Hannan from the Great Northern Railway was present, and stated that the Great Northern Railway was in favor of this rezoning. Jerome Pazzell, 6161 - 6th Street stated �� that half of 6th Street is in now, and wondered what the method of assessment would be when the Ualance of the street was put in. The standard method of assessment of streets was explained. LETTER FROM E AND M DEVELOPMENT COMPANY CONCERNiNG SPECIFICATIONS OF STREET SURFACING AND OTHER MATTERS RELATING TO IMPROVEMENTS There was discussion on the street specifications, and the City Manager stated that he had the dates the plats were approved, but it was hard to tell �ust when the street specifications were up-graded, and when they went into effect The Manager stated that Mr. Kirchman had apparently told the developer that he could use the old specifications in Brookview Terrace and Rice Creek Plaza, and then later had changed his mind. Mr. Nagel, former Council member, stated th�t he felt that the plat had not come in until the following year. The first request by the developer was that street surfacing and ciirbs be installed on Main Street along with moving necessary hydrants and catch basins, and the cost be assessed to the benefited property owners Motion by Nee that a public hearing be set on the above matter. Seconded by Wolke. Upon a voice vote, there being no nays, the motion carried unanimously. UEST BY THE DEVELOPER THAT HE BE RE ONTO THE LINES PUT IN. Mr. Nee stated that the City should honor its co�itment if it had told the developer that he would be re-imbursed. The City Menager explained the problem. Motion by Wolke to proceed with the necessary steps so that the developer may be re-imbursed for a portion of his expenses in those instances where other property owners connected to his line. Seconded by Nee Upon a voice vote, there being no nays, the motion carried unanimously. The second request by the developer was that the City accept the streets in Brookview Terrace and Rice Creek Plaza North Addition as now constructed, which is in agreement with the original plans, and to refund the escrow deposits on Brookview Terrace. Mr. Wolke stated that he thought there should be more background on this matter The City Manager stated that he h�d checked the records, and several other people had checked the records, and it could not be definitely determined when these street specifications were changed Mr Nee stated that the City should abide by the agreement made by its agent, the City Engineer. Motion by Johanson to accept the streets in Brookview Terrace and � ��_�, �� Rice Creek Plaza North Addition as now constructed, and to refund the escrow for seal coating. Seconded by Nee. The developer requested that he be notified if there is eny change in the street specifications for Melody Manor Motion by Johanson that the developer be notified that he is to instail the streets according to specifications now used by the City. The developer had also requested information as to what the final cost of the � improvements would be for water and sewer mains in his Rice Creek Pl�za North plat. It was explained that this could not be definitely determined at this time., as the pro�ect which would affect the assessment has not been constructed. Mr. Sheridan stated that the petition that caas circulated called for a 20 year assessment spread He also suggested that maybe the parties involved should be contacted, and the difference between a ten and a twenty year assessment spread be explained to them, so that they may see what the difference in cost would be between a 10 and 20 year spread. CONSIDERATION OF COUNTER FOR STATE AID REQUIREMENTS: The City Manager read a letter from the City Engineer whereby the Engineering Department was requesting approval of a traffic counter which would cost $410 00, to be taken out of State Aid funds Motion by Wolke to approve this pis chase. NORMAN: The City Manager stated that the Planning Commission had recommended denial of this lot split Mr. Kohlan stated that the restrictive covenants in this arez provide for only one house per 1ot. Mr. Kohlan suggested th�t the Building Permit be denied for the second residence on this 1ot, and the party who is � asking for the permit could then bring action if they so desired against the City. The attorney for Mr. Norman stated that the Council is assuming jurisdiction over a civil matter, and he did not feel that this action, which his client is requesting is in violation of the covenants, and stated that someone will have to bring action a�,;��.s� the City, if the request is not granted. Mr. Kohlan read the covenants which cover the Moore Lake Hi11 area. He stated that when. the plat was approved, each lot was one building site, and the covenants called for one house per lot, or building site.
