RES 1962-85 - 00012440e: 0 � RESOLUTION NO. 85 -1962 A RESOLUTION RECEIVING THE PRELIMINkiY REPORT AND CALLING A PUBLIC HEARING ON THE NATTER OF THE CONSTRUCTION OF CERTAIN IMPROMIENTS: STREETS PROJECT ^�O. ST 1962 -3 WHEREAS, the construction of certain improvements is deemed to be in the interest of the City of Fridley and the property owners affected thereby. BE IT RESOLVED, by the City Council of the City of Fridley, as follows: 1. That the preliminary report submitted by Comstock and Davis Inc., Consulting Engineers, is hereby received and accented. 2. That this Council will meet on the 4th day of September, 1962, at 8:00 o'clock P.M., at the City Hall in the City of Fridley for the purpose of holding a Public Hearing on the improvement noted in the Notice attached hereto and made a part thereof by reference, Exhibit "A ". 3. That the area proposed to be assessed for said improvements and each of them as noted in said notice are all the lands and areas as noted in said notice: All of the same to be assessed pro- portionately according to the benefits received. Z. That the City Manager is authorized and directed to give notice of such Public Hearing by publishing a notice thereof in the official newspaper of the City of Fridley according to law, such notice to be substantially in the form and substance of the notice attached hereto as Exhibit "A ". ADOPTED BY THE CITY COUNCIL OF THE CITY OF FRIDLEY THIS 6th DAY OF AUGUST, 1962. (Signatures con't on page #89) t _. tom... - - - RE'SOLUTTON NO. 85 EXHIBIT "A" 1962 -3 St. CITY OF FRIDLEY NOTICE OF HEARING ON nTROVEMENTS WHEREAS, the City Council of the City of Fridley, Anoka County, Minnesota, has deemed it necessary and expedient that the improvements hereinafter described be made. NOW, THEREFORE, NOTICE IS HEREBY GIVEN THAT on the 4th day of September, 1962, at 8:00 o'clock P.i•`., the City Council will meet at the City Hall in said City, and will at said time, and place hear all parties interested in said improvements in whole or in part. The general nature of theimprovements is the construction (in the lands and streets noted below) of the following improvements, to -wit: CONSTRUCTION ITEM: ( ST. 1962 -3 ) A. Street base and surfacing and asphalt curb or concrete curb and gutter and appurtenance work located in all the streets and serving all the area described as follows: 1. 75th Avenue W.E. from University Avenue N.E. to 4th St. N.E. 2. 4th Street N.E. from 75th Avenue N.�. to 76th Avenue N.r,. 3. 76th Avenue N.E. from 4th Street N.E. to 5th Street N.E. 4. 75th Avenue N.E. from 4th Street N.E. to 5th Street N.E. 5. 5th Street N.E. from 75th Avenue N.E. to Osborne Road. 6. Service Drives ( Fast side T.11. No. 47) from 75th Avenue N.E. to Osborne Road. ESTIMATED COST (with asphalt curb ) ............................$ 42,290.00 ESTIMATED COST (with concrete curb and gutter) ................$ 55,670.00 THAT THE AREA PROPOSED TO BE ASSESSED FOR SAID IMPROVEMENT IS AS FOLLOWS: FOR CONSTRUCTION ITEM A. ABOVE: All of the land abutting upon said streets named above and all lands adjacent and abutting thereto. All of said land to be assessed proportionately according to the benefits received by such improvements. WAGNER CITY MANAGER NEWS: Aug. 23, 30, 1962 MAYOR Greig =Y MANAGM Ears P.,/Magner ATTEST: IdITYY CLE -` Marvin C Brunsell RESOLUTION NO. 86 -1962 A RESOLUTION RELATING TO THE MAKING OF ASSESSMENTS FOR CERTAIN SEWER AND WATER MAINS, LATERALS, AND SERVICE CONNECTIONS BE IT RESOLVED, by the Council of the City of Fridley, Anoka County, Minnesota, as follows: Section 1. The provisions of Ordinance No. 113 of the City of Fridley provide that no connection shall be made or continued in use at any time with respect to any sewer or water service serving the property of any person or occupant of any parcel if payment has not been made or provided for (by assessment or otherwise) with respect to said parcel or property of the full and proportionate share of the cost of such service to the parcel or property. Section 2. The City Clerk shall accordingly investigate and search the records of the City with respect to the connections made and in use and with respect to payment of charges and assessments and costs thereof and determine whether or not any parcel of land or property is connected to _ and making use of the sewer and water systems of the City without having paid or provided for (by assessment or otherwise) of its full and proportionate share of the cost of such service to the parcel or property. Section 3. That upon such determination the Clerk shall give notice to the owner or occupant of the charges, assessments, and costs to be so apportioned and to be paid, and upon fail- ure of the owner or occupant to make such payment or provide otherwise therefor within a reasonable period of time (not in excess of 60 days) the Clerk may and shall prepare an assessment roll with respect thereto and upon a hearing held thereon and confirmation of the roil, the assessments therein contained shall be certified to the County Auditor in the same manner as provided by Statutes in other cases. Section 4. The Clerk upon receipt of any such monies, shall deposit the same in the funds of the City, first to the credit of any fund or account established and created with re- spect to the construction of such improvement and service and payment of the costs thereof; provided that should such deposit and credit create a surplus in such fund or account, then the Clerk may deposit the same to any similar fund or account in which a deficiency exists.
