RES 1960-138 - 00012877i RESOLUTION NO. 137 -1960 A RESOLUTION RECEIVING THE PRELIMINARY REPORT AND CALLING A PUBLIC HEARING ON THE LATTER OF THE CONSTRUCTION OF CERTAIN IMPROVEMENTS: (WASHINGTON AND JEFFERSON STREETS — 58TH TO 59TH) WHEREASO the construction of certain improvements is deemed to be in the interest of the City of Fridley and the property owners affected thereby. ' BE IT RESOLVED By the City Council of the City of Fridley as follows: 1. That the preliminary report submitted by CometBck and Davis, Inc., Consulting Engineers$ is hereby received and accepted. 2. That this Council will meet on the let day of November 1960, at 7:30 o'clock P.M. at the City Hall in the City of Fridley for the purpose of holding a public hearing on the improvements noted in the Notice attached hereto and made a part thereof by reference., ESchibit "A ". 3. That the area proposed to be assessed for said improve - ments and each of them as noted in said notice are all -the lands and areas as noted in said notice: All of the same to be assessed proportionately according to the benefits received. 1�. That the City Manager is authorized and directed to give notice of such Public Hearing by publishing a notice thereof in the official newspaper of the City of Fridley according to law, such notice to be substantially in the form and substance of the notice attached hereto ' as Exhibit "A". W erw`� ATTEST: � CITY C — Marvin Co Brunsell RESOLUTION NO. 138 — 1960 ' A RESOLUTION ORDERING IMPROVEMENTS., ADVERTISEMENT APPROVAL OF PLANSj, AND ORDERING FOR BIDS WHEREAS, the resolution of the City Council adopted the 20th day of September, 1960, set the date for hearing on the proposed improvements, as specifically noted in the notice of hearing att- ached hereto for reference as EXHIBIT "A ". and# WHEREAS., all the property owners whose property is liable to be assessed with the making of these improvements (as noted in said notice) were given ten (10 ) days published notice of the Council Hearing through two (2) weekly publications of the required notice.. and the hearing was held and the property owners heard thereon at the hearing., as noted in said notice. NOW., THEREFORE2 BE IT RESOLVED by the Council of the City of Fridley, Minnesota, as follows: 1. That the following improvements heretofore proposed by Council resolution are hereby ordered to be effected and completed as soars as reasonably possible, to -wit: (a) All of the improvements as noted in the notice of hearing eki the same as are noted (in Exhibit "A" in said notice) except (none): that the work involved in said improvements as listed above shall hereafter be designated as: STORM SEWER PROJECT NO. 40 -1960 2. The plans and specifications prepared by Comstock and Davis, Inc., Consulting Engineers, for such improvements and each of them, pursuant to the Council resolutions heretofore adopted, a copy of which plans and specifications are hereto attached and made a part hereof, are- hereby approved and shall be filed with the City Clerk. 3. The work to be performed under STORM SEWER IPiPROVEgENT PROJECT NO. 40 -1960, shall be performed under one con- tract. The City Manager shall accordingly prepare and cause to be inserted in the official newspaper advertise- ments for bids upon the making of such improvements under such approved pland and specifications. The advertisement shall be published for 3 weeks (at least 21 days), and shall specify the work to be done and will state that bids will be opened and considered at 12:00 o'clock noon, on the 15th day of November, 1960, in the council chambers of the City Hall, and that no bids will be considered unless sealed and filed with the City Clerk, and accompanied by a cash deposit, bid bond, or certified check payable to the City for five percent (5 %) of the amount of such bid. That the advertisement for bids for STORM SE =1 I11PROVEMENT PROJECT NO. 40 -1960 shall be substantially in form as that noted in Exhibit "B" attached hereto for reference and made a part hereof. Greig CITY MANAGER - Earl Wagner ATTEST: CITY CLERK - Marvin 0..Brunsell RESOLUTION N0. 139-196 A RESOLUTION PERTAINING TO STRAIGHTENING OF OSBORNE ROAD Tpn0REAS, Osborne Road extends from East River Road in the City of Fridley to Stinson Boulevard, on the East City Limits of the City of Fridley, and lm'HEREAS, That stretch of Osborne Road lying East of University Easterly to Old Central is on the joint limits of the Village of Spring Lake Park and the City of Fridley, and is a County Road between those points, and WHEREAS, From approximately one- quarter mile east of Highway No, 56. Westerly to East River Road, Osborne Road curves sharply to the south, and WHEREAS, Said curvature of Osborne Road results in a hazardous crossing of the railroad tracks west of Highway No. 56, RE50LUTi0N 90. 138 EXTTIPIT "A" SS X40 CITY OF FRIDLEY WHEREAS, the City Council of the City of Fridley, Anoka County, Minnesota, has deemed it necessary and expedient that the improve- ments hereinafter described be made. NOW, THEREFORE, NOTICE IS HEREBY GIVEN THAT on the 4th day of October, 1960, at 8:00 o'clock P.M., the City Council will meet at the City Hall in said City, and will at said time, and place hear all parties interested in said improvements in whole or in part. The general nature of the improvements is the construction (in the lands and streets noted below) of the following improvements, to —wit: CONSTRUCTION ITEM A. Storm Sewer System for the Parkview Oaks Addition located in and serving all of the area described as follows: 11 The area that is within the corporate limits, North of T.H. No. 1000 East of T.H. No. 65, South of Central Avenue, and Gardena Avenue, and West of East Corporate Limits. ESTIMATED COST ....................... .................t 87,314.00 THAT THE AREA TO BE ASSESSED FOR SAD IMPROVEMENTS (AND EACH OF THEM) IS AS FOLLOWS: FOR CONSTRUCTION ITEM A, ABOVE: All of the lands abutting upon said streets named above and all the lands located North of T.H. No. 100, East of T.H. No. 659 South of Central Avenue and Gardena Avenue and West of East Corporate Limits, and all lands adjacent and abutting thereto. All of said lands to be assessed proportionately according to the benefits received by such assessments. That the Council proposes to proceed with each of said improvements as separate improvements as separate improvements, except as hereafter otherwise provided by the Council all under the following authority, to— wit: Minnesota Laws 1953, Chapter 398 and laws amendatory thereof, and in conformity with the City Charter. The Project consists of the following approximate quantities: 4460 Lin. Ft. 12 to 48" RCP Storm Sewer with appurtenances. 800 Lin. Ft. of 10 Ft. width open drainage ditch. All bids must be made upon printed proposal forms, furnished and in accordance with the plans and specifications. Plans and speci- fications may be examined at the office of the City Manager and copies may be had for the Contractor's individual use by applying to the Eng- ineers, Comstock & Davis, Inc., Consulting Engineers, 1446 County Road "J ", Minneapolis 210 Minnesota, Telephone SUnset 4 -9346. Plans and specifications may be had by depositing $25.00 per copy. Bids must be made on the basis of each payment for the work and accompanied by a cash deposit, certified check on a responsible bank in the State of Minnesota, or a bidder's bond, and payable without condition to the City of Fridley, Minnesota, in the amount of not less then 5% of the total amount of the bid accompanying such cash deposit, certified check or bidder's bond. The City Council reserves the right to waive any informalities in any bid received, and to reject any or all bids received, without explanation. No bid may be withdrawn for a per- iod of thirty days.
