RES 1960-145 - 00012889RESOLUTION NO. 144 - 1960 A RESOLUTION ORDERING PRELIMINARY PLANS, SPECIFICATIONS, AND ESTIMATES OF TIE COSTS THEREOF: (SECOND STREET BETWEEN 57TH AND 8TH). BE IT RESOLVED, by the Council of the City of Fridley, as follows: 1. That it appeare in the interest of the City and of the property owners affected that there be constructed certain improvements, to -wit: a. WATER LATERALS, service connections, and appurtanances in the following lands and along the following streets: 1. All of those streets lying in the area on 2nd Street between 572 Avenue N.E. and 58th Avenue I'J.E,, 572, Avenue N.E. between 2nd and 22, Street, and 21 Street from 5721 Avenue N.E. to 58th Avenue N.E., and all lands adjacent and abutting thereto; the same being located in the North one -half (Ni) of Section 23, T - 30, R - 24, Anoka County, Minnesota. b. SEdER LATERALS, service connections, and appurtenances, in the following lands and along the following streets: 1. In the area descrived in paragraph a, Subdivision (1) above. That the firm of Comstock and Davis, Inc., is hereby authorized and directed to draw preliminary plans and specifications and to tabulate the results of his or their estim-tes of the costs of said improvements, and to make a preliminary report of his or their findings to the Council not later than at their earliest convenience. RESOLUTION NO. 145 - 1960 EXTRACT OF MII'•.UTES OF MEETING OF THE CITY COUNCIL OF A SPECIAL MEETING HELD OCTOBER 25th , 1960, AT 7:30 O'CLOCK, P.M., AT THE CITY HALL CITY OF FRIDLEY, MINNESOTA Pursuant to due call and notice thereof, a Special meeting of the City Council of the City of Fridley, Minnesota, was duly held at the City Hall in said City on Tuesday the 25th day of October, 1960, at 7:30 o'clock, P.M. The following members were present: and the following were absent: The Clerk announced that the proposed assessment for SEWER AND WATER IMPROVEMENT PROJECT NO. 21 — 1959 Had been filed in his office on the 4th day of October, 1960, and that notice of a hearing on s,-.id assessment to be held at the Special meeting of the Council on the 25th day of October, 1960, had been given in the form and manner as provided by law. The Clerk presented an affidavit showing publication of such notice in the official newspaper, which affidavit was examined and found satisfactory and ordered pl ,-ced on file. The Mayor announced that the meeting was-open for consideration of objections to the assessment heretofore filed with the City Clerk for SEWER AND WATER IMPROVEMENT FROJECT NO. 21 — 1959• The Clerk reported that written objections had been filed by the following persons affecting the following described lots, pieces or parcels of land, to — wit: NAME OF OBJECTOR DESCRIPTION OBJECTION The following persons were then heard and presented their objections to said assessment: NAME OF OBJECTOR DESCRIPTION OBJECTION After due consideration of all said objections, Councilman introduced the following resolution and moved its adoption: RESOLUTION CONFIRMING ASSESSMENT FOR SEWER AND WATER IMPROVEMENT PROJECT NO. 21 — 1959 BE IT RESOLVED BY the City Council of the City of Fridley, Minnesota, as follows: 1. The City Clerk has with the assistance of the engineers heretofore selected by this Council for such purpose, ca.lculted the proper amounts to be specially assessed for the SEWER AND WATER IMPROVEMENT PROJECT NO.21 — 1959 in said City against every assessible lot, piece or parcel of land in accordance with the provisions of law, p.nd has prep -red nd filed with the City Clerk tabulated statements in duplicate showing the proper description of each and every lot, piece or parcel of land to be specially assessed and the amount calcul-ted against the same. 2. Notice has been duly published as required by law that this Council would meet in special session at this time and place to pass on the proposed assessment. 3. Said proposed assessment has at all times since its filing been open to inspection and copying by all persons interested, and an opportunity h -s been given to all interested persons to present their objections, if any, to such proposed assessment, or to any item thereof, and no objections have been filed; except 4. The amounts specified in the proposed -- ^ssessment are changed and altered as follows: 7. Said assessment so affirmed, adopted and confirmed shall be certified to by the City Clerk_ and filed in his office and shall thereupon be and constitute the special assessment for SEWER AND WATER IMPROVEMENT PROJECT NO. 21 - 1959 8. 5. This Council finds that each of the lots, pieces or parcels of h nd ennumerated in said proposed assessment as altered and modified w -s and is specially benefited by the 9. I n the amount in said proposed assessment as altered and modified by the corrective roll in the amount set opposite the description of each such lot, piece or parcel of land and that said amount so set out is hereby levied against each of the respective lots, pieces or parcels of land ' therein described. 10. 6. Such proposed assessment as altered, modified and corrected is affirmed, adopted and confirmed, and the sums fixed and named in said proposed assessment as altered, modified and corrected, with the changes and alterations herein above made, are affirmed, adopted and confirmed as the proper special - ssessment for each of said lots, pieces of parcels of land respectively. 7. Said assessment so affirmed, adopted and confirmed shall be certified to by the City Clerk_ and filed in his office and shall thereupon be and constitute the special assessment for SEWER AND WATER IMPROVEMENT PROJECT NO. 21 - 1959 8. The amounts assessed against each lot, piece or parcel of land shall be-r interest from the date hereof until the same have been paid t the rate of six per cent 6% per annum. 9. Such assessment shall be payable in twenty equal annual installments p -yable on the 1st day of January in each year, beginning in the year 1960, and continuing until all of said installments shall have been paid, each installment to be collected with taxes collectible during s =id year by ' the County Auditor. 10. The City Clerk is hereby directed to make up and file in the office of the County Auditor of Anoka County a certified statement of the amount of all of such unpaid assessments and the amount which will be due thereon on the 1st day of January in each year. The motion for the adoption of the foregoing resolution was duly seconded by Councilman , and upon vote being taken thereon the following voted in favor thereof: and the following voted against the same: WHEREUPCL SAID RESOLUTION WAS DECLARED DULY PASSED AND ADOPTED ON THIS 25th DAY OF OCTOBER, 1960.
