RES 1962-36 - 0001235141 newspaper of the City of Fridley according to law, such notice to be sub- stantially in the form and substance of the notices attached hereto as EXHIBITS "A ", "B ", and "C ". Each of said improvements as noted in the respective notices attached as Exhibits hereto shall be treated as separate improvements, except insofar as the Council shall otherwise hereafter determine. The Council shall at the time set in said notices,t and each of them, as contained in EXHIBITS "A ", "B ", and "C:' attached hereto and made a part hereof by reference, meet at the time and place set therein and hold such corrective public hearings according to law, and for the purpose of correcting any invalid procedure heretofore taken by the Council with respect to said improvements, and each of them. This Resolution and the hearing to be held with respect thereto is:, passed pursuant to Minnesota Statutes, Section 429.071 and the Charter of the City of Fridley. Brunsell RESOLUTION NO. 36 -1962 RESOLUTION ORDERING IMPROVEMENT AND FINAL PLANS AND SPECIFICATIONS SEWER AND WATER - #55 WHEREAS, Resolution #24 -1962 of the City Council adopted the 16th day of April, 1962' set the date for hearing on the proposed improvement, as specifically noted in the Notice of Hearing attached hereto for reference as Exhibit "A ", and WHEREAS, All of the property owners whose property is liable to be assessed with the making of these improvements (as noted in said notice) were given ten (10) days published notice of the Council hearing through two (2) weekly publications of the required notice, and the hearing was held and the property owners heard thereon at the hearing, as noted in said notice. NOW, THEREFORE, BE IT RESOLVED, By the Council of the City of Fridley, Anoka County, Minnesota, as follows: 1. That the following improvements proposed by Council Resolution #24 -1962 are hereby ordered to be effected and completed as soon as reasonably possible to -wit: a. All of the improvements as noted in the notice of hearing on the same as are noted (in Exhibit "A ") in said notice. That the work above may be consolidated with other areas as one improvement. 2. The work to be performed under this project may be performed under one or more contracts as may be deemed advisable upon receipt of bids. 3. Comstock and Davis, Inc., Consulting Engineers and the City t ii I i1 42 Engineer, are hereby designated as the Engineers for this improvement. GREIG ATTEST: CITY CL K - Marvin C. °Bfu ns'ell RESOLUTION N0. 37 -1962 RESOLUTION APPROVING COOPERATIVE AGREEMENT BETWEEN THE CITY OF FRIDLEY AND ANOKA COUNTY FOR CURB AND GUTTER CONSTRUCTION ON S.A.P. 02- 635 -01. WHEREAS, Anoka County has prepared plans and specifications for the improvement of a portion of Old Central Avenue (CSAH $35) within the corporate city limits, and WHEREAS, Anoka County Engineer's office has estimated the City's share of the cost of the concrete curb and gutter to be $14,053.00, and WHEREAS, Anoka County has asked the Council of the City of Fridley to accept this estimate as the City's share of the cost of the total project; NOW, THEREFORE, BE IT RESOLVED, By the Council of the City of Fridley that: 1. The City of Fridley participate in the improvement of a. portion of Old Central Avenue Northeast as described above. 2. That the Mayor and the City Manager are hereby authorized and directed to sign a cooperative agreement with the County of Anoka, for the City of Fridley to participate in the above estimated cost. Brunsell RESOLUTION NO. 36 EXHIBIT "A" S &W #55 CITY OF FRIDLEY NOTICE OF HEARING ON IMPROVEMENTS WHEREAS, the City Council of the City of Fridley, Anoka County, Minnesota, has deemed it necessary and expedient that the improVo- meets hereinafter described be made. NOW, THEREFORE, NOTICE IS HEREBY GIVEN THAT on the 7th day of May, 1962, at 8:00 o'clock P.M., the City Council will meet at the ' City Hall in said City, and will at said time, and place hear all parties interested in said improvements in whole or in part. The general nature of the improvements is the construction (in the lands and streets noted below) of the following improvements, to -Wit: CONSTRUCTION ITEMS: A. Watermain and Sanitary Sewer Lateral and Sa vice Connections located in all of the streets and serving all of the area described as follows: 1. 6Lth Ave. from alley E. of Central to Arthur Street. 2; Plat of Moore Lake Hills, 2nd Addn., Gardena Meloland Gardens and part of the Yeloland Gardens Addn. 3. 22 St. from 572 Ave. to 58th Ave. (Sewer only). 4, Taylor Street - in Marian Hills 2nd Addition (Water only). ESTIMATED COST ............. .................... $ 59,360.00 THAT THE AREA PROPOSED TO BE ASSESSED FOR SAID IMPROVEMENT IS AS FOLLOWS: ' FOR CONSTRUCTION ITEM A. ABOVE: All of the land abutting upon said streets named above and all lands adjacent and abutting thereto. All of said lands to be assessed proportionately according to the benefits received by such improvements. That the Council proposes to proceed with each of said improve - ments as separate improvements, except as hereafter otherwise provided by the Council all under the following authority, to -wit: Minnesota Laws 1953, Chapter 398 and laws amendatory thereof, and in conformity with the City Charter.
