AN ORDINANCE CREATING AND ESTA.BLISHING FIRE LIMITS
WITHIN THE CITY OF FRIDLEY, AIVD AMENDING CHAPTER 46
OF THE CITY CODE OF THE CITY OF FRIDLEY AS TO FIRE
LIMITS AND FIRE DISTRICTS.
The City C oLmcil of the C ity of Fridley do ordain as follows:
Section 1. A.section to be known as 46.3 is hereby added to
the C ity Code of Fridley providing as follows: •
�Section 46.3.� There are hereby created and estab-
lished in the City of Fridley certain areas designated as the
FIRE LIMITS.
(a) All areas designated on the City of Fridley
Zoning Map as being classified in Zone C2 and C 2S shall be deemed
as within the fire limits.
(b) All occupancies classed as C2 or C2S under
Chapter 45 of the City Code shall be deemed as within the fire
limits when constructed in either Zones M1 or M2.
• Section 2. That Chapter 46 of the �ity Code shall have added
to it the following sub-sections;
46.029. The provisions of C hapter 16 of the Uniform
Building Code shall be revised to read as follows:
For the purpose of this Code, the entire C ity
is hereby declared to be a fire district, and within the dis-
trict certain areas sha11 be designated as the FIRE LIMITS.
Whenever reference is made in this Code to any FIRE LIMITS
it shall mean the fire limits created and established by this
Chapter o
46.030. The provisions of Sectiori 16.03 of Chapter
16 of the Uniform Building Code as to items A through C of said
Section shall be deleted and not be a part of this Chapter.
460031. Section 16.04 of the Uniform $uilding Code,
Chapter 16 shall be revised and amended to read as follows;
Any building or structure complying with the
requirements of this Code may be erected, constructed, moved
within or into the fire district.

tidHEREAS, it is necessary to acquire an easement for utility •
;arposes in connection with the storm sewer and other utility construction
involved with Project SB, and
WHEREAS, the C ontract has been let for the construction work in
Project SB, and
WHEREAS, a voluntary easement was contemplated for the easement
necessary in Lot 5, Block 3, Bennett Palmer Addition, but that said easement
has not been forthcoming, and
WHEREAS, the City C ouncil has previously determined that the
Project was feasible and necessary, and has approved the plans and speci-
fications, and

� WHEREAS, the easement that is required may be more fully
described as follows:
A permanent easement over the South 10 feet
of Lot 5, Block 3, Bennett Palmer Addition, accord-
ing to the map or plat thereof on file and of record �
in the office of the Register of Deeds in and for �
Anoka County, Minnesota, and together with a con-
struction easement for a temporary period over the
following described land: The North 10 feet of the ,
South 20 feet of T,ot 5, Block 3, Bennett Palmer
Addition, according to the map or plat thereof on
file and of record in the office of the Register
. of Deeds in and for Anoka C ounty, Minnesota.
� NOW, TI�REFORE, BE IT RESOLVED by the C ity Council of the C ity
of Fridley,;Anoka County, Minnesota, as follows:

1. It is necessary for the purpose of storm sewer and utility
construction that the above stated easement be taken;
2. That said easement is to be used for utility purposes;
3. That the attorneys for the City are authorized and directed
tc acquire such easement by condemnation action in Anoka C ounty District
Court,
The motion for the adoption of the foregoing Resolution was
duly seconded by C ouncilman Sheridan, and upon vote being taken thereon
