ROLL CALL: Members Present; Nee� Wright, Sheridan, Kirkham, Johaneon Memb�rs Absent; None NEW BUSINESS: callad �o ox'der at CbURT FACILITIES AND PERSONNEL (TABLED 2�3�64): ", Mayor Nee announced the consideration of court facilitiea and personnel and stated Judge Johnson and Judge Herrick were preaent to address'the;City Council. Judge Elmer Johnson stated they had prepared s report that thQ�City�Council had in hand and he wished to go over some points of this report. He'fUrther stated that he and Judge Herrick had discusaed the itema. The population 3n.,Fr�dley had grown from 3�700 to a probabl� 23�000 with the same facility ea before and the total case laad at approximetely 1650 cases in the last year ,if,consideration had been given to conciliation cases� there-was.a need for additioaal eourt fecilities and they were chiefly talking ebout office apace. He explained �he present room was sufficient Sor ,jury cases and takee care of the gxet�est number of any avdienee but the clerk's office aaas an embarassing problem and it was impossible to use their present ofPice. He ilzrther explsined the solution suggested was an office in the Madsen Euilding next door and anpther suggestion had been the possibility of the Chief of Police's interrogation room and their present office being made into one ofPice. Thi� sug�estion� he etated� wou].d more than double their space and give them adequate accomodations. It was �� d mentioned there wae the posaibility of new construction South of the present building ia,the'Yire etetion. Mayor Nee explained the Fire Department had suggested they would rgther not have prisonere in with the equipment, Mayor Nee asserted it did aeem they would have to�develop some good space. Judge Johnson said they would want aometh3ng that was private, that Fridley ie the only court that doee not have a iu11 time clerk with the heavy case loads as other courts heve and the handling neceseary for future loads as the caee loeds expaed., �— Judge Johneon exple,ined they had 40,$ more case loade in the first two months I of the preaent year and the State of Minnesota has said they are going to put out saturation programa; that Fridley was number one for accidants for 1963 in the 15�000 to 20�000 population clasa. There are, it was explained, eight c�ties in ttiat populetion class in the area. Tudge Johnson stated to the City Couneil,that by,the end of the yeary they would be able to give the council knowled�e if it.would be convenient to divide the case load� that there was the poeeib3lity o3 new legislation for the two judges to ahare the case load. Sudge Virgil Herrick etated he had nothing to add to Sudge Johnson's statements. Councilman Johanaon stated he was in complete accord with Judge Johnson in the need for additionsl space. Motion by Jphaneon that the City of Fridley eetablish the position oF a full- time Clerk oY Court under the terms presented and that the City of Fridley enter into a le�ee agreement with Madsen Reelty Yor office chambers at $75,00 per month and 8t'the earliest possible date. Seconded by Kirkham. Upon a voice vote� there being no nays� the motion carried unanimouely. Councilmen Wrigh� inquired if a motion wae in order for a resolution of Item #3 in support oi Judge Sohnson and Sudge Herrick� that there wae no official action to be taken by the City Council but if a reaolution were on record irom Fridley� they could get early action from the legislature and as it was a joint request by the judges and a part of the balence of their request, the City Council ahonld aet on this item. Motion by Wright that the City of Fridley intends to modify the Municipal Court to have two Municipal Judges if and when it is authorized to do so by the State Legislature. City Attorney Smith stated there was more to this than just the particular motion� that it is suggested that Fridley perhaps, should get some clarification from the Attorney General. Judge Herrick explained to the City Council there was some doubt as to how it could be converted but it was clear that the City Council could exercise the option and they wished to suggest the point be clarified first. City Attorney Smith explained to the City Council if they passed this motion with the understanding that he follow through to get some interpretation as they would be establishing a policy and with the Attorney General's ruling, they could decide what to do and what effectiveness it hae before e le�islative sesaion. Motion seconded by Councilman Sheridan. Upon a voice vote, there being no nays� the motion carried unanimouely. CON'PRACT FOR CONSULTIlUG ENGINEERING SERVICES: (TABLED 2�3�64): Mayor Nee anaounced the item for council consideration was the contract for Qoneulting engineering servicea and stated it was a modification of the pre- vious contxact and there was a propoeal for an amendment to the contract, City Attorney Smith atated he had canver�sed with Consulting Engineer Comstock and the euggeetad addition to Article #1 we.s satisfactory� the deletion of Article �8 wae satisYactory end the article presently marked Article 9 would be rennmbered #B.,,The suggested sddition to Article #1 was to include the following:_ �The_City reserves the right to retain other engineers on projects ii it so desirea and the City reservee the right to sign similar contracts with others". Mayor Nee atated he would wiah to have the matter resolved. Motion by Wright that the City of Fridley adopt the Agreement for Services of Consulting Engineers� se revised, between the City of Fridley and the firm of Comstock and Davis� Inc.� and authorize the Mayor and City Manager to execute the eaid agreement. Councilman Sheridan stated the word "contrect" had been referred to and inquired if it would not be better to use the word "agreement" in its plsce. City Attorney Smith replied it made no differenee but in the concept oP the Counnil members they preferred the word "agreement" and it might be more descriptive and sta�ed he would change the reading of the addition to �i f� r include the word "agreement" rather than "QOntract", Seconded by Sheridan.
