen explained that in the act of platting their property in conjunction with what Mr. S�vaneon previously had approved, they did not lose any title to the property with the exception of 25 foot right of way along the East line. They will still be owners as they are today. However, they will have three separate parcels instead of one large one. Mrs. Novak said they still want one large piece. � � Chairman Erickson explained the pxocess of the final plat in which signatures of all the owners are required, confirming that platting does not mean a change of awnerahip. Doaald Nielson, 115 71st Way (Lot 31) said he had been contacted in regard to selling 25 feet for a road easement, but could not come to terms with Mr, Swanson about the price. Mr. Gordon Sangeter, 7169 Riverview Terrace, said his property abuts the pro- posed plat. His objections were the eize of the lots were not compatible with the area, the traffic from the lots would use Riverview Terrace. 1�OTION by Jensen, seconded by Fitzpatrick, that the Planning Co�iseion continue the public hearing of the proposed preliminary plat, P.S. #69-07, Brentwood Estates (Reviaed) by Tom Swanson, for all that part of Lot 34, Revised Auditor's Subdivi- sion �77 lying East of the East line of Block 1, Mississippi View Addition until the meeting of July 9, 1969 expecting Mr. Swanson to make an appearance at that time. Upon a voice vote, all voting aye, the motion carried unanimously. Chairman Erickson co�ented that he was particularly bothered by the fact that the petitioner has not made an attempt to camplete the access road of the original plat which leaves it mandatory for the City to condemn the land to get a road in there. The possibility is that the Novak's may not go along with this platting if it is approved. He would like the two parties present. 3. The Engineering Asaistant said that the Church plans to sell off the North part of the cemetery which is not being used as a cemetery. Most of the property is already zoned R-3 except the piece in the rezoning request. This will square up the saleable portion. Accesa would come from Fifth Street. Brunis Smoka, 2513 St. Anthony Boulevard: He explained that he represented the Church. They have a large piece of land which could be used for some other purpose than lying vacant. They have about 175 burials in the other part of the land that they intend to keep. Arnold Carlson, 5430 Fifth Street, asked what could go on this property and was told multiples only. The requeet is for approximately two acres. Thirty- six un�ts could be built, but at this time, there would be no way of knawing whether it would be one large unit or several smaller ones. Upon a voice vote, all voting aye, the motion carried unanimously. 6. LOT SPLIT R�QUEST: L.S. 4k69-15. ARTHUR DEYS: Lots 3 through 5, Block 7, Hyde Park Addition. Mr. Deys brought the certificate of survey. The survey shawed a definite problem regarding the existing house as it was placed on the proposed lot line. Because of the narrow lota, a setback problem is created which would require a variance. It was suggested Mr. Ueys go before the Board of Appeals and make an application for a sideyard variance and setback. MOTION by Fitzpatrick, seconded by Jensen, that the Planning Co�iasion refer the Lot Split Request, L.S. ��69-15, Arthur Deys, of Lots 3 through 5, Block 7, Hyde Park Addition to the Board of Appeals for their opinion. Upon a voice vote, all voting aye, the motion carried unanimously. ^ It was suggested that Mr. Deys should look into dividing the split by a diago- nial line being approximately 60 feet on the atreet eide and approximately 57 feet on the rear lot line of the new lot. 7. REZONINC RF7QUFST: ZOA �k69-10, GEORGE BALTHAZOR: Lot 3, Subdivision 10 of Auditor's Subdivision ��94 (North side of Skywood Lane facing Hwy. ��694). Rezone fram R-1 to Triplex. Set public hearing date. Mr. and Mrs. George Balthazor were present. The Ca�ission felt R-3A would cover the triplex request. REQUEST FOR A SPECIAL USE PERMIT FOR CONSTRUCTION OF A TWO FAMILY IlWELLING IN R-1 ZONING: Lot 3, Block 4, Ostman's Addition by Roger L. Peterson. Referred by Council at June 2nd meeting. Mr. and Mrs. Roger Peterson and Mr. Harland Berry (contractor) were present. ^ Mr. Mittelstadt said, explaining the action of the Board of Appeals, this was a request for a special use permit to construct a two family dwelling in R-1 zoning with living quarters one on top of each other. The Code indicates thst a double bungalow, by specia� use permit, goes from the Board of Appeals to the Planning Commission Meeting - June 11, 1969 Page 6 Planning Coumisaioa and then to Gouncil:, There are $1,000 in back taxes, and � because of the hole on the lot, it would take about 1,000 yarda of fill at $1.00 a yasd to fill it up. The floor of the basea�nt is much higher than the water table. There could be a parking problem with renters in the basement. He should have a three car garage, as the neighborhood does not want cars standing outeide. If the Board had O.K'd. a tum around, this would hgve had to be made in the front of the house facing East River Road. Then there is the possibility that the petitioner would not be the pexv►anent awner. There could be deteriora- tion with different awners. The neighbors, however, appreciate having the hole filled aAd would agree to the uae. - � 9. 10. r'1 Mr. Swanson said the actual house, for all appearance's sake, would be a regular siagle family house with a wal..kout to the rear. He had a petition from all the people in the surrounding ne�,ghbcrhood and no one was against it. Upon a voice vote, all voting aye, the motion carried unanimously. . The plans for the house were ahown and discussed with the Planning Commission by Mr. Berry, the contractor. He explained the lot was given to Mrs. Peterson aa a gift. This put an entire different aspect to the initiel expense in getting the lot ready for construction. The Commission agreed that a turn around should be provided on the lot so that cars would not have to back onto East River Road, and that there should be a three car garage. MOTION by Jensen, aeconded by Fitzpatrick, that the Planning Coadnission recom- mend approval of the special use permit by Roger L. Peterson for construction of a two family dwelling provided that the petitioner makes provision for e turn around on the property so that autos may enter East River Road head on, rather than backing on, and that a three car garage be constructed as part of this propoeal. Upon a voice vote, all voting sye, the motion carried unanimously. Mr. Mittelstadt asked if there was no way the City can expect the owner, now that he received a special use permit to operate an apartment within the confines of R-1, that you can stipulate that if the original owner sells the property, it reverts back to R-1? The Engineering Assistant answered that, as long as the use remains the same and the building ia not altered, the use does not change. VACATIQN REQUEST: SAV #69-03. Mr. Jensen esid he was concerned by the motion because of the effect of broader considerationa that are already on the Council table. Part of one of their plans includes acquisition of right of way from the Schmedeke property and he thought it would be quite improper to rezone his property if the co�nity is going to end up condemning or acquiring a right of way.fram him. It might be more proper to send the rezoning request without a reco�endation. MOTION by Mittelstadt, seconded by Jengen, that the Planning Commission pass on to the Council without recotmnendatioa, the rezoning request, ZOA ��69-06, by Eldon Schmedeke of Lots 16 through 19, Block 12, and Lot 30, Block 21, Hyde Park Addition to be xezoned from R-2 (limited a�ultip.le:f�ily dwellings) to C-2 (general business areas). Upon a voice vote, Erickson,. Jenaen, Mittelstadt voting aye, Fitzpatrick voting nay, the motion carried. 11. VACATION OF HORIZON DRIVE EAST OF THIRD S_TREET: SAV ��69-04, CITY OF FRIDLEY: 5100 and 5101 Horizon Drive (Lot 2, Block 9 and I,ot 7, Block 4, Carlson's Sumdait Manor South Addition). It was noted the City was making a parking lot at the awner's expense in exchange ^ for other benefits to the owner. The utility easement (sanitary sewer) was down the middle of the parking lot. It was necessary that the owner petition for the vacation and give an authorization for the City to assess against his property the new improvements. The coadnent wae that 51st Avenue is the crossing the children going to the elementary school use, and it is the only crossing between 49th and 53rd Avenues. At one time, 51et Avenue was suggested for a pedestrian walkover. It was felt the City should get an agreement that, if the crossover bridge is built, it will be allawed to �nchor on the parking lot. Also, for safety's sake, there should be a sidewalk on the North edge of the parking lot because of the signals so that the children would not be going in front of moving cars on the parking lots. The sidewalks should have curbs. The grade was high at University and low on 3rd Street so that there would be same grading. MOTION by Jensen, seconded by Mittelstadt, that the Planning Commission recomcnend approval of ZOA ��69-04, vacation of Horizon Drive East of Third Street by the City of Fridley with the stipulation that a pedestrian walkway be provided between 3rd Street and T.H. ��47 outside the limits of the proposed parking lot, construction of said sidewalk to approxima ly wind up with the signalized crossing on T.H. ��47, and the City retaining the prop r utility easement. Upon a voice vote, Jensen, Erickson and Mittelstadt voting sye, Fitzpatrick voting nay, the motion carried. 12. PROPOSED PRELIMINARY PLAT: P.S. ��69-09. Metcalf Shirley Behrens, Fridley Sun Paul Brown, Director of Parks and Recreation Purpose of this meeting wifih representation of the Y.M.C.A. was to explore possible areas of cooperative efforts if a Y.M.C.A. facility is located in Fridley. Mr. Trowbridge outlined the preliminary plans for the proposed facility, which include: 1. Covering an area East of the Mississippi River, North of Minneapolis and including all of the approximate South half of Anoka County. (Pre- liminary plans include an additional facility in the general area of Coon Rapids.) 2. Full-family facility to include program and facilities for males and females of all age groups including the senior age. 3. Plans of the physical facility are unavailable at this time. These will depend upon the exact program to be offered which,in turn, will depend upon a survey of the area as fax as existing facilities and needs. ^ It was generally agreed that the proposed facility is needed in this area and preferably in Fridley. It was the Commission's and Y's feeling that mut�al cooper- ation is desirable for development of the grounds as well as the program itself. Considerable discussion dealt with the selection of West Moore Lake Park as the proposed site. There was concern by the Commission that: - 1. This tract of�lsnd is prime park land and considered unreplaceable. 2. Location of the Y in a residential area. 3. Whether the location adjacent to a body of water is absolutely nec- essary. 4. If park land is to be used, has the stern (panhandle) portion of Locke Park been considered. This would undoubtedly have advantages because of the location, parking and ac�ass. Dr. Strait asked the Commission for their position concerning West Moore Lake Park as a site. It was agreed to place this sunject on the agenda for the June 23rd /1 meeting at which�time a member of the Y.M.C.A. site committee will be present to answer questions concerning alternate sites. PROPOSED YMCA BUILDING Vice Chairman Cochran asked for Eomments from the other members of the Com- mission present at the meeting. Member Blair said thai he was in favor of ^ the YMCA complex being built in Fridley but wasn't sure whether the West Moore Lake site was the best. Member Stimmler was interested in what other sites had been studied. Mr. Leonard Samuelson, City Councilman and also a member of the YMCA Site Committee stated that other sites located in Spring Lake P.ark, Columbia Heights and Coon Rapids were studied. They concluded that the sites in Spring Lake Park and Coon Rapids would not be as well served and the site in Columbia Heights has since been sold for an apart- ment complex. They felt that the Y should be located close to Interstate 694 making it "easily accessible to the East-West and the North-South tra£fic. The other sites located within Fridley that were studied and decided against were East Moore Lake which has two houses on the property and poor soil condi- tions which would add another $100,000 toF$200,000 to the price of the complex, the area South of the Columbia Arena which has a charter that states the Locke property is to be used by the City and Public for a park, and the area North of Osborne Road and West of University which is owned by Bob's Produce, would have no frontage available on_University Avenue. He also said that the Y organization will�build in an area only where there is great enthusiasm shown by the people, who such a building'would serve, and that they have been work- ing at getting a Y complex in this area for approximately 14 months. The following statement was presented to the Commission by Mr. John Jensen, 6070 - 6th Street N.E.: Mr. Chairman and Honorable Members of the Park Commission: . - I want to express my appreciation fqr your allowing me to make a ^ few brief comments to you this evening. _ I am a citizen, home owner, a taxpayer - and have been a resident of Fridley for past 12 ey ars. I was thoroug�ly shocked when I read in the June 4th issue of the Fridley Sun - about the planned 1Vest Moore Lake Park Giveaway - I was equally shocked when I found out that the dedicated members.of the Park � . Commission had not even been consulted.about the plan - I have also been ' told that the city manager sits on the Y site selection or development committee. Does he agree with this action? Is it proper for a city manager, a paid public official, to sit down and in any way plan to give away city property. In my opinion this whole business has a bad odor and deserves further investigation. What is the logic of giving a�day any park land or city land for that matter - we are told we are below the recommended acreage for parks - we should have 260 acres, we have 220. If we give away 8 acres - we will be down to 212 acres - 48 acres below recommended standards. With a projected population of 50,000 we will need 500 acres of park land. The land is said to be worth 100,000 dollars - I suspect more, How can you people as Park Commissioners rubber stamp the council's action and vote to give away $100,000 worth of park land when last year were allowed only $6,000 to acquire new land. Gentlemen, this is rediculous and improper. Why has the city council at this late date decided to use you to lend an air of - legitimacy to their give away. They are trying to transfer some heat to you and you don't deserve it. I also believe that Council should treat you with more respect. In my opinion the job of Park Commissioner should , be to expand and preserve and not give away Parks. I personally enjoy this Park area as a retreat. I take my boys an hikes in this area. I hadn't realized how much the schools used the area until I read the informative article in the June 18 issue of the Fridley Sun written by that gracious lady, Mrs. Metcalf. Let's be thankful for ^ Mrs. Metcalf. She will, I'm sure , in her own pleasant way make the City Fathers see the folly of their ways. In addition to giving up the natural park area - I object to the added traffic the plan would create. I live on 61st Avenue - I resent being told I can tolerate more traffic - I notice the chief proponents of this give � away live in quiet seclusion near the river. Don't tell me to move to a quiet place because I can't afford it. The feeling of the people in the neighborhood must be considered. You saw some of them marching outside tonight. Where should the Y.M.C.A. go? This is not for me to say - however there is land available near the Columbia lce Arena. If i is City land I would object to giving it away if it could be used for a park. If it is private land let the Y.M.C.A. buyiit. If they can raise 1.5 million to build a building -'they can raise money to buy some land. � I have read there is 30 acres available in Spring Lake Park. If the Y.M.C.A. is looking ahead it would seem to me 30 acres would be better for future expansion rather then be cro�aded in on 6 or 8 acres with no possi- bility for expansion unless they drain Moore Lake. No matter, let me con- clude by saying I am obsolutely opposed to giving away the West Moore Lake Area�to the Y or anyone else. There have been some comments that this • opposition will die down. Don't count on it. Pursuing this plan can bring you more problems than you would wish to have, I respectfully request that you recommend that the West Moore Lake Site be retained as Park Property and not be given away to anyone, riow or in the iuture! ^ MOTION by Blair, seconded by Stimml�r, that the Commission advise the Council to hold a minimum of two public hearings and after these are held, the Commission will take a stand if they see fit. Eie said that he was a promoter of the defeated Park Bond Issue and has always promoted adequate funding and the purchasing of land for the Parks Department. He feels that the Council has been cooperative arid quite generous to the Park Department. Mr. Jim McChesney, YMCA Site Com- mittee, said that it is the intention of the YMCA to coaperate with all organ- izations. He felt that this building would serve as an excellent drop-in center for the Jr. High and Sr. High. Mrs. Connie Metcalf asked how does this site differ from others. Mr. Trowbridge answered that the programs would be geared to the site and with this site, lake activities would be offered. Mr. Samu�lson said that many studies have to be made: Area of service, economics of people, residential versus industrial, number of people served which in this case is 150,000, which highways would serve area and also size of land available. He informed Mr. Jensen that the Fridley City Manager, Mr. Ankrum, was not a msmber of the Site Committee; he only helped to gather the necessary criteria. Mr. McChesney asked what had been planned for this particular area in the park bond issue. The Director said that the preliminary planning is for a ,passive recreational area. Mr. Cochran commented�that this area is prime, irreplaceable park land, the last lake front area left in the City. He urged the people to contact their councilmen to make.them aware of their feelings. MEADOWLANDS ADDITION AREA � A citizens committee from the Meadowland Addition area attended the meeting to find out what the immediate plans for this area are. The Director answered that the area will be graded and three pieces of apparatus p?us benches will be installed this summer. Mr. Ken McLellen, 6749 Kennaston Drive N.E., suggested that if the area that this park would serve could be determined, perhaps these people could be assessed for the complete development of the park. Mr. Jim Holmes, 6700 Kennaston Drive N.E., asked what the estimate for the drainage would be. The Director said that the Engineering Department would have to determine this. Mr. Don Bratt, 6701 Overton Drive N.E., stated that the pur- pose of them being present at the meeting was to find out the immediate plans and he thanked the Commission for the information. Mr. Cochran suggested that they organize among themselves and work w�th the Director as to how much should be done each year. Mrs. Stanley Dahlberg and Curtis Dahlberg were present. Dahlberg explained there were two different ways shown on a they request either one. The plan showed the South portion divided and allowing 25 feet for a�oad easement. , Lot 11, Curtis map, and of Lot 11 Because this area had not begun to develop, there being about five vacant lots ieft on 64th Avenue, it is hard to predict where the road at the center of Block 2, Spring Valley Addition, would go. As future requests would come in for lot splits the people would then be asked to dedicate for the road. By permitting narrow lots, the City ordinance would be violated. It was pointed out that the price range in this area does not warrent 125 foot lots for homes. It was felt that by splitting the lot according to line "A" (splitting the lot into two parcels), there would be no violations, and 2ater on, when the area would be developed, the petitioner could consider another split if feasible. The petitioner, Mike 0'Bannon, explained his sketch of the plat which, basically, followed the tentative plan of the Rice Creek Road/Central Avenue Street Study. He said that h� showed all the adjacent neighbors, except Rev. Henderson because of lack of interest, the proposed plat. There are three people involved in the platting, Mr. 0'Bannon, John Car�oll and James Skog. The cul de sac is in the center of the Skog property and ends there because the people to the West were not ready to plat at this time, but the cul de sac is situated so that the road can be extended when these people wish to develop. It was noted water and sewer was on Rice Creek Road, but Mr. 0'Bannon plans using Comstock & Davis for putting in the sewer and water in the plat. Mr. 0'Bannon said that, before the streets are paved, next spring he would put the sewer in and block up the ma.nholes. There ' appeared to be no difficulty regarding the description of the land, no prob- lem about zoning because it is all R-1, street dedi,cations are on the survey, and utilities are available. Mr. Wells explained the xeason for the petition was that they were going to put Lot 8C on the market, and according to the position of their ^ house on Lot 8A, they would face the backyard of the neighbor. The Subcommittee studied the whole area noting that the Easterly portion of Lots 8, 8A and 8B, together with the Westerly portion of the abutting lots of Brookview Second Addition, would have no street access if they should be split for buildable lots. However, the size of the lots is not sufficient to split and give necessary road easement and still maintain a standard lot depth of 1QO feet. This problem should be called to the attention of the Planning Commission. GALLAGAER: West 5 acres of NW� of SE�, except South 4 acres, Christie Addition. Mr. and Mrs. Gallagher were present. Mr. Gallagher said his house and garage face Mississippi Street. The ^ pxoposed plat consisted of three lots, two facing Mississippi and the third at the back of the property would face 7th Street. The back lot, although ` it was low, was buildable without fill in the opinion of Mr. Gallagher inasmuch as they never had water in the basement. It was felt the setbacks were adequate, the square footage of the lots was O.K. There was a pole •which would be on a lot line that would have to be removed. As far as easements were concerned, the Subcommittee felt there was no problem at the North end, but the easement situation at the South end shauld be checked, as there is a 30 foot jog on 7th Street. MOTION by Cxowder, seconded by Zeglen, that the Plats & Subdivisions- Streets & Utilities Subcomanittee recommend to the Planning Co�nission approval of the preliminary p1at, P.S. ��69-10, Gallagher Addition, William H. Gallagher, of the West 5 acres�of the NW� of the SE�, except the South 4 acres, Christie Addition, calling attention to the rather unclear situation of road easements along the 7th.Street edge of the property. Upon a voice vote, all vating aye, the motion carried unanimously. 4. LOT SPLIT REQUEST: L.S. �69-19, NORTH AIR HOME ASSOCIATION, J. R. PLEMEL: South 150 feet of Lot 18, Brookview Addition subject to road easement over South SQ feet. No one was present regresenting the p�tition. The Subcommittee felt this would be a logical extension o£ the property ^ of the Knights of Columbus to be used as a parking lot. Mr. �eglen mentioned that this was swamp land. The Subcommittee wished more information about the amount of land purchased.
