Chairman Ezickson said the Fublic Hearing was still open. Plaaning Comnnission Meeting - ApriZ 4, 1973 Page 2 Mr. Schroer said he knew from the last meeting that the Com�ission /"\ � was aot in favor of rezoning tu R-3 at this time. He said he wanted the ' - Commission to act on the co�mereial rezoning, and coasider the R-3 rezoning after the Comprehensive plan had been approved or disapproved by the Council. He said his main concern was that the Planning Co�nission consider the co�mercial rezoning. Mr. Boardman said as Mr. Schroer is in a hurry on the commercial rezoning, the Planning Commission could act on the C-2 rezoning and deny the R-3. Mr. Sc�roer can act on this part of the request at a later date. Mr. Erickson asked the reason for the 900 foot depth of the C-2 rezaning. Mro 5chroer said they had �un. into problems with 600 foot co�mercial lots. They were too small for a large commercial development, and too deep for a small co�►er�ial development. Mr. Fitzpatrick said his cancera is the different widths of the commercial property in this area. Mr. Schroer said that when Rancher's Road is put in on this property, it will separate the two zonings. Chairman Erickson asked if 81st was dedicated, in writing. Mr. Schroer said he thought it was. Mr. Boar�man said the street is alxeady in on 79th from Beech to Main. This summer, Main to flighway 47 will be put in, and also Main to 83rd. /� Mr. Wayne Wormsbecker, 3200 North Lilac Drive, Minneapolis, said he - owned lots South of the propertp Mr. Schroer wa.n.ts to rezone R-�. He,said his property is zoned M-2 and if this propertq was rezoned to R-3, it could change the setbacks on his property. For this reason he would not be in.favor of R-3 zoning in this area. If it didn't change his setbacks, he wouldn't object. He said they would still be able to build on 40% of their property, but they would have to rearrage the buildings. He said he had no objection to the C-2 zezoning. Mr. Minish asked Mr. Schroer if he wan.ted the Commission to act on both rezonings. Mr. Schroer said he wanted action on the commercial rezoning noW, but he would withdraw the request for R-3 rezoning at this time. MOTION by Fitzpatrick, seconded by �eglen, that the Planning Commission close the Public Hearing on rezoning request, �73-05, by Robert Schroero Upon a-voice vote, a11 voting aye, the motion carried unanimously. Mr. Boardman asked Mr. Schroer what sort of timetable he had on rezoning this property to C-2. Mr. Schroer said between 60 and 90 days< Mr, Minish asked what kind of development the commercial areas would have. Mr. Schroer said he was not at liberty to say at this time, He said there were quite a few restrictions on C-2 property and it would be something /1 that met the zoning requirements. Upon a voice vote, all voting aye, the motion carried unanimously. Mr. Jim London said this will be the Iast of Innsbruck. Phase IV and V Addition for Townhouses will have 62 units in Phase IV and 56 units in Phase V. The plan has been changed samewhat., The new plan will better fit the contours of the land. Chairman Erickson asked how many townhouses there were on the original plan. Mre London said there were 120. Mr. Fitzpatrick said he was confused about the 17% coverage figureo The plan presented looked as if the coverage was more than that. Chairman Erickson by doing some quick estimating, said there were about 80,000 square feet of buildings on a 400,000 square foot site, which was close enough.on a rough estimate, to make him believe the coverage was 1770. � Mr. Minish asked about the status of the single family hanes. Mr. London said there were 15 homes built out of 122 sites. He said they were only developing the lots for sale and not constructing the homese They have sold about 30 lots, but they are not encourageing development this �� � ^ ^ 0 _ _ - -- Planning Commission Meeting - April 4, 1973 Page 4 year because sewer and water are planned for this year and the streets are impassable. Mr. Minish asked how, many of the multiples have been built. Mr. London said 102 units were completed and 8 were under construction. This would make a total of 110 out of the 158 proposed. Mr. Erickson said the Plats & Subdivisions-Streets & Utilities Sub- committee recommended approval of the preliminary plat, and Building Standards- Design Control Subcommittee recommended approval of the preliminary plane Mr. Zeglen said •these townhouses are going to follow the same pattern as in the other phases. Mr. Boardman said the Planning Commission will consider the approval of the final glan and the Council will consider the approval of the fi�nal plat. Mr. Erickson asked about the exteriors of the townhouses. Mr. London said they used Texture lll Mahogany on Phase I, but had chaaged to Masonite R90 on Phase I� and III. Chairman Erickson asked if they had to replace a lot of texture lll. Mr. London said they did. This is why they have changed the exterior material. Mr. London said they use all double wall construction. Mr. Boardman asked Mr. London if he had made plans for any additional parking for the recreational building for the townhouses. Mr. London said they hadn't planned anymore than 14 parking spaces because they felt most peogle would walk to the recreational building. Mr. Minish asked how many units would be using this recreational building. Mr. London said there would be 276 units using it. Chainnan Erickson requested from staff a complete picture o€ all five phases together and copies of the minutes, so they could make a determination on the parking. ' Planning Commission Meeting - April 4, 1973 Page 5 Mr. Boardaaan said it was the recammendation of the Plats & Subdivisions- � Streets & Utilities Subcommittee that the Planning Commission approve the preliminary plat for Veit's Second Addition, with the stipulation that Lot 1 be made an outlot and red tagged until the street proposal concerning 63'� Way is determined. If someone doesn't petition to have the street opeaed, this option will be void after June 6, 1976. Mr. Erickson asked the people in the audience who were here about this preliminary plat, if they were familiar with this proposalo Mr. Harold Becl�an, 6430 East River Road, said this was a proposal when Eva Erickson Riverview Manor was platted. We had fifteen years to ask for the road so we could split our lots on East River Road, and there would be access to our property without using East River Road. I am speaking for myself, and Mrs. Erna Slawson, 6420 East River Road. We do not want the street opened and we do not want to split our lots.� Mrs. Paul Kumhera, 134 63'� Way N:E., said she was against the street being opened because she had enough t�affic by her house now. Mr, Herlin Johnson, 123 66'� Way N,E;, said he didn't want the street ogened because of the additional traffic. Mr. C1yde Ford, 6410 East River &oad, said he was in €avor of the road. He didn't care if it went all the way through but he would like it to go as far as his property. � Chairman Erickson asked if anyone had any objection to the preliminary plat. There was no proposal for a street on this plat. No one had any objection to the plat. Mr. Ford, Mr. Beckman, and Mr. Johnson all said they would like to see the property developed. Londa Englund said she wasn't aware of the street proposal when she made the request for the preliminary plat. She said Mr. Veit was against the street proposal also. She said the Lot l by itself was almost an unbuildable site so they had no objection to it being red tagged. Mr. Fitzpatrick questioned whether they should be approving a plat with a lot that doesn't meet the minimum requirements. Chairman Erickson said they didn't have an alternative as long as that was all the land that was left. MOTION by Minish, seconded by Fitzpatrick, that the Planning Commission close the Public Hearing on the proposed preliminary plat, P;S, 4�'73-04, Veit's Second Addition, by Londa Englund. Mr. Erickson said we could approve the plat and red tag Lot 1 for 90 ^ days to determine if a road easement should be retained on this lot. EXTENSION OF SPECIAL USE PERMLT, SY �71-04, GREEN GIANT HOME AND GARDEN CENTER, POOL CENTER: Located at 7622 University Avenue N.E. Mr. Dave Rick, Store Manager of Green Giant, was present. Mr. Rick said they were proposing to move the pool area to another location on the site. It wi.11 be closer to the road for higher traffic count. They were also proposing to change the fence from a cedar fence • to a chain link fence. Mr . Boardnian s aid the fence shoul.d �remain cedar . _ _ ._ _,_ Mr. Minish asked the purpose o€ changing the fence. Mr. Rick said the chain link fence would be slatted and it would be easier to maintain, --- Mr. Mixiish felt t�e cedar fence wauld follow the architectural theme, as opposed to a chain link fence,. �. Zeglen said a slatted fence only looks good when its first put up. He said as long as this was a garden center they should be able to _plant some trees along the fence and this would eventually provide good screeuing. Mr. Erickson said that what he was most concerned about was that the Special Use Permit was granted on an experimental basis, and this was the second time it was bei.ng renewed. It has gone past the experimental basis, We should know the size of the area being used by the pool center, where the fence will be located and the dimensions of the existing building. Mr. Rick said he had a plot plan that had been drawn up at the request of the Building Standards-Design Control Subcommittee when they had built an addition to the Garden Center for storage. Chairman Erickson asked if that plan had ever been approved. Mr. Boardman said it had not. Chairman Erickson said he didn't think they should act on the Special Use Permit until the plot plat and the location of the pool center had been approved by Building Standards-Design Control Subcommittee. Mr. Zeglen said Mr. Rick could bring this to the Subcommittee meeting on April 10, 1973. CONSIDERATION OF NATIONAL GUARD ARMORY PROPOSAL _ Chairman Erickson asked Mr. Fitzpatrick i£ he had discussed the armory proposal with the Parks & Recreation Gommissione Mr. Fitzpatrick said he hadn't. He said he had come away from the meeting after General Cheeseman was here, feeling that the City would have to be willing to put a lot of money into the armory if recreation facilities were going. to be provided. Mr, Minish said if this was going to be a primary concern in considering the armory proposal, we could put up recreational facilities for a lot less cost than paying for them in an armory. - -�-- -uMr.JP`itzpatrick said the Parks & Recreation Commission is making a comprehensive study of cost in providing recreation and this study could include the cost of providing recreation in an armory. Chairman Erickson asked if anyone on the Commission felt we had a � _____�_,five acre parcel we could purchase for this use that would meet all the requirements the armory must meet. Mr. Fitzpatrick said he thought a site would be difficult to find when Fridley was already so well developed. Mr. Erickson said we are having a problem finding a site for a library. � Mr. Minish said General Cheeseman had said the community has to be in favor of the armory and give it good support. I can't see that strong support coming from Fridley. Mr. Erickson said the proposal was so vague and there was no commitment from the Army. Mr. Minish said it would be five years or more before we would have a definite c�naitment . Chairman Erickson said the City i� involved in Chase Island, the North Park area, the Ice Arena and other projects that are all going to have to find a place in the budget and I don't feel we should lock up a parcel of land for years when we don't know if an armory will ever be located here. Mr. Fitzpatrick said that Fridley will have done its share as a community. Planning Commission Meeting - April 4, 1973` � �.� page 8 MOTION by Zeglen, seconded by Fitzpatrick, that the Planning Commission � recostmnend to the Council that since the City has a number of inter-cammunity projeets already in existence and under development, such as Locke Park, Moore Lake Beach, Columbia Arena, North Park, and Islands of Peace, it would not be in the best interest of Fridley to add the additional facility of a National Guard Armory which would require the purchase by the City of about 5 acres of choice real estate for an indefinite period of time for a use which could be easily provided by one or more surrounding communities whose land availability is such, that their tax base would not be eroded by such purchase as would Fridley's. MOTION by French, seconded by Meissner, that the Plats & Subdivisions- Streets & Utilities Subcommittee waive the reading of the Informal Public Hearing notice for vacation request, SAV ��73-04, for the vacation of two streets and an alley in Block 32, Hyde Park Addition. Upon a voice vote, all voting aye, the motion carried unanimously. Mr. Schmedeke said this item had been continued from the February 28, 1973 meeting because when this vacation request was received, it was noted by the Subcommittee that there was an alley and a street in this same area that had never been used and should be considered for vacation. The Pubiic Hearing notice was sent to everyone within 300 feet of this areas being considered for vacation. Mr. Sct�medeke asked if there was anyone in the audience that objected to the closing of the North/South alley in Block 32, Hyde Park Addition. Mrs. Cecil Marler, who owns Lots 3, 4 and 5, said she had no objection. Mr. Clark said the only other person affection would be Carl Sorenson, who owns Lots 1 and 2, and Lot 10 was a tax forfeit lot, These lots are all in Block 32, Hyde Park Addition. Mr. Clark said if this alley was vacated, the City should retain a 12 foot utility easement. Mr. Schmedeke asked if there were any objections to closing 58th Avenue between 5th and 6th Street on the North side of Block 32, Hyde Park Addition, which was a proposed street in an old plat. � _ �� . ... Half the street was left in Hyde Park, and this is what we are considering for vacation now. Mr. Schmedeke asked if there were any utilities in this street. Mr. Clark said there weren't. There were no objections to this vacation from the audience. Mr. Schmedeke said the next vacation to be considered was 57� Avenue between 6th and 7th Streets on the South side of Block 32, Hyde Park Addition. Mr, Schmedeke asked if there were utilities in this street. Mr. Clark said there was a water main five feet South of the North line of 572 Avenueo Mr. Schmedeke asked the administrations recommendation on this vacation. Mr. Clark said he had talked to Mr. Qureshi who recammended that this street should not be vacated unless we open 5th Street to extend to 57th Avenuea This street should be held for possible opening for traffic. � Mr. Simoneau said his only need for having this street vacated was for a back yard. He said if there were valid reasons not to vacate the street, he would agree with them. Mr. Clark said that once we vacate the street, and then the City decides we need it, the City would have to buy the property back. Mr. Simoneau said he'd rather not put the City through that process. � Mr. Clark said Mr. Simoneau had received permission fram the Council Co fence in this street because it got to be a catch-all and wasn't maintained. Mr. Simoneau said he has made it a part of his yard and that's why he had requested the vacation. Mrso Marler asked if they would be taking part of her yard if the street was put in. Mr. Clark said that they generally only needed a 30 foot street in areas like this. If the City couldn't get any more right of way, or if no right of way was available, we could put in a narrow street, but there would be no parking on it. Mrsa Marler asked if she �- would be accessed for the street. Mr. Clark said the cost was pro-rated half way down the block, but she would have some assessment. In 1970, they negotiated with the City, and the City purchased about half of their property for Meadowlands Park. They have enough land to provide eight 72 foot building sites or six 96 foot building sites. There is about 35 feet between the church's property line and a drainage ditch in the park. They could negotiate with the City to obtain 12 feet from the park azea, so the eight lots could be 75 feet wide, which would meet the ordinance require- ments. What we disagree on is that the City would like to have Oakley and 67th Avenue connected by a road. If the,church was willing to give up land for this road, it would help the traffic flow and the drainage could be picked up at one low point and brought to the drainage ditch in the park. The church would like to have a cul-de-sac on the extension of Oakley Drive and a cul-de- sac on the extension of 67th Avenue. If the cul-de-sac plan is approved, it means having two conduits which will have to be connected by a pipe< I think if the church wauld consider connecting 0akley Drive to 67th Avenue there � wouldn't be much of a problem in getting the 12 foot fram the park to make the . lots 75 feet. I don't think the plat hinges on this however. Mr. Meissner asked what happens to the land to the South of the building sites. We feel this would create a hot rod route. With this proposal we can get eight marketable sites back on the t� rales. If we contributed land for the connection of the two streets, we � would be contributing four or five times as much land as we would get back for the 12 foot strip. Mr. Thompson continued that they would much prefer to contribute the land for cul-de-sacs and purchase the land for the 12 foot strip. We do not want to plat this into six 96 foot sites as 75 foot sites are much more marketable. Mr. French asked�if all that land needed for the cul-de-sacs would be contributed by the church. Mr. Clark said a little of the cul-de-sac on Oakley would come from the park. Mr. Wyman Smith said that if the City feels strongly about the streets being connected, we could delay the platting on 67th A�enue. We feel quite strongly that we don't want the two streets connected. ^ Mr. Clark said you have had a lot of vandalism. Maybe a car driving by once in awi�ile might help with this problem. Mr. Smith said they have had 30 cases of vandalism in the last two years, We thought if we had houses facing the church, this would help the vandalism problem. � Mr. Clark said that fram a development standpoint, people do like to live on dead-end streets. Mre Schmedeke said as he understands this proposal, if the cul-de-sac plan is approved, they would need two storm drains. Mr. Clark an�aered if the storm sewer had to be put in conduit and there are-two cul-de-sacs, then there has to be two piges, one from each end. If the streets were connected then you could have just one collection point. Mr. Schmedeke asked who paid for the storm sewer. Mr. Clark said a small system is usually assessed 'with the street cost. , Mr, Schmedeke said if there was no problem in piping the drainage into the park, the storm sewer wouldn't have to be put in. Mro Clark said that when the water runs into the ditch in the park, if it should cause a problem when the park is developed, they they would have to put in two storm drains connected with a 200 foot pipee Mr, French said he was in favor of the cul-de-sac glane � • Mr. Schmedeke said the cul-de-sac on Oakley Drive would give an entrance to the park and a turn around area for the snow plow. In the platting of Eva Erickson Riverwood Manor, we made room for a possible 40 foot street going between Lots 3 and 4 to give access to the North up to 64th, a street that would more or less parallel �ast River Road. This would give the houses that presently face East River Road a different accesse The petitioner owns Lot 15 and this proposal has one lot that would interfere with this glane If the plat is approved as proposed, it would cut off the access to 64th Way, The easement for the road in Eva Erickson Riverview Manor will expire June 6, 1976. It will then become void if the City does not exercise its option for the right of way. We have sent out notices as late as 1970; and the people in the area have expressed no desire to split their property, or have a street run between 63� Way and 64th, just West of East River Road. Just recently there has been a change made by the improvement of East River Road, in that a median will be put in from 632 Way to Mississippi Street and the driveways will be cut off in•the North bound lane. Mr. Clark said the proposed glat is zo�ed R-1, and while Lot 1 is a large lot, it is only 63 feet in the NoYth/South dimension, and it would be.almost impossible to build a house on this lot under the present re- quirements, even without having a street running through it. DESIGNATION OF o9 MILES OF STATE AID ROADS Mr. Clark said if you are wondering why we are designating State Aid Roads it is as our total mileage increases, our State Aid increases. We are allowed to designate 2d% of our total mileage to State �iid Roads. The advantage of having State Aid Roads are that we collect maney to improve the ' roads and when they are improved, we get money to maintain them. We met with the District Engineer and they gave us their priorities. The first priority was the extension of Main to Osborne and Osborne Road � and 79th. The second and third priority was to connect Rice Creek Terrace • and Osborne Road about in line with Jackson and Monroe. We felt this would have too much impact on Locke Park. We wauld not want to see a bridge built over Rice Creek. Without a park in,the area., this would be a logical place for a road. The fourth priority was a combination of Ly�ic Lane and Madison. �he fifth priority was the extension of 7th Street up to Rice Creek Terrace. The sixth was 63rd and Mo�roe and the seventh priority was Arthur Street. �We have talked it over at staff level and our number one ptiority would be a combination of 63rd and Monroe, and Arthur Street, Both these streets will have to be improved next year. Mr. Meissner asked what the criteria was the State used in making their selections. Mr. Clark said you have to connect two State Aighways, or a State Highway and a County Aid Street, or two Municipal State Aid Streets, or a combination of any of these. Mr, French said he lived in the general area of Arthur Street, and they were having growing pains in this area, Mr. Clark said the more State Aid Streets we have in the vicinity of Mississippi and Arthur, the better the chances were of the City collecting ^ moxe storm sewer money. Upon a voice vote, all voting aye, the motion carried unanimouslyo ' Mr. Bill Nicklow was present. � Mr. Nickow explained that t�y were very short on refrigeration space and the manufacturer suggested installing a freezer that could be attched to the building, Thep would put an additional door in the kitchen that would lead directly to this freezer. The freezer would not be affected by the outside t�perature. The freezer itself would have a white epoxy finish. Mr. i�aravetz said this exterior had been approved by the Building Standards-Design Control Subcommittee. Mr. Minish asked why this freezer couldn't be located on the inside of the building. Mr. Nickiow said the kitchen would be too crowded. It . would be too inconvenient to have �t in the basement. Mr. Minish asked if there was garking in this area now. Mr, Nicklow said no, but the area was blacktagped. Mrs. Wahlberg asked if this freezer would show from the parking lot. Mro Nicklaw said the Building Standards- Design Control Subcammittee has requested fencing around the freezer and the garbage dumpstere Mr. Harju asked what the exterior of the building was where this freezer would be located, He was told it was brick. Mr. Crowder asked if there �ould be any other entrance to the freezer ^ other than through the daor from the kitcheno Mr. Nicklow said the freezer would be permane�tly ghysically affix�d to tha iaall and the only door would be through the kitchen. Mr. Wyman Smith, representing Mr, Max Saliterman, said he wanted to acknowiedge that Mr. Nicklow was n�nning a good restaurant. � ti�. �he Minutes of the Board of Appeals Meeting of April 10, 1973 Page 2 Mr. Smith said it was Mr. Saliterman's concern that there have been requests for additions by this restaurant that would make for violations of the ordinances as pertains to parking, Mr. Soliterman feels if he has to meet the code requirements, Mre Nickow should have to meet the code requirements. Mr< Nicklow said he was forced to add the kitchen. Mr. Smith said Mr. Nicklow keeps using additional space for his building without adding additional parking. Mr. Harju asked how far this freezer would be from the property linee Mr. Nicklow said 10 feet. Mr. Minish said he thought provision should have been made for this when the kitchen was built. Mrs. Wahlberg asked Mr. Nicklow if he would be expanding the kitchen. Mr. Nicklow said he had no plans for that at the present time. Mr. Crowder asked if this was the only size freezer the manufacturer makes. Mr. Nicklow said this freezer was 10 f�aet wide, 12 .feet l:.ng and eight feet high and was a medium size, The manufacturer makes many sizes. Mr. Smith asked Mr. Nicklow i� this would be installed on footings. Mre Nicklow said it wouldn't. He said he could be using this freezer for � 'a�year ox three months or for as long as he neede� it. MOTtON by Walberg, seconded by Crowder, to close the public hearing. Upon a voice vote, all voting aye, the motion carried unanimouslya � Mr, Minish said as this structure will not have footings I don't think it requires a variance8 The only permit they might need is to build the doore � Mr. Crowder said he would be much happier approving a temporary structure than granting the variance that was asked for. Mr. Minish said it would be better if we don't have to grant a variance. If they want to convert this into a permanent stucture, they would have the variance, to put it up within six feet of the property line, Mr. Minish said it is the Board's position that this i� not a permanent structure, it is a movable structure, and doesn't require a variance. MOTION by Harju, seconded by Crowder, to table the request for a variance, and recou�mend"this be considered as a temporary structure. Mr. Minish said when we granted the variance for the Lee Ward sign it was with the understanding the liquor store sign was caming down. Mr. Moravetz said this is subject to change at the present timeo Mrs. Walberg said the only good thing that could came fromnn granting this variance would be that the sign would be full and there couldn't be any more requests. Mr. Peugh said the customer really needs the sign. Beneficial Loan has gotten permission from the landlord to piit u� this sign. I didn't sell this sign, tae customer came to us. Mrs. Wahlberg asked if Beneficial Loan couldn't cut their sign down so it isn't so large, Mr. Peugh said this is the same sign the campany uses all over the country so they want it to be j�;st as it's presented. Mr. Minish asked if staff had ever'diezussed with the owner the removing of this structure and putting up a different type of sign. Mr. Moravetz said we would like to see a directory sign and have all the signs the same size. Mr. Harju said we are not picking on Beneficial Loan but I would like to see the owner have to make some changes for these signs. Mr. Crowder said I don't like that it's first come,'first serve in�a shopging center. I think everyone should have equal rights. Mr. Moravetz said administration can prepare a proposal in the next two weeks and present it to the owner. , Mr. Harju said there is no legal way we can get the owner to agree with a proposal. Mr. Minish said if we turn down this variance, the tenants in the shopping center will put pressure on the owner also. Mr. Peugh said he wanted tha Board to recommend approval or denial of this request, and not table it. MOTION by Harju, seconded by Crowder, that the Board of Appeals recommend to Council denial of the request for placing additional signs on the existing pylon. Upon a voice vote, all voting aye, the motion carried unanimously. Mr. Moravetz said althou�h this is a sma11 variance, the petitioner was asking for a variance and a sma11 vacation of an easement so when�there was a change of ownership of this property there wouldn't be any problem getting a mortgage conunitment. A lending company could refuse a loan on property built on an easement. Mr. Moravetz said we have letters from the utility comganies saying they have no objection to the granting ef a variance or a small vacation. MOTION by Harju, seconded by Wahlberg, that the Board of Appeals receive the letters from the Minneapolis Gas Company, Northern States Power Company, and Northwestern Bell Telephone Company. Councilman Kelshaw mentioned the possibility of a carport, but Mr. Williams 'was not in favor of this.
