RES 1959-112 - 00013151RESOLUTION NO. 112 - 1959 A RESOLUTION AUTHORIZING DISPATCH AND USE OF FIRE DEPARTMENT EQUIPMENT ' BE IT RESOLVED, By the Council of the City of Fridley, as follows: 1. That the Council finds that instances have occurred in the past and can be anticipated to occur in the future wherein there is danger from fire, hazard, casualty and other similar cause tothe City of Fridley, its residents and the public generally within and without its limits, by fire, hazard, casualty or other similar occurrence taking place or occurring outside the territorial limits of the City of Fridley; and that by the suddenness thereof it is impossible or impractical for the Council of the City of Fridley to meet and authorize the despatch and use of City fire department equipment and personnel to combat such fire, hazard, casualty or other similar occurrence. 2. The Council finds it is desirable and necessary therefore to authorize the Fire Chief of the Fire Department of the City of Fridley and, in his absence or unavailability, the Assistant Fire Chief to act in such occasion. Accordingly, each of the above named officers is hereby directed and authorized to exercise his own discretion, considering at all times and in each case the internal needs of the City of Fridley and its inhabitants, to despatch and use Fire Department equipment and personnel of the City of Fridley in such place and for such time as he deems necessary to combat such ' fire, hazard, casualty or other similar occurrence to the interests of the City of Fridley, whether such fire, hazard, casualty or other similar occurrence takes place within or without the territorial limits of the City of Fridley, and it is hereby provided that such despatch and use as directed by such officer shall be fully authorized as an act of the City of Fridley, and all provisions for compensation of personnel, rental or equipment, liability insurance coverage, work- men's compensation insurance of the City of Fridley and all other safe- guards and matters pertaining to the Fire Department, its equipment and personnel shall apply in each and every such case as if specifically authorized and directed by this council at such time, whether or not the governing body or authority of the place in which such fire, hazard casualty or other similar occurrence has previously requested and provided, for fire protection and the use of the Fire Department equipment and personnel of the City of Fridley, under a mutual protection agreement or other type fire protection agreement with the City of Fridley. Further, such officer shall recall, order and terminate the use of such equipment and personnel from such place and at such time, when the need for their use shall no longer exist, or earlier, when it shall, in his discretion appear in the best interests of the City of Fridley that he do so.
