LOT SPLIT REQUEST, L.S. �70-12, BY STJI+�IIT GEAR, INC.: Lot 6, Auditor�e St�: �ri78 -- to split off the South 200 feet of the East 363 feet, the balance of the property has been sold. Mr. H. J. Rohnen of Sumo�it Gear, Incorporated was present. The Plats & Subdivisions-Streets & Utilitiea Subcommittee coa'►vened at 7;OQ o'clock thia.evening aad considered this request. Mr. Schmedeke expl�iaed that the Subcom�nittee recommended approval to split off the South Z00 feet of'the ��st 363 feet of Lot 6, Auditor's Subdivi$ion �78 (location of Summi.t Ge�r Cct.). 1'he balance of I,ot 6, together with Lot 7, was sold to the railroad compr�y. Plannint� Comanissi�on Meeting - October 21, 1970 -- Page 2 The Subcommittee wished to call attention to the fact that the East 33 ^ feet of Lot 6 was being used for Main Street, but the half section does not show it, although the street is in. They felt the deed had been signed but not recorded. However, the City legally owns the property because the road has been there since 1956 and became a public street. Reference was made to Parcel 1900, the 22.5 foot descrigtian gap and the Commission agreed this would be no problem as it is located between Lots 6 and 7.which are under one ownership. They would asaume the railroad company had acquired it. The railroad company was told about the description gap. In orier to get a clear title, the original owner has to be contacted, If he is "long gone" or cannot be located, then the title has to be cleared by the court� Darrel Clark explained they have sold off more than half of Lot 6, �nd }he lot split request wouZd split the land into two pieces. Sumaait Gear Company would still meet all the requirements of the ordinance for setbacks, etc. Sum�it Gear Company sold the land about a year ago but was not aware they k�ad to have a lot split approved before the assessmenta could be split. P.S. �70-04, FIVE_SANDS, BY FIVE SAND As explained by Darxel Clark, the reason for platting is tha�t each btt�ld� ing �vi�.l have its separat� mortgage and assessments. The registrar of deeds would not accept the present descriptions inasmuch as the land ia torrens, Streets and utilities easements cannot be dedicated unless they plat. Accoxd- ing tp the schedule, Phase l is the application for the mortgage. Darrel Clark continued that the Subcommittee, which met previously th�$ evening raised many questions and they are going to ask information from the Citq Attorney. There are two fee awners. NEILSON: Lots 8 and 9, Block 6, Spring Brook Park. Mr. Neilson was unab�.e to be present. /"� Planning Commission Meeting - October 21, 1970 Page 3 The Engineering Assistant said that the reason for splitting is to take a ^ small part of Lot 8 and give that small part to Lots 9 and 10, and then give a small portion of Lot 9 to go with Lots 6, 7 and 8. Back in 1960, �he lots had been split, but the petitioners did not want to use this description atid were asking for a new split, which they fe�t would straighten the �at line. This property is under one ownership and probably will be up for sale. The area requirements are adequate. The Commission commented on the fact that, under the request, the new lot line would be only S feet from the garage and noted the house faced Longfellow Avenue. Considering the amount of land involved, Chairman Erickson suggested a new lot line which would give a straight line to the lots and allow the south�rly tr�ct more room North of the garage. The certificate of aurvey. dated May 26, 1970, presented this evening was designated as "�xhibit A". A line was drawn from the Northeast corner of Lot 8 and marked point "A�" Ca a point on the�West line of Lot 9 located 69 feet North ot the southwest cqrner of Lot 10 and marked point "B". NOTION by Harris, seconded by Minish, that the Planning Commission re�oan� mend approval of Lot Split L.S. #70-13, Duffy Lumber Company by James M• Nei�SOn, attorney, of Lots 8 and 9, Block 6, Spring Brook Park with the following sug- gested change: On the street line running from a point fro�a� the Northeast corner of Lot 8, designated as point "A", to a point on the West line of ,�,o� 9 located 69 feet North of the Southwest corner of Lot 10, designated es poilat "B" as per Exhibit "A" of October 21, 1970; the reason being that unde�' ti�� p�d proposa.l, they did not have enough rear yard setback, and, a1so, the recp�e�ided � chanqe of the Commission would give more area to the southerly site and st�i.�.� acco�pp��sh a straight Iine. The Subcommittee would have liked to walk ove� the �it�� but fe1C that pe�rhaps the petitioner had a reason for requesting tt�is lin�, but on the other hand, Chairman Erickson's suggestion seems to be very agreeab�e. k. PLAI�ITING BOULEVARD (40 FEET) IN MOORE LAKE HIGHLANDS 4TH ADDITION: T The Cq�ission expressed their thanks to Mr. Fitzpatrick, Chairman qf Parks and Recreation Commission, for the informative report on "Trees and Shrubs $est Suited �o Fridley Soil". An item of surprise was tha� the box eld��' and maple were related. Mr. Schmedeke said that he wished to thank the Parks and Recxeation� Aepartment on behalf of the Planning Commission for their time anci e�fprt put into this �tudy. He thought Paul Brown and Ralph Volkman should be congx�tu-- 7.ated. He fel� he learned a lot by reading the report. He thought Che �u�.ld- ing Inspection Department should be given this report for theix uae. He wt►n-� �dered if the City ahould try plgnting evergreen in the Planting Boul�vard, He felt that the Parks and Recreation Commission should make a plan far the area atid suggest ways of accpmplishing it. Darrel Clark ment�oned that the��a � is a c18$s at the high school that does a lot of outside naxur� wo�'k. In Plannin� Commission Meeting - October 21, 1970 Page 4 other areas, there have been cases where there is a credit in nat�ure study. ^ Mr. Fitzpatrick felt the Commission should not only consider a solution to the Planting Strip in Moore Lake I�'ighlands 4th Addition, but consider improving landscaping o� gasoline stations. Chairman Erickson asked if the City had ever given any thought to starting its own nursery. The members agreed that this should be considered by the Parks and Recreation Commission. Mr. Schmedeke passed a�ound a copy of the Septamber and October issue of �,a Cor�s��'vation Volunteer pub�ished by �he State Conservation Aep�rtm�n�t. Rohnen was the representative from Summit Gear Co. attid explained that this property had been sold some time ago but the proper Application was not filed at that time and the assessments could not be divided. fle would appre�- ciate the request� acted on before the end of the year in order for the 1971 tax stat�ent to be corrected. The property sold was Lot 7 and Lot 6 eacept the South 200 feet of the �ast 363 feet where the present building is. The firat sale waa in January of 196g to the Reuter Company and then in January of 1970 this campany sold to the railroad company. �' Mr. Schmedeke asked if the West line would be even with the West line of the Columbia Mill Works property and Drug Supply. He vas seoured it would. Mr. Meissner called attention to Parcel 1900, which is about 22.5 feet wide, located beCween Lots 6 a�d 7. The Engineering Assistant explained that this is called a description gap. As long as the property North and South of the "gap" is undex one ownership, it would not be difficult to acquire the land. This situation is caused by �tarting to survey a piece of land at both ends and, when the middle is reached and the measurements do not coincide, the difference is cal].ed a"description gap". In this case, there is extra land left over and the railroad company owns property on both stdes of the gap. The certificate of survey presented by Mr. Kohnen shawed a 33 fuot ded�.cs►-� tioa for a road along Main Street. Darrel Clark said that the original lot split was recorded in the County in 1960. The land and dwellings are now under one awnership and the owner wishes to sell, but does not want to use the 1960 lot line and is requesting a new lot line. The proposed lot line would meet the sideyard require�ents for the garage on Lot 8, and the land area for the dwelling on Lots 6, 7 and 8 is more than adequate to meet the ordinance requirements. Also, the new line would be straight. There would be no difficulty with the legal description which �.s a little bi� long but very cl�ar. Chairman Schmedeke explained that as long as the owner is the same for both parcels, and the proposed lot line wi11 a�.law sufficient land area to meet th� City Codes, it would seem logical to concur. . PRpPUSED PRELIMINARY PLAT, P.S. 4�70-OG, FIVE SANDS BY FIVE SANDS�_INC.: Generally located South of 79th Way, East of East River Road, Weat Q£ Ch8 railroad tracks and North of 78th Way. � Chai�man Schmedeke reminded the Subcommittee that it was not necessazy to act on the request this evening because it is quite a large project and th� public hearing before the Planning ComQaission is November 4, 1970. Mr. James Kurth, surveyor, represented the Five Sands, Inc. Mr. Zeglen commented he noticed construction of an apartment on Lot 1. Mr. Kurth said that the concept will be built in Phases because o£ financing. When one structure is completed, they will be able to get the money to st$�t anothex', In order to get the assessments for each building, the lots would have to be defined. At the present time, there �re two fee awnexs, Five Sa�3ds� Tnc. and Pearson's Inc.; however, Five Sands, Zne. have a contract to pux�hase a�l the property in the proposed plat. The problem was whether to plat ax' havs a registered land survey. Because the property was torrens, platting was chosen �s easements for streets and utilities would be necee.sary. A map will be available for the Subcommittee at the next meeting showit�g the water system, and they are using underground utilities� Mr. Kurth said, Mr. Meissner asked the purpose of the Outlots. Mr. Kurth explained that an ou�lot is a piece of property which is impossible ta use for normal bui.lding site, and is usually sold in conjunction with the adjoining lot, or is used fox some other purpose than a regular lot. In the proposed plat there a�e ssven lots and three outlots, A, B and C. Lot 7 will be used for a recreation a�e� and will be called a com�non area lot in that each of the unita surrounding Che ^ lot have the right to use the facilities. GRACE HiGH SCHpOL SKATING FACILITY. Three representatives of Grace High School, were present to present their request to the Parks and Recreation Commission, £or consideratian of an agreement, between ^ the City of Fridley and Grace High School, to provide ice skating facilities and a hockey rink, on Grace High School property. The legal aspects of this agreement were brought forward. The Director will investigate this angle. Mr. Mitteco presented Grace High School�s plans to the Commission for consideration. 'Fhis plan included the use of the area for the rink, power for electr�c lights, and power poles for light installation. Mr. Blair expressed interest and his support of this program, if it is legal. The Director pointed out the fact that there is no skating facility, or park property, in that particular section o� Fridley and this facility would serve the neighbor- hood in the evening hours and weekends, and the school could make use of it a£tex school. A general skating area would be included. The Mo�',i.an �a�.i.ed. ANOKA COUNTY REPORT. Mr. A1 Kordiak, Anoka County Commissioner; was present at the meeting, to brief the Commission on the progress and develop�ent made by the County. Mr. Koxdiak explained the County concept on Parks and their purchasing policy, in respect tp land. The Commission wondered if there was any way that the County and the City could work together on purchases of land for parks? Mr. Kordiak explained that ^ the County is interested �n land near rivers, lakes, and streams, qr parcels of at least 200 acres. Mr. Kordiak invited the Commission to contact the County on any future plans to purchase land, and they.would give it full consideratian in respect to mutual use and/or purchase. � October 26 1970. Page 2 Minutes of the Regular Meeting, , H.A.F. RULES AND REGULATIONS. ^ The Commission welcomed two members of the H.A.F. to review and update all rules and regulations concerning the H.A.F. Program for 1970 - 1971. The Director outlined the rules and regulations for this coming year. There were corrections and additions made to this list. Mr. Ingaldson requested better maintenance, having the attendants at the warming houses on time, and also to give consideration to having make up games on Saturday mornings. Mr. Nord explained the divisions, ages, fees, and overall outlook for the program in 1970 - 1971. It was pointed out that there has been a terrific increase in the program over the past two years and the tr3veling divisions are also expanding. A new Midget Division will be offered this year for boys 15 and 16 years of age. The Commission and representatives spent additional time asking auestions and providing general information about the program. 1971 BUDGET. The Director informed the Commission of additions and cuts made by the City Council, to the 1971 Parks and Recreation Budget. No date has been set for the meeting with the Commission and the City Council. WATERWAY NAMING. Chairman Fitzpatrick informed the Commission that a name is needed for the waterway which passes through the Craigway Addition.
