RES 1962-153 - 000125321e RESOLUTION NO. 153 -1962 A RESOLUTION ORDERING IMPROVEMENTS, APPROVAI: OF PLANS AND ORDERING ADVERTISEMENT FOR BIDS (SEWER AND WATER IVPROVEI'ZNT PROJECT NO. 59 - 63RD AVENUE - FILLMORE AND HIGI1l;AY NO. 100) WHEREAS, the resolutions of the City Council No. 45 -1062 dated June 4, 1962 and No. 131 -1962 dated September 4, 1962, set the date for hearings on the proposed improvements, as specifically noted in the notices of hearing attached hereto for reference as EXHIBIT "A ", and, WHEREAS, all the property owners whose property is liable to be assessed with the making of these improvements (as noted in said notice) were given ten (10) days notice by mail and published notice of the Council hearing through two (2) weekly publications of the required notice, and the hearing was held and the property owners heard thereon at the hearing, as noted in said notice. NOW, THEREFORE, BE IT RESOLVED, by the Council of the City of Fridley, Minnesota, as follows: 1. That the following improvements heretofore proposed by Council resolution are hereby ordered to be effected and completed as soon as possible, within reason, to -wit: (a) All of the improvements as noted in the notices of hearings on the same as are noted (in 'rahibit "A" in said notice) except (none): that the work involved in said improvements as listed above shall hereafter be designated as: SEWER AND WATER IMPROVEMENTS PROJECT NO. 59 2. The plans and specifications prepared by Comstock and Davis, Con- sulting Engin =ers, for such improvements and each of them, pursuant to the Council- resolutions heretofore adopted, a copy of which plans and specifications are hereto attached and made a part hereof, are hereby approved and shall be filed with the City Clerk. 3. The work to be performed under SEWER AND WATER IMPROVEMENT PROJECT NO. 59 shall be performed under one contract. The City Manager shall accordingly prepare and cause to be inserted in the official newspaper advertisements for bids upon the making of such improvements under such approved plans and specifications. The advertise- ment shall be published for two (2) weeks (at least 10 days), and shall specify the work to be done and will state that bids will be opened and considered at 12:00 Noon on the 15th day of October, 1962, in the Council Chambers of the City Hall, and that no bids will be considered unless sealed and filed with the City Clerk, and accompanied by a rash deposit, bid bond, or certified check payable to the City for five percent (5 %) of the amount of such bid. That the advertisement for bids for SEWER AND WATER IMPEOVEtmNT PROJECT NO. 59 shall be substantially in form as that noted in Exhibit "B" attached hereto for reference and made a part hereof. All of said land to be assessed proportionately according to the benefits received by such improvements. That the Council proposes to proceed with each of said improvements as separate improvements, except as hereafter otherwise provided by the Council all under the following authority, to -wit: Minnesota Laws 1953 Chapter 3Q8 and laws amendatory thereof, and in conformity with the City Charter. GREIG 1 X53 RESOLUTION NO. 153 EXIIIBIT "B" S &W #59 NOTICE TO CONTRACTORS Sealed bids will be received, publicly opened and considered by the City Council of the City of Fridley, Anoka County, Minnesota, at the office of the City Manager in said City of Fridley, on the 15th day of October, 1962, at 12 :00 Noon for the furnishing of work and materials for the installation of Water and Sanitary Sewer Improvene nt project Number 59. The project consists of the following approximate quantities: 2,600 Lin. Ft. 8" and 6" Sanitary Sewer Lines with appurtenances 2,200 Lin. Ft. 6" and 1" Water Lines with appurtenances All in accordance with plans and specifications prepared for the City of Frridley, Minnesota, by Comstock & Davis, Inc., Consulting Engineers, 1446 County Road "S ", Minneapolis 32, Minnesota, Tele- phone: SUnset 4 -9346. P1Ans and specifications may be examined at'the office -of the City Manager, and copies may be obtained for the Contractor's individual use by applying to the Engineers and depositing with the Engineers $25.00 for each set. The deposit will be refunded to each bV der submitting a bonafide bid upon return of the doc- uments in good condition within ten (10) days from the date of opening bids. Bids must be made on the basis of cash payment for the work, and accompanied by a cash deposit, certified check ( on a res- ponsible bank in the State of Minnesota ), or a bidder's bond and made payable without condition to the City of Fridley, Minn- esota, in an amount of not less than 5% of the total amount of the bid. The City Council reserves the right to reject any and all bids and to waive any informalities in any bids received without explanation. No bid may be withdrawn for a period of thirty (30) days.
