RES 1959-101 - 00013136RESOLUTION NO. 101 - 1959 A RESOLUTION DETERMING THE NECESSITY OF AND PROVIDING FOR A TAX LEVY IN EXCESS OF NORMAL CITY CHARTER TAX LIMITS BE IT RESOLVED, By the Council of the City of Fridley, as follows: Section 1. That the Council of the City of Fridley heretofore received from the City Manager a proposed budget of the City of Fridley for the year 1960, which proposed budget when examined evidenced the necessity for and additional tax levy in excess of the City charter limits and, accordingly, there was then adopted on the 23rd day of July a resolution declaring the necessity for an additional tax levy and specifying the purpose for which such additional tax levy is required. FURTHER,'upon the receipt of such proposed budget and the adoption of the resolution dated the 23rd day of July, the Council proceeded to hold a public hearing pursuant to three (3) weeks published notice,in the official news- paper of the City, setting forth the contents of the resolution noted herein. That such public hearing was held ai the`l7th day of August, and all persons interested therein were afforded an opportunity to be heard and make objections, if any there be, to the budget as then pro- posed. That after such hearing and after full discussion of the contents of the budget and all objections thereto the Council further proceeded to correct and amend the budget in such way as was deemed necessary by the Council to be in the best interests of the City; and after such corrections and Admendments the Council did pass and adopt by Ordinance on the 24th day of September a budget City of Fridley for the operation of its business during the year 1960, a copy of which budget is attached hereto for reference purposes as EXHIBIT "A ". for the SECTION 2. Further, upon the examination of such budget originally proposed, corrected and amended and adopted by the City of Fridley on the 24th day of September, it reasonably appears, and the Council does now so find that the tax levy necessary to provide moneis for the operation of the business of the City of Fridley during the year 1960 under saidbudget is and will be, when computed in accordance with law, inexcess of the normal City Charter limit of thirty (30) mills on each dollar of the assessed valuation of the property taxable in the City but that, nevertheless, it is reasonable and to the best interest of the City in order to provide for the proper operation of the business and functions of the City during the year 1960, to exceed such normal City Charter tax levy limit, and to levy taxes thereof sufficient to provide the monies necessary to the operation of the business of the City in accordance with said budget. Section 3. That to provide money in accordance with the needs and purposes of the budget of the City for the year 1960 taxes shall be levied in accordance with law J RESOLUTION NO 101 - 1959 Continued SUFFICIENT to provide monies in the following amounts and for the following purposes, and no part or portion of any monies provided for any purpose herein shall be appropriated to and used for any other purpose, except as might otherwise be authorized by law, either under the general law of the State of Minnesota or the City Charter of Fridley.
