He said that the first Council meeting.of the year would be an January 6th so he thought the 7tr� would be a better date. He asked the other mem�ers v�hat they thought of ineeting on the 7th. � Mr. Harris said the regular Planning Commission meeting was schedule� for January 8th. He asked Mr. Boardman what was scheduled for that meeting. AZr. Boardman said as far as he knew there wasn't anything on that particular agenda as yet, and it was too late to schedule any Public Hearings for that date because of the time needed for publicatior. Mr. Harris said he would have no objection to having this joiri4 meeting on the 7th, if they didn't have another meeting on the 8th. Chairman Fitzpatrick said as long as the regular meeting of the 8th could be cancelled, Yie thought the 7th could be set as the date for the joint meeting between �he Citizen Bikeway Committee and the Planning Commission and Parks & Recreation Commission. ^ 3. Approval of the minutes of the November 21, 1974 meeting will be made at a future meeting. 1. CONSIDERATION OF A RE UEST FOR R SKYWAY AND STOREROOM ADDITION: LOCATED AT 500 OSBORNE ROAD, FRIDLEY �4INNESOTA. RE UEST BY UNITY HOSPITAL, 550 OSHORNE ROAD, FRIDLEY MINNESOTA Mr. Peter Kramer from Construction Coordinators and Horty-Elving Rrchitects and Albert Eilers from Unity Hospital and Health Center were present to represent the request. Mr. Kramer explained that this was the connecting link between the new office structure now under construction and the hospital. The project involves an addition to the storage area on the hospital, a stair and elevator tower, and the actual skyway connecting the two structures. The storage addition construction will match tf�e hospital in color and the skyway will be of the same texture as the horizonal lines of the hospital, an off white. The estimated cost is $185,000. The skyway and one story storage addition is being financed by the hospital and will be maintained by the hospital. It was pointed out by the Board that there must be a 13 faot clearance between the driving surface and the bottom of the skyway of which the contractor had already made plans for. MOTION, by Simoneau, seconded by �telson, to recommend appraval of tMis proposal with the following stipulations: l: An agreement between the North Suburban Hospital Distriei and the group of doctors who will own the three acre tract, on the maintenance and use of the skywalk, or the use of the parking lots and driveways, be drawn. 2. If any additional v�rater mains, sewers or storm sewers become necessary, the entire cost be borne by the North Suburban Hospital District and/or the owners of the medical building. � 3. The North Suburban Hospital District agrees to work with the City to establish a park in the area. 4. Proper signing be provided by the North Suburban Hospital District to direct traffic to and from Osborne Road N.E. 5. Complete the 50 feet of buffer along 75th, Lyric, and 5th Street which shall consist of a berm and planting to screen the parking lots from the residential areas. _ 6. ido tree removal ajithout City approval. , 7. Any future parking areas be provided with a berm or screening from the adjoining R-1 areas presently occupied by single family homes. 8. The medicai bullding wlll be limited to occupation and uses as stat�cl in � a letter from the Unity P�ed�cal Center of September 6, 1973 which states that this buildtng shall be limited to health professionals whieh•u�i11 inclu�L, but not llmited to, physicians, den�ists, aral surgeons, clinical psych�logists, psychiatric social workers and allied mental health personnel. AncYllary uses other than office space shall be limited to those commercial enterprises designed to serve the doctors and dentists and their personnel and patients. Such ancillary uses would include things such as a professional �pharmacy, an optical company, possible a card and flov�rer shop, and possibly at a later date, a coffee shop. 10. Dust abatement procedures be taken to keep the dust down�during cnn� struction. ,_� 11. Contractor be responsible for garbage and waste removal on the overall area during the construction period by providing large containers that would be regularly emptied by pick up. �- 12. Additional parking be provided if deemed necessary by the City. 13. All garbage be stored inside the building. 14. Work with the Engineering Department in setting up a workable storm water runoff plan. 15. There is to be a 13 foot clearance betw�en the driving surface and the bottom of the skyway. MEMBERS PRESENT: Blair, Caldwell, Harris, Peterson and Wagar OTHERS PRESENT: Paul Brown, Director of Parks and Recreazian Department John Caldwell, 5847 Hackmann Ave. N.E., Fridley, 788-6973 Vi.sitor . MOTION by Wagar, seconded by Caldwell to approve the Minutes of the Parks and Recreation Commission Meeting, dated November 25, 1974o The motion carried. PASSOUTS Director Brown passed out three articles for the attention of the Commission: 1.� Snowmobile Ordinance. 2, Park Map of City. .'.. Ski Flier. These articles were passed out for general information to the Con^�ission members. Chairman Blair passed out and introduced a�ikeway Committee Study. �This is a preliminary plan for Bikeway system that will involve Fridley. Many of the trails wauld move through our town. The copy is for the Commission's own personal use and to be updated with additional memo's and material on this subject. Chairman Blair expressed co�cern over the fact he is l��oking for m�re detailed information from the Committee and hopes that the city does some research into what other surrounding communities are doing in respect to a Bikeway System. ^ DIRECTOR'S REPORT � Director Brown then reviewed the following items that were distributed during the month to the members: � 1. Hockey Association of Fridley practice schedule. This outlines the number of teams, where they will practice and at what rink and at what time. � 2. Ice Skating Rink Survey. A two page report outlining the existing skating rinks in our suburban area. The Commission members were also interested in finding out what communities provide overtime work schedules and also if these areas have shi�t changes with their maintenance staffs. 3. Fridley Xouth Football Association. The Commission is reminded of the meeting that the members will have with the F.Y.F.A. in January. At this time the Commission and their Board members will review the football program both boys tackle and girls flag sections. 4. Girls Flag Football Rules. A revised draft copy of the 1975 Girls:Flag Football rules were reviewed quickly by the members. It was decid.ed to review these along with tackle rules and regulations at the January meeting with tlie F.Y.F.A. Board. 5. Hockey Association of Fridley Rules and Regulations for 1974-1975. Ch�irman, Blair objected to the section of the rules that had to do with penalty time andiwho . �would serve the penalty time when line changes occur. All members are asked to be present. Department secretary will call all members to remind them. KARATE CLASS Chairman Blair stated that they have not heard from the Karate Teacher. The Commission tvishes to meet with him at their next meeting if possible. Director Brown will try to contact the teacher and get a confirmation. MEETING CHANGE Due to confl.ict, the Parks and Recreation Commission Meeting scheduled for Monday, January 27, 1975 will be rescheduled for bionday, January 20, 1975 7:30 p.m, at Fridley Civic Center, Community Room. He said that they would be purchasing an additianal 50' to the south in order ta buiid tF�is building and still allow room for future construction of more storage space. Mr. Boardman stated that the petitioner wi�l be going before the Board of Appeals on a front yard, side yard, and rear yard setbaek. t-1r. Burah said that they were no longer requesting the variance on the rear yard setback. Ne said that the City wants a 44' easement across the rear flf the property because of an unrecorded se�{rer�line, He said that it would also be used for storm water drainage. Because of this, they will just keep the building back the required 50`. Mr. Tonco asked if the L-shape configuration would change beeause af the setback? Mr. BuraM said that it wauld because the L-shape at a 50` setback- would hin:der the future construction of additior�al storage units. Mr. Lindblad asked what material the structure would be bu�[l� with? Mr. Burah said that it would be a textured block with cedar trim. It wi11 have pilasters spaced a.t about 20' increments. � Mr. Tonco asked if they would be willing to paint the concrete block? ; Mr. Burah said ihat the texture of the block gives it a �vhite or egg shell eolor. Tnis is the main reasan they were going with this more expen- sive block, than just a regular concrete block. Mr. Lindblad felt that if the block color is develaped with the block texture, it would be an unnecessary expense to require the painting of it. Boardman stated that they should establish well defined parking area� �hich presently do not exist. 7his could be done in front of the existing building and still allaw approximately 15 i'eet for planting and landscaping. He also said that parking and driveways should be kept 5 feet off of the praperty line. Mr. Lindblad stated that our code requires poured concrete curbing around all blacktop areas and would want to have this done also in fron� of ih� existing building. Alsa, that the d�iveways have to be a minimum width af 25 feet with 10 X 20 stalls. A 10 foot radius must 6e provided -for entrance - drives. � �1 Mr. Tonco ask�d Mr. Burah if he understaod the Baards requ�st and if he agreed ta the changes on the plan noted in red. Mr. Burah said that he could not see any real prob1em Zn the changes and that they wan�ied to do everything they cauld to have a nice area. �4r. Tonco asked Zf there wi11 be any outside storage? Mr. Burah said that the main purpose of the storage buzlding was to eliminate outside storage. It is a Federal requirement tha� the starage baxes which are presently outside must be kept inside a protected building. That the parking and driveway on the south and north be kept 5 feet off the 1ine. 3. That a we11 defined parking area in front of the existing building be provided in conjunction with a landscaped area. 4. That poured concrete curbing be put in along a11 black top areas within the front yard area. 5. Additional plantings be provided as per approved plan. CONSIDERATION OF A PROPOSED PRELiMINARY PLAT, P.S. #75-01, CENTRAL VIEW MANOR 2ND ADDITION, BY REALCO, INC.: A replat of that part of the SE 1/4 of the NW 1/4 deScribed as follows: Commencing at a point on the Easterly line of the NW 1/4 of Section l2, which point is 726 feet South from the Northeast corner of the SE 1/4 of the NW 1/4, thence running Westerly1338.6 feet to a point on the West line of said SE 1/4 of �he NW 1/4 of said Section 12, which point is distant 726' South from the Northwest corner of said SE 1/4 of the NW 1/4 of said Section 12; thence running South along said West line a distance of 140 feet; thence running Easterly to a point, which is 140 feet South from the beginning, thence running North along said East line of said NW 1/4 of said Section 12 to point of beginning, generally located between Central Avenue N.E. and Highway #65 N.E., North of 73 1/2 Avenue N.E. Mr._W. G. Doty of Realco, Inc. was present. Mr. Clark said that presentiy this long narrow lot is owned by two people. The Easterly portion is owned and occupied by Gustavson Grinding. The Westerly portion is owned by Sheldon Mortonson. About a year ago, this body approved a lot split on this property by the now defunct American Auto Listings� Mr. Clark said that Central Auto Parts, who own lots 10-15, Block l, Cen�tral View Manor, are contemplating purchasing what will be Lot 2, of this proposed plat, so they can enlarge their storage yard, if the plat was�.approved. Mr. Clark said that when this plat goes to the Planning Commission, Central Auto Parts will also be reqaesting rezoning an the Westerly 60 feet of this same Lot 2 be rezoned from-commereial to industrial, so Lot 2 will have all the same zoning. They will also be requesting a Special Use Permit on Lot 2�o enable them to use this property for the expansion of their storage yard. Mr. Clark continued that administration felt this was a logical division of this property. Lot 2 would not have street access but as it was going to be purchased by Central Auto Parts who have access to 73 1/2 Avenue, this should not be a problem. He �� Plats & Subs -St & Util Sub. Minutes - January 15, 1975 Paqe 2 said that Mr. Doty originally wanted to handle this as a lot split, but it was felt �that the legal descriptions would get too lengthy, so he was advised to plat instead. He said they did cor�sider replatting this all as Central View Manor, but this wo�ild have involved about a dozen signatures, and by platting this as a new plat, it only involved two property owners. Mr. Clark said the only comment th�t staff had was that the City would need some drainage and utility easements. These should be along the Northerly portion of Lot 2, and North and South between Lots 2 and 3 and the South portion of Lot 3. The property to the North of this plat all drains down to 73 1/2 Avenue. Ihere is a drainage ditch that �oes up to 73�1/2 Avenue which doesn't handle much water now, but it�will after t�is plat is developed. He said tfiat as far as the zoning on commercial, Lot 1 was industrial, and lot 60 feet, which Central Auto Parts will be to industrial. this plat was concerned, Lot 3 was all 2 was all industrial except the Westerly requesting to have rezoned from commerical Mr. Harris asked if there was some way to tie this Lot 2 to the property to the South, to ensure that they weren't platting a lot without street access. Mr. Clark said that maybe Mr. Doty would know of a way, or else the City Attorney could advise on that problem. Mr. Doty said that this plat evolved so they could sefi�l Lot 2 to Central Auto Parts, arrd if they don't buy this lot, then we won't proceed with the platting. He ^ said that before the final plat was approved, Central Auto Parts would be coming : before the Planning Commission on the 22nd of January on their request for rezoning and a Special Use Perm�t. This seems the only log��cal use for this property, otherwise ihe land was worthless. � Mr. Harris said this Lot 2 would be a land locked lot so that's why he was concerned. Mr. Doty said he could see Mr. Harris's point, but the only reason for the plat was to facilitate selling this parcel to Central Auto Parts with a simple legal description. Mr. Meissner said the problem he sees was if five years from now, Central Auto Parts goes defunct, or needs to reduce in volume, it would leave this Lot as a separate legal descrip tion. Mr. Doty said that if that happened, that no one would buy this property except ad�acent property owners who already had street access. Mr. Harris said that this wouldn't preclude someone else buying and demanding that the City give them street access. Mr. Clark said that what the Subcommittee wants was some type 6f document that could be filed at the County to tTe Lot 2 to the balance of Central Auto Parts property. He said this could probably be done with a private covenant. Mr. Doty said he was in agreement to having a pri�vate covenant on the plat, but he would rather have it say that it couldn`t be sold to anyone who didn't already have street access. Then the owners of Lot l and Lot 3, plus the owner of "the property to �he North could purchase it, if Central Auto Parts should want to sell this property � in the future. " Mr. Meissner asked how this plat was served as far as utilities were concerned. Mr. Clark said Lot 1 was served from Central Avenue, Lot 3 was served from Highwa� #65, and Lot 2 was going to be used as a salvage yard and wouldn't need any additional Plats & Subs -St & Uti1. Sub. Mr. Clark said this was pretty good land, it was not swamp, and if the 1'ot did go tax forfeit, he would assume that one of the four adjacent property owners would want this lot. � Mr. French asked how wide an easement the City wanted on these lots? Mr. Clark said fifteen feet should be sufficient. Mr. Mea�.ssner asked if all the easements would be on this plat. There may be fututa expansian onto �.he commercial property and in that case they would have to rezone and they would 1i.ke to know that this would be looked favorably upon. ,�There is a state aid road desiqnatian that would connect onto Main Street that could not be put in if the plant is allowed. Their representatives, Mr. Robert Olson, Jr. and Sr. are present ton;ght. Mayor Kirkham said that this would be an excellent opportunity to close the access to Mississinpi Street. The advantage would be to keep traffic out of the residential area. This would help to keep the residential area to the south residential only. The City Enginee, said that he has reviewed their plan and they want to be sure they would be welcome in Fridley and if they move�into the City, they would not have any future problems. Their business makes no noise or smoke and there would not be a heavy amount of traffic generated. The truck traffic would be . � very minimal. Councilman Breider asked if they do any plati.ng. Mr. Robert Olson Sr. said no. The painting and plating is done by other contractors. Councilman Kelshaw asked what size the txucks would be. Mr. Olson Sr. said normal trucks would be � hauling materials in and out. There would be 4 to 6 trucks a day. Occasionally there would be a flat bed coming in, but that would not average one a week. The trucks would be smaller trucks and most of their traffic would be to Onans. He said that the satisfaction of Onans with Fridley is one of the reasons for their proposed relocation in Fridley. He said that they would not be coming in here if they did not think they would mak.e good neighbors. They want to maintain the wooded area and they intend to keep the truck traffic toward the railroad riqht of way. They.did not intend their plant to be an eyesore. Councilman Liebl asked if the street would not have to have a Public Hearing for the vacation. The City Engineer said that the street right of way was never acquired, so it would just be a matter of taking off the state aid designation. Councilman Harris said welcome to the community and that it sounded like they would be a good neighbor and an asset to the community. The City Engineer said � that if they expand in the future to double their building from their proposal � on Page 20 of the Agenda,-100' of the k�uilding would be on commercial zoning and would necessitate rezoning. Councilman Breider wondered if this Council could commit themselves until the xezoning was completed. Councilman Harris said that,they hoped to grow to utilize the property. He was sure that they understand that the Council would be bound to go through the legal procedure of the Public Hearinq for the rezoning. Mr. Robert Olson Sr. said that after the rezoning, there would still be about 150' of commercial area left open. He added that they are still about two years away from construction. The gentleman who owns the property to the west is present in the audience. The City has been working to develop park land east of Central. The City does own parcels to the west. He recommended that the first reading be gone through again. . Mr. Floyd Foslien, 3345 University Avenue N.E., said that he was at the Plan�ing Commission Meeting some time ago and this is new to him. He got a call last week asking about tiie property. He said that he understood that the rezoning was contingent upon Mr. Edward Perry obtaining his land. He said that he does own land adjacent to his. He believed that it was Outlot #1 that the City was interested in obtaining. There are two lots ne.ar there that are high ^:nough to support housing. He said that he mention to Mr. Perry that maybe something could be worked out if his interest was rezoning the land adjacent to his. If there is interest, he would get in touch with him. The City Engineer showed the whole area on the overhead projector and ex- plained that the area shown in green is the area the City is interested in for park land. Councilman Harris said that this land is unbuildable for homes, and that it is beautiful land. Mr. Foslien said that Lots l0 and 11 could be used for building homes. The City Engineer said that if Mr. Foslien is willing to proceed and give the necessary land, he should make an application for rezoning and the City would work with him to get control of Outlot l. He said that his recom¢�►endation is to deny the time extension request and go through the first reading of the Ordinance again. Councilman Flarris asked how big the parcel of land was that Nir. Foslien had. Mr. Foslien replied that it is about 200' wide. The Acting City Manager asked how long after the Public Hearing could the first reading be held. Can the first reading be held again without another Public Hearing? The City Attorney said that he would think that it ��aould require another Public Hearing. The Council has been using the policy of 6 months between the first and second reading. tie asked when the first reading was. Councilman Liebl said that it was in October, 1969.
