Mr. Fitzpatrick said he was still asking for the Iot split. Mr, Boaxdman said the apartment complex does need additional area for parking. Mr. Julkowski and one of the apartment owners did come in to the City offices and discuss this, and the aparment owner was quite vehement about purchasing land for parking only. Mr. Drigans said that in previous discussions, it has been stated that if Mr. Julkowski got the lot split, and rezoned the property, he �ould build eight or ten apartment units on this parcel, but if the apaxtment complex purchased the property, al� they could use it for was parking, because it would be considered as one parcel, and they would need this additional space to meet the present..parking requirements for ��e existing units. f Mx. Fitzpatrick asked if administration has a recommendation. Mr. Boardman said as this property is zoned commercial, if the lot split was -� granted, as commercial �roperty, it would be too expensive for the apartment . owner to purchase, Fox this reason, a lot split at this tima would not be ^ favoxable for any negotiations for purchase of this parcel by the apartment owner. Mr. I.indblad said the apartment owners have had several years to decide ii they want to puxchase this parcel or not. There w�s about 10 £eet af Lot 32 that was at the same grade as his lot, and then there is about a thre� foot drop, which has a retaining wall. He said h�s present garage was right on the property line, and because of this there was no way to get financing on this property. Mr. Mycka said his house, with an attached garage, was about 110 £eet from the present property line so he didn't need �his 10 feet. . Mr. Baardman said the administration has no objection to the lot split. There is a proposal to have an entrance from Riverview Terxace that would turn Noxth at Lot 31 and end with a cul-de-sac. Both these lats will not have access to East River Road and will be sexviced by pxivate drives. It was felt that multiple dwellings or a townhouse development would�be the best use of the area, and the entire area should be developed at one time, Qur major recommendation was that the traffic that would be generated be the main consideration Richard Soj, 65 61st Way N.E., said his home is located on part.of Lot 17 and Lot 18, Block 18, Fridley Park Addition, and his home would be right next doar to this proposed apartment building. He was opposed to the praposal. Mr. Brown asked if this would be approved tonight. Chairman Fitzpatrick Sa�id this wouldn't be approved or denied until it has been seriously studied. Mr. Bxown said he thought more people should be notified of this proposal. Chairman Fitzpatxick said the mailing list of the people notified was a long one, and Mr. Brown was welcome to look at it if he wished. It is just that only two property owners came to the Public Hearing. Mx. Brown said he bought his home in an R-1 district, and ]te has to live there. Could the Planning Commission tell him of any advantages he � would have £rpm this proposal. Chairman Fitzpatrick said that until the development was completely presented, the Planning Commission couldn�t answer that question. Mx. Seledic said this would be one building with underground parking, There would be one underground stall for each unit, and one parking stall ior each unik on the back of the property. The twelve stalls shown on th�e frpnt of the building would be for visitor parking. He said he would need no varxances and will have no parking problems, � Mr. Seledic said there would be 36 one-bedroom units and 33 2-bedxocam units. Mx. Lindblad asked the grice range of the rentals. Mr, Sel�di� said he couldn't say for sure, because it depended upon constructio� �osts, but h� thaught it would be in the $175 to $200 range. Mr. Boardman said they would have to work with the Engineering Department on the tra£fic flaw. � Mr. Harris asked how th� noise £rom tha railroad would affect the geopl� wha lived �.n these apaxtments, Mr. Seledic said he didn�t think it waul.d have too much ��fect. Mx. Selsdic said that at the present time, Anoka County has three different proposals for East Rivex Road. The property the residential homes are located on will be.quite small in its entirety, so if they did decide to sell their pr�perty, or develop it, what could it be rezoned to or used for, that wo�ld b� compatible with this proposal. Mr. �indblad asked Mr. Boardman i£ in any of the propasals by the Caunty for East River Road there were any plans for widenin$ it# so that some of the res�dential area would �e taken by the road. Mx. �oardman said that the right of way has already been acquired fox East River Road in this area. Mx. Bxown said he would like to urge the Planning Commission ta deny this xequast xight now. I think we'd be misleading the pe�itioner to 1et him think this proposal might go thxough. There is no buffex between th� pxopased R-3 rezoning and the present R-1 zoning. This proposal would make my house unlivable and unsaleable. Mr. Fitxpatrick said this area has remained undeveloped. He asked �r. Brown if he cou�d give and reason why this area hadn't been developed R-1. Mx. Brown said it wasn't a very good reason but he thought that one of the reasons.waS because the xoad was unimproved. Mr. Fitzpatrick said � he thought thexe could be a numbex of reasons, one being that it was close /"�. tp the railraad tracks, but on the ather hand, some of the finest homes in Fridley were closex to the tracks. Mr.Arigans;asked Mr. Seledic if he had considered a towrihouse develap- men� for this area. Mr. Seledic said he hadn't. He has always felt tha� an apartment complex was the best use fox this property. Mr. Drigans asked if he had considered, in this type of complex, any type of apartments for th� elderly. Mr. Seledic said, not specifically, but there would be elevators in the building, so iz would be convenient for elderly people. We are not building it with elderly people in mind, at least at the present time. Mx. James Langenfeld, Chaixman of the Environmental Quality Commission, ask�d if there was a need for this apaxtment complex. Chairma� Fitzpatrick said that would be taken into consideration before the final decision is made. In my opinion, protecting the property ownexs who are affected by a xequest is our first.considexation, along with the considexation of the justiiication of the property owner who is making the request. Mx. Fitzpatrick said he was surprised that more of the affected propexty ownexs wexe not present tonight. Mr, Boaxdman asked Mr. Seledic if he had approached any of the owners o£ tho five private homes in this area about purchasing theix pxoperty. Mr, Seledic said he had not. Chairman Fitzpatrick said he was concerned about how this proposal would affect these five property owners, � Mx. Some of the lots mentioned would in fact vacate alleys of private property. Mr. Harris said that if the rezoning request was approved, the intent would be to vacate the entire alley, after the affected property owners had been notified of the request. UPON A VOICE VOTE, a11 voting aye, the motion carried unanimously. 5, FINAL PLAN APPROVAL: WALL CORPORATION: The area generally located on 5th Street and 7th Street from Mississippi Street to 63rd E�venue. Mr. Boardman said the Wall Corporation has not brought in the final plans. As there is no one from the Wall Corporation her� tonight, the final plans are not available. Chairrttan Fztzpatrick said he thought it should be discussed so the Planna.�g Commission has some idea of what the pxoposal zs going to be. Mr. Boardman said that what Council told the Wall Corporation is that they could build 155 units on this property, with the following stipulations; That they provide the same recreational facilities as shown on the axiginal plan; that they solve the drainage problems the satn� as on the original plan; that one driveway on 7th Street be eliminated� �nd ons dri.ve on 7th Street be lined ug with Bennett priveR and there b� limitsd access to Mississippi Street. Mr, Boardman believed tha plan called f4r one entra�ce on Missi$sippi. Mr. F�tzpatriek asked if the zoning wa's still R-1 alang 7th Street. Mr. Boaxdman said it was. � Planning Commission Meeting - June 6, 1973 Pa�e � Mr. Drigans said the Board of Appeals approved a densite of 42.46 for the entire area of both R-1 ana R-3, which would allow them approximately 140 townhouse units. The Council granted the vari<�nce requested which was for 83.units in the R-1 area, an incxease of 20 units, or a total of 155 in the entire area. This gives a density in the R-1 area of 4,246 square feet per unit and for the entire area, both in R-I and R-3, of 3,872 square feet per unit, which is getting pretty close to l:-3 density. Mr. Boardman had the Planning Commission look at the original plan that had 171 units and the new plan for 155 units. Mr. Fitzpatrick said it is mostly a shift in density. Mr. Boardman explained the ponding on the property, and answered questions from the Planning Commission on how this will operate. Chairman Fitzpatrick said as the plans were not available this could just be added to the next agenda without a motion. 6: VACATION REQUEST: SAV #73-10, ROGER CHRISTENSON: Vacate 30 foot road easement on Lot l, and the North 25 feet of Lot 2, Block 6, Rice Cxeek Plaza South Addition, to use for a parking lot for a pro�osed school bus gaxage. ^ Chairman Fitzpatxick said we have a copy of a letter that was received by Council. He asked Mr. Boardman if he knew Council's xeaction to this lettex. � Mr. �oardman said that Council postponed any action. They are waiting fox a xeport from the City Manager as far as the trade-off of some land and an appropriate valuation of this property. Mr. Fitzpatrick said then this is in the hands of the Council. Mr. Boardman said he had talked with Mr. Qureshi, and they both feit that thE best th�.ng to do was to pass this request on to Council, with no actian. Mr. Drigans said the City Attorney has said that the petitioner has a legal right to build on this property. I would like to see what the Cpuncil says about Study Area 4 before this zs sent to Counc�l. We have a variance request the Board of Appeals has pending, waiting tp �ee what Cauncil has ta say about this Study Area. With all the objections to tha.s x�c�uest, I would like to wait for their recommendation. Mr. Drigans said we could deny the vacation, instead of passing it on to Council without action. MOTIDN by B1air to recons3der the mot.ion. The motion died for lack af a second. 7, REVIEW REQUIREMENT FOR SPECIAL USE PERMIT FOR SECOND AUXILLIARX BUILDING: Mr, Harris said he asked to have this put on the agenda because it seems like we have been deluged by requests for everything from second gara�es, who should have a Special Use Permit, to garden sheds. I would like to have some input from the Planning Commission on changing the ordinance in regard to the garden sheds. I.think that small storage sheds could be handled by administration, with a limit put on the size that doesn't need a Special Use Permit. I still feel that second garages and utility buildings over a certain size should require a Special Use Permit. Mr. Fitzpatrick asked if anyone would like to recommend the size that ^ could be allowed without a Special Use Permit. Mr. Iiarris said anything that is small enough not to handle a car or truck. ►r'� Mr. Lindblad said he thought a building permit should be required for any size utility shed. That way administration could control where it was placed on the lot. They should be on the back of the lot. It should be made a requirer�ent that it be properly anchored and stipulate that it be maintained. t[e said a lot of utility sheds are eye sores because they have been blown arpund and are dented and ruste�, but still in use. Mr. Boardman said we don't require a building permit now unless th� building is over 100 square feet or costs more than $150.00. We don't have the staff to inspect the small sheds, If we have a complaint, we wxite a letter to the ownex and tell the owner the shed must be maintained. Mr. I,indblad said that if we had something in our ordinance, you would havQ something to enforce, when thexe were complaints. If they had to anchpr them prQperly, it would eliminate a lot of complaints. Mr. Drigans said this goes hand in hand with some of the requests fox vaxiances received by the Board of Appeals. He felt that notices should always be sent as they are now, but if it is a minor variance, and there are no objections, he felt the variance could be granted by the Board of Appeals and not have to go to Council. This would cut down on a lot af woxk, both by the Administration and the Council., He said he knew we wer�n't elec�ed, only appointed, but we would still pass on to Council anything that there had been any opposition to, or contrvversial, with our recommendation. This could apply to Special Use Permits far auxilliary huildings, when thexe were no objections. The Special Use Permit could be gxanted by the Planning Commission, without going to Cauncil. Mr. Harris said he didn't expect the Planning Conunission to come up with any reconunendation tonight. tie just wanted the Commission to be thinking about this and see what recommendations they might want to make. Mr. Fitzpatrick said he didn't think we had anything for Council� to consider as yet. Mr. Boardman said they could ask for a report from administration on anything that had been discussed. � Mr. Harris said we should come up witli some policy type thing on second garages, and ask Council for a recommendation. Mr. Narris said we only have half the right of way on 61st Way and half a dedication of the road that would go in back of this proposal. We have sewer, water and gas lines in this area which will have to be stubbed or looped back and altered. This should also be a stipulation. Mr. Harris said he wouldn't want to leave dead-end alleys. Mr. French said he felt that any alley that has never been put in, and it was certain they would never put it in, should be vacated. Mr. Harris said the other property owners would have to be notified before the entire alley could be vacated. Mr. Seledic said they lost about 15 feet when the property was surveyed, so they would only have 65 units. There would be one underground parking stall for each unit, plus one parking space for each unit on the back of the property. His company will be building the garage for Mr. Christenson. � Mr. Boardman informed the Board that they were just deciding on the building�s elevations. Due to the fact that Council has not given a final decision on the site location, the Board could not give a final recommenda- tion on the site plan and landscaping. Mr. Boardman said they should decide on the type of building that they felt could be buil� on the Locke Lake site. Mr. Simoneau asked if there were homes located on Main Street, across from the proposed site. Mr. Christenson said yes. Mr. Simoneau thought that perhaps a steel building would not fit into this area. Mr. Christenson and Mr. Coyle gave a brief description of the building. The present design will have a low profile with a pitched roof. Colored steel panels wili be used for the sides. The steel l� a baked on finished and guaranteed for up to twenty years. Mr. Coyle said it is a modular type of construction, where sections are placed together to make the building. The east and west elevations wi11 have three 20' x 11', fiberglass overhead doors. This will allow the buses to drive through the building. The west side will have an additional two 11' x 11' fiberglass overhead doors. Because of these two doozs the elevation was dropped two feet to allow for a continuous running roof line. The Board's main concern was the view of the building as seen from the north side, this wi11 face Locke Lake Mrs.Treuenfels said she talked to Mr. Qureshi last Saturday, and he told her there was a possibility of another site for the garage. ^ Mr. Christenson said yes. There might possibly be a land exchange between himself and the City. He would exchange the Locke Lake site for park land located by the City garage. They use not only steel siding panels, but also aggregate panels and brick. One building they have done in Fridley is Strite-Anderson. Mr. Simoneau asked Mr Boardman if the Board can move to accept this building as is a�d lea've the site plan and landscaping plan up to the City staff. Mr. Boardman said, you will have to decide as a Board if you think a steel building will fit into this area. It is either a steel or brick building that will'be seen from Locke Lake. I prefer something in the order of brick. People have a negative approach when they hear "painted steel garage" as opposed to a''natural brick building". Mr. Treuenfels asked Mr. Christenson if he would consider brick for the building. Mr. Christenson said a brick building gets to be rather e�cpensive just to store �uses in. .� _�, Mr. Boardman said he appreciated Mr. Christenson's concern on the money factor. He suggested perhaps the use of a stone or brick panel could be introduced to the building design. Mr. Coyle showed various plans by his firm using a combination of brick, stone or steel. Mrs. Cariolano asked why they had decided on green panels. She said wasn't that color going to stick out as much as gold, orange, yellow etc. Mr. Christenson said they thought it would blend in with the area, green foilage. Mrs. Treuenfels asked what the owners of the nearby homes thought of the idea of a garage bei�ng built here. Mr. Christenson s aid this is what happens when you build near a light industrial area. Mr. Boardman replied this is why we have restrictions. Mr. Simoneau s aid we have to decide tonight on what type of building we would like to see on this site, and not on the site by the City garage. However, the Board s aid they thought this plan was quite suitable for the City Garage site. Mr. Coyle asked what exactly would be.done at the Council meeting on Monday. Mr. Boardman said the Council will decide on the variance and vacation requests as these items were not finalized at the subcommittee levels. Also ^ the land trade will be decided on. Starting from East River Road and going towards the tank, the plan has three areas: 1) trees SO feet and over, such as marshall green ash, skyline and imperial honey locust; 2) trees 30 feet and un�r, such as white ash, red maple, Russian olive, Japanese lilac and flowering crab; 3) vine covering on the fence. This plan would hide the tank from view of the motorist on East River Road and also help keep the sound level down. Mrs. Treuenfels felt that some deciduous trees would be nice for year around foilage and protection, especially closer to East River Road. Mr. Simoneau said the Russian olives in the second group o� the plan are a good size bush year around. Mr. Boardman said deciduous trees have a hard time with the salt on the streets in the winter. He also said as the trees get older, the foilage on ,^ the bottom dies, leaving a bare trunk. Mrs. Treuenfels asked if the evergreens could be put in the second row of the landscaping plan. She recommen�ed a yew tree. b4r. Westerberg said a blue spruce would also work. Mr. Boardman said some blue spruce planted�in the second landscape area would be fine. He also asked what type of ground covering would be used. He said he wasn't sure if sod would be feasible in this area. Mr. Westerberg said they did not have the facilities to water and with so many trees in this area, if sod would be able to grow. Mr. Simoneau said any area in Fridley will go back to its natural coverage in a few years unless physically maintained. Mr. Boardman suggested to use sod and if not feasible work some other landscape coverage out. He said possibly a nursery could recommend some type of ground vine. A vine covering could also be used on the slope when the road goes through. Mrs. Treuenfels asked about berming around the tank. Mr. Boardman said there is a three foot berm. Mrs. Ledo said that there were semis and tankers and flat beds and a11 ma,nner of txucks like that. She said that even though they moved the tankers, the semi.s were� parked all over the propexty, every which way, and even in the alley, which i.s naw xutted frosn the trucks being there. She said that the neighborhood kids started pl��ing araund the trucks and �vere playing with matches under one big truck. Mr, Crawder asked if the Ledo's used the alley and Mr. Ledo said no, the City doesn't mai.ntain it because it was never improved but some neighbors do use it. Mrs. Ledo sai.d that the trucks weren't in the alley now and hadn't been for the past week. Mr. Crowder asked if there were anyway the neighbors could live with this situation for 6 to 8 months or a year. Mr. Ledo said yes but not the early morning and late night noise. Mr. Gary Novak, 5315-4th Street, got up and said that he didn't get a notice of the meeting but that he was awakened at night from across 4th Street by these trucks and that �.t was very bad they were there. Mx. Crawder asked if the Ledo's had air conditioning. Mr. Ledo said no. Mr. Crowder said then your windows are open during the summer and Mr. Ledo said yes. Chairman Drigans asked Mr. Fine how large his property was and Mr. Fine said he thought abaut 40 feet by 120 feet each. There was same discussion from the floox about the property limits. j�ix', Castonguay was asked how many different kinds of trucks would be using the prpperty. Mr. Castonguay said every kind af truck imaginable. There was further diacu$sion from the floor about kids, control, parents, and tXespassing. Chairm�a,n Drigans said he didn't understand Mr. Castonguay's brother not being present, and Mz. Castonguay said he thought the man whose name was on the lease was the one who h$d to appear. Mr. Peteraon, owaex of the lots to the North, said from the floox thaC he di.dn�t mind the trucks being on the first 30 fe�t or so of his property but if h� deci.d�d to charge rent, did he have to get pexmiaeion. Ghaixmait Arigano said yes. Mr, Crawder asked how far his property extended and Mr. Petexson said he had eight 40 foot lots n4rth of Mr. Fine's three lots.
