He said they operated � aeveral day centers in the Twin Ci.ty area -- Bloomington, Robbinsdale and Brooklyn Park. They felt there is clearly a need hers, as throughout the �tain City area, for this kind of program. The staff is to be a combination of licensed teachers and child professionals, trained in child care. One of the great needs taciag our country is to solve som� of �he problems of �thers working. Two yeare ago figures ahowed 40X of the mothers were working, it is probably SOX now. Currently, the facilitiea for day care are substandard. 80X of the children are taken eare o� in private homes by unlicensed peaple. Children under the age of five years should be in a_place run by professionals in education'and social work. This is the need they txy to aerve. Mr. Leidich continued, ihe day care centers in Bloomington and Robbinsc�ale were opened in 1970, and they are almost operating at capacity. They are work- �ng with the University of Minnesota doing teacher txa�ning. T'hey feel this is quite an accomplishment in less than a year's t�.me. The name of "day center" is misleading as it ie not a custodial service where the children just play and look at TV. The center is open from 6:30 A.M. to 6:Q0 in the evening. T�af£ic pattern: Parents bring the children to the day center from 6:30 A.M. to about /� 9:OQ or 9:30 A.M. Some come in the afternoon. They start picking up the chil- dren between 3:00 to 3s30 P.M. and it lasts until 6:00 o'clock. The center operates five days s week. 'The access to the center should be close to the flaw of traf£ic from a peraon's residence to their job and Centxal and University Avenues are essentially that. The day center takes up two of the three vacant lpts available on 53rd Avenue and would be a buffer between residential and the laxge commercial area to the East. The building they plan to construct now will have 5,600 square feet with a licensed capacity of 120 children. Centers, such as thi�, are iicensed by the State under the Aepar�ment o£ Welfare and the Fire Marehal's office. They are given �3anitarY guides as they serve meals. The figures quoted earlier regard- i�g the percentage of children under the age of five ye�re in Fridley were gotte� from the Department of Commerce in Chicago: Regarding parking, the aize of the lots is 25,000 aquare feet, 5,600 squar� feet w�.11 be the building and 11,000 aquare feet the play area. The children are in the building BOX of the time, but the playground area has swings, saadboxea, horaea and culverts. The playgxound is fenced, and there would be no children in the parking area. They ls�tve room for twelve to fifteen cars, and provide a circular drive. The procedure is a drop aff one, cuatomers don't leave the cars at the center. It would be better to have the day center Mr. Leidich said that the day care center in Bloomington is across the stx'eet from a supermarket, and it operates there under special u�e permits. It 1s difficult to characterize the day center as either commercia��private school. The fee is charged by the week. Chairman Erickson said that in R-1 District additional facilities were � allowed. Anoka County runs a day centez across the street from Rice Creek School, but it is government owned. Chairman Erickson asked Darrel Clark about the possibility of getting utili- ties. Mr. Clark said that there is water and sewer available some distanice from the �ot. It will have to be a Council decision as to whether or nat it should be �un from the area to the North. There would be no need of a petition for water and sewer unless the use is permitted. The sewer is deep enough, 400 feet from the corner of the property. It goeS North up to Hwy. �694 to a lift station. The sewer stops about in the middle of the Target Store. This wauld not be that much closer to make it preferable. A sewer lift station service along Target Store was designed to take care of this ar�a. The 600 squa�re feet on the second floor of the bui,lding would be used for remedial reading. Mr. Russell Hedge, 649 53rd Avenue (Lot l, B1. 2): He said he owned the hous� adjacent to the proposed building. There is heavy foot traffic through the vacant lots to the Target Store and he wondered if there were any means af elowi,ng it down. Chairman Erickson was told the entrance to the day center would be from the Target side on 53rd Avenue. There ia a ditch through these lots and they are low. If the day center is �toinsz to be built on the two Easterly lots, will the third lot become a catch all? The Engi.neering Assistant explained that there is a culvert on 53rd Avenue. 'Th�t pipe Will h�ve to be either extended to the North to pick up Target or to the East to the existing parking lot storm sewer. Mr. Hedge asked i€ the fence running along the property would continue to the end of the second and third lot.. There is a natural path to Target, and the proposed building will be nearly on it. Hs felt the people would go through the lots even more. Darrel Clark said the Commission was now dealing with a parcel of gruund that had metes and bounds description and not approved by the City Council. There 3s the question of the legality of the lot split which resulted from the apartments being built simultaneously with the platting. Mr. Girdler said that he waA not aware of this problem. Chairman isrickson said tl�at, in order to split assessments, a lot split is requir�d by the City. Evidently what happen�d was that part of the property was sold and parz of the property was never assessed. If this is the case, the owner should be willing to split the lot. Ua�rel Clark said that you really have ta stretch the lot split ordinance to legally fit the lot split division. (Mr. Girdler stated the title was abstract.) Bernard Julkowski had the plat approved but found some title problems and could not record it. The apart�nt house had been built on the premise that the plat wau�d b� recorded aad this parcel ia the result of the apartment house aF11t. Now the description reads "Lot 5, except that part ----°°-��, a m�tes and bounds description. It seemed to him that matter should be resolved. If the Commission and Council desire to act favor- ably on the request, they should put in whatever conditions they want as far as the descriptions are concerned, but he thought the matter of the petition should be considered first. He could not see any sense talkiag about the necessity of f�ling a plat on that one lot until the request for rezoning is re�olved. REESE: Lot 16, Block 1, Revised Auditor's Subdivision No. 10: Rezone from R-1 to R-2 (double bungalow). Mr. Donald W. Reese was present. Chairman Erickson said that he wanted Mr. Reese to be aware af the set- backs required undEr R-2. Mr. Reese said he had been briefed by Mr. Herlofsky, � and that they do not plan to build for a year. He said they had been looking for property for a year. They gave up on zoned property. The realtor ran an ad that this lot could probably be rezoned. Chairman Erickson said that the setbacks on the property on the East has to be considered. All of the houses East are setback further than 3S feet. Mr. Reese would have to have a waiver of the ordinance as he could not be more than six feet ahead of the houses on either side. Mr. Reese said if the rezoning request went through, they thought that eventually they could split the lot into two lots. Chairman Exicksan said there is the possibility it could be done, but thexe would be no room for a street easement. The lot for sale just South of this property has a driveway, but it is only a driveway. There are other problems at the East of this area. There is no sewer on Central Avenue. Water is on the other side of Central, but this line could be extended. There is sewer down the middle of 69th Avenue from Central Avenue to the City Limits. Mr. Reese should retain an easement to go from the_back of the lot out to 69th Avenue. Mr. Minish explained that at the Board of Appeals meeting of July �.3, 1971, there were two requests for a building permit for construction on substandard 1ots, and in this same area are one half dozen more lots in an identical situa- xion. If the Board had acted favorably on them, there would be no basis for not � acting favorably on Qthers. The Chairman suggested the first thing to do in getting atarted on this study is a survey of the substandard lots in the City of Fridley. Darrel Clark commented checki�ng ownership of the lots and whether or not it has been changed. As most of the lots are tax forfeit, it is too bad th� people next door do not see the need for purchasing them. Chairman Erickson said the question of the City allowing tax forfeit lots to be put back on the tax role and then saying to the purchaser "you can't use them" probably would not hold up in court. Mr. Schmedeke felt the lots could be used with a small home built on them. People have built small homes for years. We would rather have these lots back on the �ax rolls. Mr. Clark felt that 90X of the substandard lots are corner lots. A forty foot lat in the middle of the block would nat present as great a problem as a carner lot. Tentative comments: One suggestion was to reduce the required size of the house and set up guide lines. A hardship could be considered if the adjacent property owner refused to purchase. Stipulate how many bedrooms a house could have. Check to see how many 40 faot lots are vacant and ia what zoning district. The City would retain a 20 foot utility easement and rededicate Matterhorn Drive. Chairman Erickson said that Matterhorn Drive has been one of the gaod factors in appxoving the Viewcon proposal. Improving of the street will have to be imperative. Mr. Muhich gave each of the Board members a copy of the Townhouse Ordinance to follaw in checking that all requirements were met. Mr. Wiensch stated that this would be a 141 unit rental project. He said the rent will be about $270 a month plus utilities. He said they will be deeding ^ some of the land ta the City for a park. He said that they will be furnishing some of the park equipment but that the City will maintain the park. He said they would also be putting in some tot lots within the complex. fle also said that all roads within the complex will be maintained by them. Mr. Wiensch said that there would be 288 parkiug spacea including the garages within the complex. The Board asked �f thia was aufficient parking for a complex of this size. Mr. Muhich stated that he had just been checking through the Townhouse Ordinance and parking was not mentioned there so he assumed it would be the same as for multiple dwellings. As these would all be three bedroom units, they would be required to have 2� parking spaces per unit and, therefore, they did not have enough according to the code. Mr. Wiensch stated that it would be impossible to add another 70 spaces. He said that this would take away too much of the green area and that is one of the ways a townhouse differs from apartments in that there is more green area. He said that if they were required to add another 70 spaces, they would have to abandon the townhouse project and put in either apart�nts or else just leave the land vacant until some future time. The Board stated that they glso felt that adding more blacktop area would apoil the image of the camplex but they did not have the authority to approve the parking as it was becauae it did not conform to the code. They said it would have to be checked before a final decision could be made. � Mr. Rova said he would also check with Mr. Reese, another gentleman in the Eirm who had had previous discuasions With the Bngineering Department, to see if parking had been discuesed or if same arrangement had been made regarding parkin.g. Mr. Rova aaid that this is usually one of the things Mr. Reese checks on first. � Building Standards Design Control MeetiaS of August 5, 1971___ Page 2 � In discuaeion of the landscaping it was mentioned that poured concrete curb was required on all blacktop areas. They were also told that a 10' radius would be required on all entries and also suggested that they should try for a 10' radius oa all roads within the complex. Mr. Wiensch said that all the green areas were shawn on the plans. They will have either gas lights or electric lights throughout the parkiag lot. They are getting a rating so there will not be any dark areas and this will be shown on the final plan. He stated that all the outside utilitiea will be under- ground. As far as refuse areas were coacerned, they would all be covered so ao garbage contaiaers would be visible. fle also stated that the water and sewer were in in this area. The townhouses will have ahake siding and asphalt roof shingles. 8ach unit will be 1214 squaxe feet not including the basement. The buildings will be 22 to 24 f�et in heighth. They will be all carpeted, have central air conditioning, built-in appliances, and a full basement with a� bath. The basement will be completely block. The walls will be a one hour firewall. They will have staggered studs with insulating sound board to get a 52 decibal souadproof rating. Mr. Muhich said that when the final plans are ready, he will need 3 complete sets. Also, they would need a performance bond for the exterior work. Mr. Wiensch asked if they zould have a letter of credit from the bank instead of the performance bond. Mr. Simer atated that they had moved to Fridley because they needed more room. Their business had tripled in the last three years and they expect to need an addition to the building in about three years. They would like some additional inside storage, howevex, and would, therefore, like to move in this building fram their old location. �, Mr. Muhich stated that the stxucture was well built. He would also like to add a covered refuse storage area. MATION by White to recoQmead approval of the moving in of the storage shed and also the construction of a loading dock and refuse storage area and poured concrete curbing around the blacktop areas with the follawing stipulation: 1, That there be a three year time limit on the temporary storage shed. She hae also been told that it would mar the appearance of the neighborhood and that it would set a precedent in the area. Mr. D�igana stated he could not see a hardship ia just wauting to•move the workshop. If Dr. Akbar wanted to use the gaxage for another purpose that would be anothex point. He certainly has the ri.ght to add on the 11.5 feet that he is allowed under the code. Mr. Wa11 stated that he felt, because of the points brought out, that it would take a hardship of eonsequence before he could agree to the variance. These agreements referred to the Southern most part of the property which was to be deeded to the City except 160 feet.which could be used as density. Darrel Clark said he understood the prabate court would be ab le to release the portion to the City prior to settlin� of the entire estate. He did not , believe the petitioner was the fee owner yet. Mr. Hoffineyer esplained what information he had ready and said he had ordered a topog of the area but hadn't seen �it yet. The lots are fairly flat and slope down to the river. The development will be 56 townhouse units, nine of which will be along Anna Avenue, the balance will be in blocks of nine and five. There will be a sraimming pool in the middle and green aYea throughout. There will be a two car tuck under garage in the basement, and the laundry and workroom will also be there. There will be a split entry, livin$ room, deck looking over the back towards the river and dining area. The second floor will have a half bath and two bedrooms. The units will be staggered to get as much light and shadow as possible. Materials will be brick with wood infill. Under the present program, they will be rental with the possibility of conversion and then they would convert to a cnndominiwn. They meet the requirements of the land coverage,�iri fact, they were a few units under. � Darrel Clark volunteered that there is sewer and vater in Anna Street, but if it wilJ. be deep e�pu.�h_for the apartments next to the river, they would not know until Mr. Hoffineyer presented his topog. The street is a normal residenti�l street and goes through the center of_the concept. This street could be used for excess parking. They plan to use Linden and Sunburst Locust trees for the area.
