HIS ATTORNEY: To construct a service station on Lots l thru 6, Lot 9, North 68 feet of Lot 20, Central Avenue Addition. Chairman Erickson read the Public Hearing Notice. Due to the absence of Mr. Giancola, Mr. Robert Guay, Attorney, represented the petitioner, and Mr. Ralph Sundberg, Real Estate representative and Mr. J.L. Winters, Construction representative of Skelly Oil Co. were also in attendance. � Planning Commission Meeting - June 17, 1970 Pa�e 2 Mr. Guzy stated the service station would be the rustic design. There is a plan for the landscaping "in the mill" and would be ready for the Council. Basically, the building will be on the West side of the property with two en- trances off Old Central and one off 73rd Avenue. �tao pump islands are planned East of the building with a future island North of the building. The station would be three bay with parking along the South and West. The buffer areas are open to recommendation of the City. The Ground Plan, Sheet No. A, dated March 3, 1970, was shown to the Comnnis- sion. The station would not be a 24 hour station, nor would it be in the towing business. Therefore there would not be cars parked outside for long periods of time. Regarding signs, Darrel Clark said the sign ordinance is pretty restrictive, and is much easier to enforce on new stations. Mr. Schmedeke asked if Skelly Oil would consider putting evergreens along the blacktop area West of the building. Mr. Sundberg said they would mention it to the people planning the landscaping. Referring to the intersection at 73rd and Central Avenues, the Engineering Assistant said recently it was widened at the intersection and the City has 100 feet of right of way on Central Avenue so that there is plenty of room to work with. The Skelly people are working with the City Engineer on the 73rd ^ Avenue right of way. MOTION by Fitzpatrick, seconded by Minish, that the Planning Commission close the.Public Hearing for the Special Use Permit, 5P #70-05, Cpl. James L. Robinson by G. D. Giancola to construct a service station on Lots 1 through 6, Lot 9, North 68 feet of Lot 20, Central Avenue Addition. Upon a voice vote, a1Z votinq aye, the motion carried unanimously. When Lot 20, Central Avenue Addition, was split, it was stipulated that the remaining part of Lot 20 would stay with Lots 7 and $, and also the peti- tioner was asked to get a petition for the vacation of Brook Street. Referring to the George Walquist petition for a similar split, Council asked the petitioner to plat the remaining piece. In the case of Central Avenue Addition, the property is torrens. The purpose of the vacation of Brook Street was to give approxi- mately 90 foot frontage on Central Avenue. The present owners are considering this as one unit as far as sale or development, but the Commission was con- cerned with the problem if it could not be sold in one piece. The two lots (7 and 8) and the 30 foot vacation, makes an area of 16,500 square feet which is still a pretty small piece for an M-1 (light industrial). The North lots, facing 73rd Avenue, are zoned C-1 and the remaining South lots are M-1 (light industrial). A suggestion was made to tie the remaining property together, but because of the two types of.zoning, it was felt the land could not remain as one lot. Mr. Guzy asked how long it would take for a Registered Land Survey and � was told about 90 days. The Skelly people said they could not wait that long, as they planned to start building this summer. Mr. Guzy did not believe it would be possible for the owner of the land to sell the lots 7 and 8 and leave the South Half of Lot 20 and the proposed vacated 30 feet to go back to tax�s as this is valuable industrial land. MOTION by Minish, seconded by Fitzpatrick, that the Planning Commission recommend to Council granting of the Special Use Permit, SP #70-05, by Cpl. James L. Robinson by G. D. Giancola, his attorney, to construct a service station on Lots 1 through 6, Lot 9, and the North 68 feet of Lot 20, Central Avenue Addition. Upon a voice vote, Harris abstaining because Mr. Guzy is his attorney,.Erickson abstaining because of confZict of interest, Schmedeke, Minish and Fitzpatricic voting aye, the motion carried. 2. VACATION REQUEST: SAV ��70-04� CPL. JAMES L. ROBINSON BY G. D. GIANCOLA, HIS ATTORNEY: Vacation of Brook Street -- immediately South and abutting Central Avenue Addition. Chairman Erickson commented that apparently this is a logical vaeation, but there is a question of Lot 20 being landlacked at this point, and he felt it should be tied together with Lots 7 and 8 with a Registered Land Survey as a condition of the vacation. MOTION by Fitzpatrick, seconded by Minish, that the Planning Commission recommend to Council approva.Z of the vacation request, SAV #70-04, Cpl. James L. Robinson by G. D. Giancola, his Attorney, of Brook Street, and that it be � granted with the stipulation that Lots 7 and 8 and the South Xalf of Lot 20, Central Avenue Addition., be platted as a Registered Land Survey with the area requirement of the o1d zoning code to be appZied. Public Hearing closed. Mr. Art Winters and Mr. Marlo June were present. Mr. Winters reported on the information he had received from HUD; Mainten- ance of grounds -- none; construction -- Fridley Code requirements; occupancy -- this was from the document published by HUD, G4700.1 FHA and under No. 236 Section, Housing for Lower Income Families. Chairman Erickson rep 4rt�d on the information he and Darrel Clark obtained. Their source of informatio�i'sa�d that there was no control over how they are re�ted. They can rent to the elderly and others if they wish. They do have maintenance checks once a year, but they did not state hora tharough the check would be. His opinion was that ttiis is really a request for a rezoning to R-3 igeneral multiple family) and perhaps should be treated as such. If it were a request for elderly housing, and�there were some controls over it, he would have no objections, ea�cept for the lines and layout of the buildings. He added that if the complex can be rented to anybody, which, in fact, it can be, � then the request should be treated,�as a rezoning, and he would object to it�s being handled in this manner. ( � Planning Com�ission Meeting - June 17, 1970 Page 4 Chairman Erickson explained that HUD No. 236 is a special section of FHA wherein the government will subsidize certain things by direct payment. The Federal government requires that a person living in a financed bui•lding by HUD pay 25% of his income, and would subsidize a$100.00 a month rental unit for anybody with a low income. The government encourages the mixture of old people with younger people. They can't rent to people with higher incomes. If, in the future, the apartments were not rented to law income people, this would be an apartment complex. Mr. Winters said that was not the intent of the petitioner. Mr. Marlo June said he had some thoughts on this problem. The suburbs are getting a lot of pressure from the State and Federal government to build housing for the lo�a income and elderly groups. The State Government has the right to take away our zoning ability or prerogative and tell us what to do and they could take it away any time. All the communities are going to have to start looking into it. He hoped this would be along the line to help the community without going to the State. Mr. Winters read excerpts from FH 4700.1 Digest of Insurable �oans and Summaries of other Federal Housing Administration Program, March 1970 -- a Hud Guide. He said if the City of Fridley accepts the request, under the HUD program, the City would have to pass a resolution "Under the Workable Program". About two or three months ago, the City of Hopkins passed such a resolution /"'� and he would try to get a copy of it. Mr. Schmedeke wondered if the complex could get 40 families to come out here and if the people would be interested in concrete floors and electricity heating. Mr. June volunteered that the floors are carpeted. Chairman Erickson said the Planning Comm►ission is being asked to create a density equal to R-3 density and intended for the elderly but not necessarily knowing it will be rented to the elderly. Mr. June said the government stipulated that no one can live there with more than one child. The Commission wished more time to study the possibility of making stipula- tions to restrict the houses to the elderly only; how difficult it would be to enforce the stipulation; and whether or not the City would have to draw up an ordinance. SKOG: North 10 feet of Lot 17 to be added to Lot 18, Block 2, Parkview Oaks lst Addition. Mr. Skog was present. ^ � Mr. Schmedeke, Chairman of Plats & Subdivisions-Streets & Utilities Sub- committee, which met at 7:00 P.M. previous to the Planning Commission meeting, stated the Subcomuti.ttee appraved the lot split request. Planning Commission Meeting� - June 17, 1970 Paf�e 5 � Mr. Skog explained that he has the opportunity to obtain 10 feet from the North edge of Lot 17 which would give him 10 more feet alongside his garage. The basketball area could then be in the back instead of the front yard. It would not be long before the children would be awning their own cars and this will create a parking place alongside the garage for the extra cars, if he needs it. The bank will be cut back. If his neighbor were to fill this, it would cost him a lot money, and it is quite a distance from his house. His garage was built too close to the line to begin with. The Engineering Assistant said that 6 feet of the 10 feet is an utility easement and Mr. Skog does not intend to build a structure on it. MOTION by Harris, seconded by Minish, that the Planning Commission recom- mend approval of the Iot split request, L.S. #70-08, Frederick A. Skoq, to split the North 10 feet from Lot 17 and add to Lot I8, Block 2, Parkview Oaks lst Addition. U,pon a voice vote, a11 voting aye, the motion carried unanimously. 5. LOT SPLIT REQUEST: L.S. ��70-09, WENDELL ELLIOTT: South 20 feet of Lct 1, Block 1, Sandhurst Addition deeded to Lot 2. Mrs. Wendell Elliott was present. Mr. Schmedeke explained the Subcommittee heard this request tonight also. ^ The land involved had been deeded several years ago, but Mr. Elliott continued to pay the special assessments. However, now a road is being built, and unless the lot split was done legally at the City level, he would be paying the assessments for the new road. The Engineering Assistant said that this 20 feet, which was deeded, actually is at grade with the neighbor and below the grade of the Elliott�bawn and it does look logical. Both houses have about the same distance to the new lot line. MOTION by Schmedeke, seconded by Fitzpatrick, that the Planning Commission recorr¢nend approval to the Council of the Lot Split, L.S. #70-09, Wendell Elliott, splitting the South 20 feet of Lot 1, Block 1, Sandhurst Addition and deeding it to Lot 2, Block 1, Sandhurst Addition. Upon a voice vote, all voting aye, the motion carried unanimously. 6. STREET SIGNS IN COLUMBIA HEIGHTS: On 40th Avenue between Central Avenue and University Avenue. Mr. Schmedeke again spoke about the difficulty of seeing the street signs in Fridley at night. The street signs he referred to in Columbia Heights are quite large, and he thought a sign of this type should be placed on the main ar�erial streets, such as Mississippi Street, 7th Street, T.H. #47, etc. If there were new men on an ambulance or fire truck, it would be easier for them to see the signs at night. He did not believe in taking down every sign, but ^ to gradually replace them. He said the signs in Fridley look good and are easy to read during the day. The Engineering Department was to contact D. W. Harstad Co. to inquire about costs. Continued. No action. IAT SPLIT REQUEST: L.S. 4E70-08, FREDERICK A SKOG: Ten feet of Lot 17 to be added to Lot 18, Block 2, Parkview Oaks lst Addition. Mr. Skog was present and explained that for seven years now, the "sharp cliff", belonging to his neighbor, and partly behind the garage, has been unimproved. There are rocks in trhe grass so that it can't be mowed. His neighbor, Mr. Harris, said he would give him ten feet of this area. Mr. Skog's garage is 3'� feet from the South property, which was a mistake when the house was built. If he had the ten feet, he would make good use of the extra land for patio, and other recreational purposes. Mr. Skog said his neighbor's house was probably 4 or 5 feet higher than his garage level. The whole area is on a hill. There is a drainage easement North/South and East/West. The gully to the South is sodded for drainage but when water comes down from the hill, the dirt comes with it. The Engineering Assistant said that he felt if the two neighbors could divide the property up, as far as the City is concerned, there would be no objection. The easement would still be there the same as it is now. The description would be simple "the North 1Q fQet of Lot 17". LOT SPLIT REQUEST: L.S 4�70-09, WENDELL ELi,IOTT: South 20 feet of Lot 1, Block 1, Sandhurst Addition deeded to Lot 2. Mrs. Wendell Elliott was present. The Engineering Assistant said that the two lot splits were similar, except in this case, the Tand had already been deeded. The petitioner is the person who sold the 20 feet. The reason for the lot split request is to make the transaction legal because a new street is being built and Mr. Elliott does not wish to pay for the special assessments. Mr. Elliott owns Lot 1 and all the Subcommittee is concerned with is that he has sold off 20 feet. On four lots, five homes have been built. Mrs. Elliott said there was approximately 52 feet between the houses, 20 feet between Mr. Sampson's garage and the new line and something around 40 feet between their house and the new lot line. PROPOSED PRELIMINARY PLAT: P.S. 4�70-01, ROGER M. JONES: Part of the SW� of the NT� of Section 2 for golf driving range - M-2 zoning. Mr. Al Davies, Mr. Fred E. Jones and Mr. Roger M. Jones were present to discuss the petition. The Engineering Assistant stated that last.fall:Mr. Jones first $roposed the golf driving range. The land was purchased under an agreement that he would h get a Special Use Permit for a driving range. The permit was processed through the Board of Appeals and Council approved subject to the dedication of 30 feet for 81st Avenue, also the Easterly 30 feet for Main Street and also a 50 foot looped service drive across the Easterly edge which is adjacent to University Avenue.Because this would be a very long description, Mr. Jones agreed to plat and record it prior to some time this early fall. At this time he will be platting the South 400 feet of the Southwest Quarter of the Northwest Quarter and put up a temporary type building on the East side of the service drive. He has a three year agreement with the opportunity of renewing unless the area begins to develop. Referring to the loopback at the Southeast corner of the proposed plat, this is back from the highway to give more room for traffic. It was brought up that this would give another site for a filling station, however, it i3 1.3 Acres and would not necessarily have to be a filling station. The plat and the area around it was zoned heavy industrial. Speaking of roads, Darrel Clark said that there was no reason to build a road until the land is developed, but when one is built, it will be 9 Ton design. Mr. Fred Jones said that the golf driving range was something they hoped would support the cost of the property until industry would build. They were contract purchasers of the property. Mr. Croaader asked if Mr. Jones could provide an entrance to University /'1 Avenue. Darrel Clark answered the Highway Department has built an approach and it is blacktopped goint to the property line at 81st Avenue. The street pattern lines up with those in East Ranch Estates 2nd Addition which is to the South of 79th Avenue. North of 85th Avenue, there is land being purchased by the City for Open Space. � � ;.. _ :� Plats & Subs.-Str. & Util. He further explained that the sign will be a one sided sign made of stainless steel plate and will have florescent lighting. The sign face will be 4 feet thick, 21 feet 6 inches wide, 9 feet high and the overall height which includes the base will be 11 feet 6 inches from the ground. � Mr. Davidson stated that the company might want to increase the base height, now 30 inches, by 1 foot because of snow depth. A discussion about the lighting of the sign brought out that the lighting will be 1000 watt florescent fixtures and the face of the sign will be made of one sheet of a new type of plastic called "Lexan" which is translucent and highly reaistant to damage. Mr. Sondhei�r suggested that they use aluminum bodies for the fiactia�ete�o:ti�e sign would be grounded. He also suggested they use tamper proof fastenere for the panels on the back of the sign to discourage vandaliem. Cathie Stordahl, Secretary to Commission. 1971 BUDGET, ` This Special meeting of the Parks and Recreation Commission was called so the Commission could discuss their findings at the ''Tour of the Parks" on Saturday, June 6, and how they can relate these findings to the 1971 Budget. In preparation for a second Special Meeting with the City Council on Wednesday, June 10, in which the Commission would discuss the needs of the Department, the Commission prepared a list of areas which needed the most attention and a possible solution for a means of obtaining the finances. As each Park or Park Land was named, the Commission and Mr. Brown indicated whether or not the need was an immediate need. The Riverview Heights area has many possibilities; Chases Island would be a matter of cleaning up and could be developed into a very nice park; Meadowlands is in need of a major storm sewer project befor.e any further development can be started. It's not a problem of acquisition, but rather an improvement problem. The possibilities of acquiring some land directly adjacent to the Meadowlands Property, was also discussed; The Commons is in need of an irrigation system; Hyde Park and Summit Square have similar problems; West Moore Lake has a need for a sidewalk, lighting, and planting; The City of Fridley Engineering ^ Department is developing the road into Locke Park and the parking lot is in the Parks and Recreation 1970 Budget. Areas for improvement were suggested, such as replacing one warming house a year, a Recreation Center at The Commons, a 60' X 60' Park Garage with indoor plumbing, and the possibilities of a Municipal pool. The areas requiring large sums of money for development are the Ruth Circle Area, Hyde Park, North Park, West Moore Lake Park, Meadowlands, RivErview Heights, Chases Island, The Commons, 5ummit Square, and an unnamed area in East Fridley (G6 on the map) which is about six acres in size. ^ Possible solutions for funds are a Bond Issue and money from the sale af the Shorewood Lounge. Federal Grants were mentioned, but the government is the most interested in developing parks to remain in their natural state. Mr. Olson asked to go on record as commending the Parks and Recreation Director, Paul Brown, and the Parks Foreman, Ralph Volkman, for the great job they�re doing in the Parks and with the Recreation programs. The entire Commission agreed that they were most fortunate to have these two men working for the Department. ADJOURNMENT. To permit housing for the Elderly and Senior Citizens. � Mr. Arthur Winters, 7651 Central Avenue Northeast represented Mr. Chies. ' His explanation for the Special Use Permit was to build housing for the Elderly and Senior Citizens. l'� This plan cames under the HUD Program No. 236 which is a low rent type, the reat being in the neighborhood of $99.00 a month. The renter pays the �oun� he can afford and the government subsidizes the balance. There would be the regular real estate taxes and the property would be assessed as any other parcel of land, the only difference being ti�at:.t�e .reaf_ is subsidized. The plans are for one bedroom units, no basement, but there is an area for washing clothes in the �tility room. Plans were submitted to Spring Construction for frame construction. They subsequently found out that, under HUD rules, con- crete was specified, probably from the standpoint of fireproofing. There would be ten 52'x48' four unit buildings one story high on twelve 75'x120' lots. They knocked on the doors of seventeen property awners, Mr. Winters saw twelve people -- ten of the twelve signed a petition approving the plan, but he did not get to see the rest of the neighbors. The Petition was presented to the Planning Co�ission. MOTION by Fitzpatrick, seconded by Schmedeke, that the Planning Commission receive Petition No. 7-1970 approving the Special Use Permit request, SP N70-03 by Edward Chies to permit housing for the Elderly and 5enior Citizens in an R-1 District. Upon a voice vote, all voting aye, the motion carried unanimously. � • Planning Commission Meeting - June 3, 1970 Page 5 The Engineering Assistant commiented that there is a fairly high water table � in this area. Mr. Winters said that the homes they are building on Meadawmoor Drive, South of this proposed complex, are all split entries, and they are raised up quite high. The response of the people he visited there showed no objections. In fact, he really didn't have any serious objections from the neighbors. The statement was made by Darrel Clark that the lots in this request are all zoned R-l. Under R-1, a Special Use Permit is required for the type of the housing. It was noted that Lots 5 and 21 have R-1 zoning and they abut Lots 4 and 22, which are zoned C-1 (local business). The C-1 area included Lots 1 thru 4 and Lots 22 thru 26, Meadowmoor Terrace. Mr. Winters stated he understood that this proposal was to abut the C-1 District and he would talk to his client to see what he would want to do with Lots 5 and 21. As Mr. Chies owns all the lots, this can be corrected. Louis Stoffers, 7676 Bacon Drive: He stated he has been a resident in the area for four years. Across the street from his house, the tornado took a house and after three years, nothing was ever done. He asked Mr. Chies to do something with this property and even went to the Council. Council sent letters out to cut the grass, but nothing was done. Now he wants to build this housing. Right after he bought his house from Mr. Chies, he had some action against him, which was four years ago. If Mr. Chies didn't take care of him four years ago, he wondered how long he would keep this property before selling to someone else who would say they wouldn't have to follow the rules someone made five years ago. Mr. Stoffers also wondered if there would be an increase or decrease in the /'� value of his home. He didn't have anything personal against Mr. Chies, just in his business end. � Mr. Winters told the Planning Commission that Mr. Stoffers was not object- ing to what Mr. Chies is doing, but he wants to make sure that Mr. Chies has to follaw through with what he said. All Mr. Winters could add was that it would be his personal view, building under the HUD program, maney will be withheld until the work is done the way it was agreed upori. Mrs. Donald Nelson: She mentioned that there is approximately forty little children on Bacon Drive and the increase in traffic would be hazardous. Chairman Erickson asked Mrs. Nelson if she would have the same objections if the parking were on Osborne Road. She thought that would help, but it is a busy street already. Mrs. Nelson continued that the type of building that is put on a slab is bound to affect the property value. Most of the houses in the area were rented from Mr. Chies and the renters had great difficulty getting maintenance done on the houses. The people are afraid of the care this housing project would get. Referring to.the parking, Mr. Winters explained that one of the reasons for having the parking lots on Meadawmoor Drive was because Osborne Road is a fast track at the present time. He didn't believe this housing would be a dawngrade factor in the area. Michael Sandahl, 7651 Bacon Drive: He thought the crux of the matter is that homes built on slabs would downgrade the area. These mobile homes would be "Select Homes of Cannon Falls", expensive units, and at any time, no more than four homes would be on display. The prime reasan for the better class homes would be to upgrade the tenancy of the mobile home park. The property line of the lot we are talking about would be right at the North end of the existing structure running to the property line of the Rice Creek Office Building and is aside and apart from the general shopping area. David 0. Harris, 470 Rice Creek Blvd.: Mr. Harris stated he was one of the owners of 6279 University Avenue along with Dr. George J. Haysuo, who was also present this evening, and Virgil Herrick. He recognized the right of the petitioner to ask for this type of waiver. He added, we are talking about a large area that extends from City Hall to St. William's Church. All business is conducted within the structures and are permanent. We feel that such an endeavor would certainly be a detriment to the area in general, and specifically to our structure. They felt the people renting from them did riot expect anythiag else, beside the shopping center, would be in their view from that side of the building. They made a substantial investment in the area and own land behind their building. He did not think a mobile home sales in the area would enhance it. There is already a charge for connecting the ejector pump• He asked if there would not have to be quotes taken. The City Engineer said that if a job is les,s than $5,000, it daes not have to be let, but there would be three quotes�taken.� Councilman Sheridan said that originally he thought that this would be a � structure outside of the home. Atter the job is done, it would then be turned over to the property owner. The City Engineer agreed that once the City is done with it, a release should be signed and it is then the concern of the property owner. The City Engineer said that this type of service has been installed in other cases, but the property owner paid for it. In this case, this man has been-assessed. ' The City Attorney suggested that there should be a formal release wh�n the work is done. _ � � � � MOTION by Councilman Sheridan to authoriz� the expenditure of the necessary_ funds to provide- sewer and water service at 6880 East River Road for Mr. M.P. CONSIDERATION OF RE UEST FOR APPROVAL OF PLANS FOR DRIVING RANGE NORTH OF 81ST AVENUE (ROGER JONES): The City Engineer said that the Council granted approval of the concept of this plan last November. Since that time Mr. Jones has had some title problems that are now straightened out and he is_anxious to start. The land is to be divided into Tract A, B, and C by a survey, which will be coming before the Council. He explained that the black lines on the map in the Agenda_ _ are the existing easements and it was his secommendation that the petitioner should dedicate three additional easements, one along the east, one along the west side and one along the south side, to includ� an eas�ment Eor a possible loopback. It is not known at this time what type of road pattern will be needed. If they are not needed in the future, they could be vacated. A driving range just has a short season and he is anxious to start. He plans on building a small building along the lines of a warming house and showed the plans on the easel. He said that he would recommend that the special use permit could be for three years, renewable for an additional two years, and at the end of five years the installation could be considered permanent and he would then be required to follow all the City Ordinances in regard to blacktopping, curb and gutter, etc. Councilman Harris a5ked Mr. Jones if he was agreEable to this, and Mr. Jones repl�ed that he was. Councilman Liebl agreed that the permit should be at least five years as he will be investing a considerable amount of money and it will take a few years to establish his business. Mr. Jones agreed and said that he would not get a return back on his investment in one year,�and he felt that it shouZd be a five-year permit. A permit fnr an operation such as this would give the City some control to assure them that he will not be running a shoddy business. The City Engineer said that the petitioner shoulci also be willing to go along with the water, sewer and storm_sewer improve- ments when they go in. He asked about how large the loopback wauld be. Councilman Harris said it would have to be 250 feet from the street, and would be about l�s acre parcel. Mr. Richard Harris said that this would be another"potential site for a gas station. The City Engineer pointed out - that before a filling station could go in, the Council would have to grant a special use permit. Mr. Harris said that he was not quarreling with the loopback concept, but he wondered what would-be done with these small parcels of land as more and more laopbacks are created. Mr. Jones asked how close the sign could be to University Avenue. The � , Gjity Engineer said about 60 feet €rom-the highway. Councilman Harris said - -- that the sign ordinance would give him all the additional information he would need. ' . MOTZON by Councilman Breider to grant a special use permit to Mr. Jones sub- ject to dedicating the three easements, su�mitting a xegistered land survey, the sgecial use permit to be for three.years, renewable up to five years, at which time the business will be considered permanent and he will be expected to comply with all the Code requirements, and with the understanding that he will not oppose the sewer, water and storm sewer improvements when they go in in the future. RECON5IDERATION OF BUILDING ON LTNDERSIZED LOT, FRANK DIRCZ: (On Agenda �t the request of Councilman Liebl) The City Engineer explained that Mr. Dircz owned three lots, and is trying to split them into two lots. He has a house on Lots 28 and.29 and he wants to split off 10 feet from Lot 30 and add to Lot 29 to make.:a lot 45.12 feet deep. The previous action by the Planning Coimmission was to deAy the lat split, althaugh the Board of Appeals apgroved of the variances. rec�uested. Councilman Liebl pointed out that there was a petitiom from th2 neig�oring residents in favor of his building a house on this lot. He said that as ther.e was a member'of the Board of Appeals in the audience, he-would like to ask him why the Board of Appeals granted this request. , Mr. Mike 0'Bannon said that when he was on the County Board he went to Mr. Dircz and asked him to buy this additional lot in an effort to get it cleaned up. At that time the taxes on Lot 30 were $20, naw they are $109 for this year. He felt that any lot that is taxed for $109 should be con- _ sidered a buildable lot. Mr. Dircz came before the Board of Appeals and asked if he could not put a small home on it. The Board of Appeals approved of his request, bst from then on it was disappzoved. Mr. O'Bannan felt that when being taxed to that extent, he should have the right to use the property to some advantage to himself. ., Councilman Liebl said that the applicant plans to face the house toward 3rd Street, and the setback would be 35 feet. He did not feel that there would be any trouble with vision while driving. He said that he had inspected this site, and did favor this request last year. Therefore, in ih� absence of any prohihitive ordinance or legislation, of �rhich I can find none, it <<ould be my opinion that tihe Qoard of Appeals can conduct business as ]anc� as a quorun is pr�sent.
